On January 29, it became clear at a DPJ General Meeting for Health Welfare and Labor issues that Chinese temporary workers (haken sha-in), have caused problems with digital conversion of handwritten data into online computer databases.

The old system using handwritten passbooks has resulted in about 14,660,000 future pensioners, who have paid into the system but are not yet recorded as eligible for benefits, going unrecorded digitally.

According to the Social Insurance Agency, between December 10 and 20 of last year, about 60 foreign temp workers were inputting data. However, their inability to input correct kanji readings, or separate surname and first names of entrants, had caused errors in the system. The Social Insurance Agency says that by switching all these workers with Japanese people, they’ve corrected all errors, and are now considering lowering the amount of money paid out to the companies brokering their temp workers.

More than 2.08 million foreigners now live in Japan. With the rise in international marriages between Japanese and non-Japanese, the number of children who have dual nationality is also increasing. Of them, tens of thousands attend schools for foreigners.

Currently, there are about 100 schools for North and South Korean and Chinese children. In recent years, a growing number of people from South America and elsewhere have settled in Japan.

Schools to accommodate children of such “newcomers” are also increasing. There are 94 Brazilian schools and also schools for children from Peru, India, the Philippines and other countries. The total number of schools for newcomers exceeds 100.

Chinese schools in Japan have a history of more than 100 years, while ethnic Koreans from North and South Korea established schools for their children after World War II to teach them the language and cultures of their motherland. Thus, schools for foreigners in Japan have various backgrounds.

Schools for newcomers are concentrated in the Tokai and northern Kanto regions, home to many Brazilians and Peruvians who work as dispatch employees at automakers and other factories.

A Brazilian school in Ibaraki Prefecture celebrated its 10th anniversary last year. It started out as an unauthorized day-care center for children whose parents work at factories from early morning until late at night. As the children grew, the center set up elementary and junior high school classes.

The government does not recognize schools for foreigners as regular schools that provide general education. Therefore, they do not receive any government subsidies. Most of the schools are supported by donations from fellow countrymen.

While donations to European and American schools are now tax-exempt, the same rule does not apply to North and South Korean and Chinese schools, which are also categorized as kakushu gakko (miscellaneous schools).

Since most schools of newcomers are not even recognized as kakushu gakko but are treated as “private juku,” they are not even eligible for subsidies from local governments.

Some local governments have eased authorization standards for kakushu gakko. But in Gunma, Saitama and other prefectures that apply strict standards for authorization, it is difficult for most schools for newcomers to meet the requirements. Many of them rent small factories that went out of business and split them into six to nine classrooms to give lessons. Such schools do not even have gymnasiums or schoolyards.

Japanese children are guaranteed free compulsory education at public elementary and junior high schools. Accredited private schools also receive generous government subsidies. However, when parents of foreign nationality enroll their children at foreign schools because they want them to learn the languages and cultures of their homelands, they are not eligible for public support measures.

Moreover, at schools not authorized as kakushu gakko, consumption tax is imposed on tuition. Since students are not eligible for a student commuter pass, parents are required to bear a heavier financial burden than their counterparts at Japanese schools.

Although there are more than 200 foreign schools in Japan, few public subsidies apply to them. Most of the schools rely on the self-help efforts of foreign communities alone and are excluded from the realm of public education.

I believe there are few countries in the world like Japan where foreign schools are at a disadvantage compared with regular schools.

As Japan is about to become a “multinational, multiracial and multicultural” society, it is time we break away from “national education” and switch to “multiracial and multicultural symbiotic education.”

For that, we must establish guidelines for education that embrace multiracial and multicultural values and immediately implement systematic support, such as legislation to promote measures for schools for foreigners.

Doing so also meets Japan’s obligation under the international conventions on human rights including the U.N. Convention on the Rights of the Child.

It is also the duty of adults for children of the 21st century.

Hi Blog. Oh well, never mind the DPJ trying to split New Komeito off from the LDP. Seems the Suffrage for Permanent Residents issue has set the DPJ against itself as well, according to Japan Today. This issue is not settled by any means (the DPJ is all over the map ideologically anyway, so this degree of dissent is quite normal, actually), so let’s see where the kerfuffle goes. But for all the people that say that Japan’s NJ demographics and labor issues are politically insignificant, we may in fact be seeing quite a few fault lines between old and new Japan after all… Arudou Debito

DPJ holds opposing meetings on foreigners voting in local elections

TOKYO — Members of the Democratic Party of Japan on Wednesday held two separate meetings, one involving lawmakers and proxies who support allowing foreigners with permanent residence status to vote in local elections and another involving those opposed to the idea.

While DPJ members emphasize that they will not allow the issue to create an intra-party division, the development apparently shows that members of the largest opposition party do not see eye-to-eye on the matter.

About 80 DPJ lawmakers and proxies attended an inaugural meeting of a group supporting the idea shortly past noon, while approximately 50 gathered in the afternoon for a study session opposing it.

Both gatherings, held in the Diet building, were attended by 23 parliamentarians each.

DPJ Vice President Katsuya Okada, who was elected chairman of the group supporting the idea, expressed his readiness to work on drafting a bill to grant local suffrage to permanent residents for submission to the Diet during the ongoing regular session through June.

“This issue has been an ardent wish for the DPJ for many years. There are various opinions within the party, but we want to gain the understanding of many and to present the bill” to parliament, Okada said at the outset of the group’s meeting.

In the other gathering, Kozo Watanabe, the DPJ’s top adviser, said it was necessary to discuss the issue cautiously while seeking unity among all party members.

“It is a very important issue. We will not start out with a conclusion but rather study how we can gain the understanding of the people,” Watanabe said.

Those attending the meeting opposing the idea decided to request that the issue be discussed by the DPJ’s shadow cabinet.

DPJ President Ichiro Ozawa has expressed support for the idea to allow permanent residents to vote in local elections and made remarks to that effect when he met with an envoy of South Korea’s President-elect Lee Myung Bak in Tokyo in mid-January.

The South Korean government has repeatedly called on Japan to allow permanent residents of Korean descent, who make up the bulk of foreign residents in Japan, to vote in local elections. South Korea allowed foreigners who have lived in the country for more than three years after obtaining permanent residency to vote in local elections for the first time in June 2006. While many members of Japan’s ruling Liberal Democratic Party are opposed to granting local suffrage to permanent residents, its coalition partner, the New Komeito party, has long pushed for the move.

LDP lawmakers who oppose the idea argue it could violate the Constitution, saying the supreme law gives the Japanese people the “inalienable right” to choose electorates in Japan.

Under current laws, only citizens with Japanese nationality aged 20 or over are eligible to vote in local and national elections.

Some municipalities in Japan have passed ordinances to allow foreign citizens with permanent resident status to vote in local referendums. (Kyodo News)

Hi Blog. Here’s something interesting–a person who naturalized due to bureaucratic exigency. My reasons are quite different, of course. And the procedure for me was easier as well. But I agree with him that even after naturalization “I just feel myself.” But of course I feel Japanese as well, FWIW. As I said, my motivations for naturalizing are fundamentally different.

The government plans to abolish the current registration system for foreigners living in Japan and introduce a new regime similar to that for Japanese residents that will manage them on a household basis, Justice Minister Kunio Hatoyama said Friday.

The new arrangement, which is being examined by a team at the Justice Ministry and the internal affairs ministry, is expected to introduce a new registry system under which detailed information of foreign residents on a household basis, instead of an individual basis, will be kept by local governments.

Critics view the new system, however, as increased state control.

Under the current general registration law it is a requirement for foreign residents’ births, deaths and marriages to be reported. But the new alien registration law will make it easier for local governments to collect such information from foreigners.

Local officials often claim it is difficult for them to provide foreign nationals with information in areas such as school enrollment, health insurance and residence tax procedures. Some are also concerned about crimes committed by foreign nationals.

While the new system may help local authorities improve their services for foreign residents, some critics say it is likely to increase governmental control over foreign residents in Japan.

Hatoyama said Friday he hopes to submit a bill to abolish the current Alien Registration Law to enable the new arrangement to be passed in the next ordinary Diet session. The plan surfaced as a result of the government’s decision last June to revise the foreign registration system by 2009 to better cope with local government needs.

“Details have not been finalized and we are not at the point of revealing” the new regulations, a spokesman for the Immigration Control Office said, but the finalized outline of the law is expected to be released this spring.

Under the Alien Registration Law enacted in 1952, all foreigners in Japan are obliged to apply for registration with the local government of their residence.

Currently, only photographs, passport and registration forms are required for the process, which are used to clarify matters pertaining to their residence and status. There were 2.08 million registered foreigners in Japan at the end of 2006.

The government is also considering replacing the current alien registration cards, which foreign residents are required to carry at all times, with a new certificate card.

Under the new system, long-term foreign residents will get registration cards at airports and local immigration offices, which will then be used to register their information at local governments.

The data will be controlled in a similar manner as for Japanese citizens, and used to compile information for taxation, health insurance programs and census-taking. Special permanent residents, including those in Japan before the war and their descendants, are also expected to be listed in the new registry system.

Makoto Miyaguchi, an official of Minokamo, Gifu Prefecture, which has a large Brazilian population, said the current law is not sufficient to provide administrative services for foreigners in his city.

“Since the current system does not gather detailed information, we have often been unable to give adequate services for foreigners in the area,” including school guidance for parents and information on welfare services, he said.

Approximately 10 percent, or 50,000 residents, in Minokamo are registered foreigners.

Miyaguchi said that both his city and its foreign population will benefit from the overall detailed management, since it will be able to better track locations and the status of foreign individuals and households.

But while some suggest that the new system will view foreigners as legitimate residents instead of objects of supervision, others say it will only strengthen government control over foreigners while providing minimal improvement in their lives.

Yoji Shimada, a Tochigi Prefecture-based public notary, said that although a change in the defective Alien Registration Law is welcome, the proposal so far shows no extensive improvement.

“Foreigners will still be listed on a separate ledger from Japanese residents, and they will most likely be required to carry their IDs at all times,” said Shimada, who is married to a Thai.

Shimada said that information on households may become more accessible by local governments, but discriminatory clauses will likely remain. “The Justice Ministry will have better control and more information on foreigners in Japan — and that seems to be the only change in the proposal for the new law,” he said.

TOKYO: A legal division within the Liberal Democratic Party, the “Project Team (PT) on Nationality Issues” (Kouno Taro, Lower House, Chair), decided at a meeting on January 24 to submit to this session of the Diet a bill, entitled “Special Exemption for Special Permanent Residents to Obtain Japanese Nationality”, which would simplify the procedure for Zainichi North and South Koreans etc. to become Japanese.

The bill would in essence provide a special procedure within the Nationality Law, limited to Zainichis, for them to receive fast-track approval within one year after application. Although in 2001 a similar bill was deliberated upon within the same committee, it was not formally submitted. Voices within the three-party ruling coalition countered, “If you create a fast-track for naturalization, you don’t need the [then-proposed] local-election suffrage bill [for Zainichis].” New Komeito countered, “We just can’t give up the Zainichi vote”, and both proposals fell through.

After January 24’s meeting, the 2001 Project Team’s former chair, Lower House Dietmember Ohta Seiichi, stressed, “I was particularly annoyed back then because we tried to take up the issue of local voting rights for Zainichis at the same time as amending the Nationality Laws. We didn’t listen properly to the needs of the actual Zainichi themselves, and look what happened. So this time, we’re only concentrating on simplifying the naturalization procedures, and not touching the local suffrage issue.”

COMMENT: Understood. But what of just granting Zainichis (or everyone who wants Japanese citizenship) Dual Nationality, and just being done with it? That would cut many a Gordian Knot–not the least being naturalization as an issue of identity sacrifice.

A major barrier to taking Japanese citizenship is indeed procedural (says I, a person who went through it), but the bigger barrier is the issue of having to decide whether or not you can stop being “Korean”, “American”, whatever, and start being “Japanese” only. You’re not allowed to be both, even though you WILL (and should) be both in a modern society, suitably tolerant of differences and plurality, as befits Japan.

EVERY ONE of Japan’s developed-country brethren allows somewhere, sometime, somehow, and officially, a measure for dual nationality. So should Japan.

No doubt Kouno Taro, a man who is doing very good works indeed (and I stress this here because I know he reads this blog), would argue that we have to do this step by step–one development here, another there. Or else, like in 2001, both issues will crowd each other out from getting through the door.

The above news is a step in the right direction, to be sure (especially if the bill actually does get passed). But people like me want more than just baby steps, and indeed would like it if naturalization were easier for everybody.

And the easiest way to make it easier for everybody would be to make dual nationality possible. Is my take.

 自民党法務部会の「国籍問題に関するプロジェクトチーム(PT)」(座長・河野太郎衆院議員)は24日の会合で、在日韓国・朝鮮人などの特別永住者が日本国籍を簡単に得られるようにする「特別永住者国籍取得特例法案」を議員立法で今国会に提出する方針を決めた。

 法案は、国籍法の手続きに特例を設け、特別永住者に限って通常1年近くかかる許可手続きを法相への届け出制に変えるのが柱。01年に与党3党が議員立法での提案を目指して自民党の党内手続きは終えたものの、党内に「特例法ができれば参政権法案は必要ない」といった意見が出たことなどから、公明党内から「参政権法案が棚上げされては困る」との懸念が広がり、提出できなかった経緯がある。

 当時、与党PTの座長として要綱案をとりまとめた太田誠一衆院議員は会合後、「前回も地方参政権との関連で取り上げられたが、心外だ。戦後、本人の意思を聞かれずに韓国朝鮮籍になった特別永住者に『申し訳ない』ということで、簡単に国籍を取得できるようにするもので、地方参政権の問題は視野に入っていない」と強調した。

The government plans to scrap the current registration system for foreign nationals living in Japan and introduce a new resident registry system similar to that for Japanese residents, Justice Minister Kunio Hatoyama said Friday.

”We are moving in the direction of deciding to abolish it,” Hatoyama told a press conference, indicating the Justice Ministry and the Internal Affairs and Communications Ministry are working to craft a bill to that end to submit in next year’s ordinary parliamentary session.

Under the current registration system, the personal data of foreign nationals living in Japan, including their address and marital status, are registered only on an individual basis and not on a household basis, hampering local municipalities from grasping the situation of foreign residents in Japan.

Since foreign residents are not obliged to report to municipalities a change of address, it has also been difficult for the authorities to provide foreign nationals with information in areas such as school enrollment, health insurance, and residence tax procedures.

The move to scrap the system comes amid mounting calls for action from local municipalities with growing populations of foreign nationals such as Brazilians of Japanese descent. Some of the children of such residents are failing to enroll in local schools at the appropriate times.

”We are unable to properly notify families having school-age children of necessary information on school enrollment,” an official from the town of Oizumi, Gunma Prefecture, where foreign nationals account for about 16 percent of the overall population.

A social insurance consultant from the town, Shuichi Ono, said, ”Some foreign residents frequently move from one place to another. Once they return to their home countries, it is not easy to send them residence tax notifications.”

Under the envisioned registration system, information on foreign residents will be handled on a household basis as well.

The government is also considering replacing the current alien registration cards, which foreign residents are required to carry at all times, with a new certificate card.

COMMENT: Pinch me. Let’s keep an eye on this one, people, as it’s fundamental to our lives in Japan–and getting rid of the Gaijin Card could be the best news we’ve had all decade. It all depends on what goes in its place. What’s with this “certificate card”, and will not carrying it 24-7 still be a criminal offense?

As commenters below put well, it’s not like any government to give up a means of control over people, especially when you consider that practically all governments to some degree control information about their foreigners (not to mention their citizens). But imagine if the Gaijin Card Checks actually became somehow less nasty (or even nonexistent–but that’s sky pie at this point), and NJ were actually formally registered as “residents” with some kind of juuminhyou?

In sum, will the new system be a way to ensure all people regardless of nationality are informed of and guaranteed the fruits of Japanese society? Or will it still just be a means to police them?

Kazuo Kitagawa, secretary-general of ruling coalition partner Komeito, has voiced support for opposition Democratic Party of Japan (DPJ) leader Ichiro Ozawa’s suggestion of considering submitting a bill to give foreigners with permanent residence status the right to vote in local elections.

“I would like a bill to be compiled and submitted,” Kitagawa said of the proposed move, adding that there had been arguments against it within the DPJ. “If they compiled it I would welcome that,” he said.

In a news conference on Tuesday, Ozawa said, “I’ve stressed before that the right for foreigners to vote in local elections should be granted. I’ve been criticized by long-time supporters, but the bottom line doesn’t change.”

There has been a strong tendency within the ruling Liberal Democratic Party (LDP) to take a cautious approach over granting foreigners with permanent residence status the right to vote in local elections. In 2005 Komeito submitted its own bill to the Diet, and the bill remains under deliberation.

Some LDP members have expressed concern over Ozawa’s comments, calling them a move to break up the ruling coalition.

 小沢氏は22日の会見で「以前から(地方選挙権を)認めるべきだと主張してきた。旧来の支持者からしかられたこともあったが、結論は変わらない」と語った。

 永住外国人の地方選挙権付与について、自民党内では慎重論が根強い。公明党は05年に単独で付与法案を国会提出、法案は継続審議となっており、自民党内には小沢発言を「与党分断策」と警戒する向きもある。【西田進一郎】

Abstract
Japan is at another one of those crossroads–where it could either head down the path of other developed countries, accepting migration and immigration as a natural part of global interdependence (preserving an economic and demographic vitality), or else become an economic backwater with an aged society, leapfrogged by China as Asia’s regional representative to the world. Official trends, including increased registering, policing, and scare campaigns towards non-Japanese entrants and residents, have tended towards the latter. However, the last two decades of economic and labor policy have been clearly towards importing unskilled workers to replace Japanese in the less savory 3K industries. This gap has made work and living conditions for many non-Japanese in Japan unequal and difficult, as they receive few constitutional or legal protections against discrimination. Moreover, many receive no labor rights whatsoever by dint of their visa. The speaker, an activist, columnist, and author on issues of discrimination, will discuss his research and activism. Plans to introduce language tests for foreigners wishing to live and work in Japan has prompted concerns from the expatriate community.

Japan’s foreign minister, Masahiko Komura, made the announcement on Tuesday, and the foreign ministry told Radio Australia the department should pursue the terms of the new requirement quickly.

The plans, announced just months after the country began photographing and finger-printing all foreign nationals on entry to Japan, have not been taken well in many quarters of Japan’s expatriate community.

Dave Aldwinckle has been a permanent resident in Japan since 1996, and is married to a Japanese with two children.

The author, columnist and human rights campaigner, who goes by the Japanese name, Arudou Debito, told Radio Australia over a million people will be affected by the move.

“And millions more if you include their families as well that are Japanese,” he said.

“To pass them all off as potential terrorists is worse than callous, in my view, it’s unappreciation for the work that people have done over here already,” Mr Aldwinckle said.

‘Another arbitrary hurdle

He says while he believes anyone wanting to live in Japan should be able to read, write and speak Japanese, it will be difficult to test and enforce.

“It’s another potentially arbitrary hurdle to put up in front of foreigners that, given the past government enforcement of policy, I’m a little bit concerned about how this is going to be enforced as well,” he said.

Dr Chris Burgess, of Tsuda College in Tokyo, says the proposed language test for foreigners is going to harm Japan in a multitude of ways.

“The new regulations, supposedly aimed at eradicating illegal residents, is just going to push them underground more than anything,” Dr Burgess told Radio Australia.

“I think, in some ways this is a poorly thought out policy and just a knee-jerk reaction to public attitudes which demand more to be done to tackle the foreign crime – a myth that you see in newspapers all the time, that foreigners are criminals; unfounded statistically, but that’s the myth.”

The Secretary General of the International Movement Against All Forms of Discrimination and Racism, Professor Mushakoji Kinhide, has another theory about the language test.

“It is, more or less, a general position of the Liberal Democratic Party leadership about the so-called overseas, Japanese-origin, Latin American migrants,” Professor Kinhide said.

The ‘Nikkei-jin’ factor

The deputy director of the Foreign Nationals Affairs Division in Japan’s Ministry of Foreign Affairs, Terasawa Genichi, told Radio Australia that ‘Nikkei-jin’ – returning Japanese emigrants and their descendants living outside of Japan – are indeed a focus in the proposed language test.

Declining an interview, Mr Terasawa did, however, stipulate that the test was not targetting any particular ethnic group.

Professor Mushakoji says the group has caused problems before.

“Unfortunately the Japanese-descent, young people who come do not necessarily speak Japanese and have very genuine cultural habits which are quite different from the Japanese and so there has been a few cases of cultural problems – Brazilian-Japanese will tend to sing and dance and be quite different in their behaviour at night,” he said.

In 2006, the then-foreign minister, Taro Aso, described Japan as “one nation, one civilisation, one language, one culture, and one race”.

Professor Mushakoji is therefore concerned about the comments of the new Foreign Minister, Masahiko Komura.

“If Komura has repeated the statement already made by Aso it is a manifestation of the Japanese government not to admit that Japan will gradually have to turn into a multicultural country and insist on keeping Japan as a homogenous society,” Professor Mushakoji said.

Naturalised Japanese citizen, Dave Aldwinckle feels, like many others, unduly targeted.

“Well, foreigners aren’t like Japanese, there’s no commonality, the Japanese are unique, etc,” he said.

“If you keep playing that button the Government can keep getting budgets for anti-terrorism moves which will eventually target disenfranchised foreigners – hey, foreigners can’t vote.”

In a country that has long prided itself on homogeneity, it’s becoming cool for youth to embrace the growing number of foreigners in their midst.

Oizumi, Japan: Miharu Tanaka hands out fliers in Tokyo advertising Brazilian eateries in Oizumi, a city two hours away by train. The young woman makes the commute to encourage people to visit the country’s most diverse city, with its 16 percent non-Japanese population.

Her efforts are part of a generational shift toward becoming more receptive to a multicultural Japan. But in a country that has long prided itself on homogeneity and is seeing a rise in Japanese-centric nationalism, it will take some persuading for most people to embrace the growing reality of a more diverse population.

Japan has long been wary of – even hostile to – foreigners in its midst. Some say the media perpetuate a stereotyped image of foreigners as criminals.

Japan’s bias against foreigners shows in its immigration laws. It is virtually impossible for immigrants to find work here and become citizens. Most foreigners are reduced to low-level “3K” jobs – kitanai, kiken, and kitsui, or “dirty, dangerous and hard” – that most Japanese were no longer willing to take. The country wants to maintain its “racial homogeneity,” critics say. Officials recently began considering ways to tie long-term residency permits and work visas to Japanese language ability.

Certainly, the self-image of a homogeneous society remains strong. But some say that perception is incorrect. The official count of registered foreign residents is 2 percent of the nation’s total population of 128 million; but that represents an increase of 47 percent in the past 10 years and excludes many non-Japanese residents. While Japan has witnessed more international marriages – 21,000 children are born to these couples every year – its census figures do not show ethnicity.

Moreover, the number of registered foreigners does not include naturalized citizens, indigenous people, or those who overstay their visas, argues Debito Arudou, a US-born social activist who became a naturalized Japanese citizen in 2000.

Brazilian Japanese are thought to number around 300,000. The descendants of Japanese who immigrated to Brazil in the early-1900s, they returned to the land of their ancestors in recent decades. But since immigration reforms in 1990 granted only the descendants of Japanese the right to live and work in Japan, Japanese Brazilians mostly serve in 3K jobs in Oizumi and similar drab, industrial towns.

These areas have become non-Japanese enclaves – as well as microcosms of the racial tensions that have arisen with diversity. In Oizumi, where most non-Japanese residents are Brazilian, more Brazilian flags hang from buildings than Japanese ones. Brazilian restaurants, grocery stores, and video-rental shops dwarf Japanese sushi bars and noodle shops.

Japanese Brazilians in Oizumi complain about being called gaijin, or “outsiders,” and treated as such. When they run into Japanese colleagues, some Brazilians complain, the Japanese pretend not to recognize them. A majority of foreigners who live in neighborhoods alongside Japanese would like to interact with them, a 2007 opinion poll found. But only 10 percent of Japanese in these areas felt the same.

But a growing number of Japanese – mostly youths, such as Tanaka – are trying to persuade compatriots to embrace ethnic minorities. Unlike in previous generations, young adults tend to be more welcoming of diversity. Some analysts argue that, in a country with a dwindling birthrate – 1.32 as of 2006, down from 1.66 two decades ago – and a rapidly aging population, Japan should roll out the red carpet for foreigners.

In Oizumi, young Japanese are teaming up with Brazilians, cracking barriers among communities. Tanaka formed a group named Kimobig (“daring”) to energize exchanges such as language classes between Japanese and Brazilians.

Not everyone is pleased with the group’s efforts. Tanaka receives prank calls and harassing e-mails from Japanese and Brazilians. Still, she says, more locals have gotten acquainted with Brazilian residents. Urbanites have been entranced by Brazilian music, dance, and food. “So great is what one person can do,” she says. “One person can help change his or her parents’ views and their friends.’ ”

Jan. 15 (Bloomberg) — Japan may consider requiring long- term resident (chouki taizai) foreigners to have local language ability, Foreign Minister Masahiko Komura said today, without saying to what degree the language would have to be learned.

Komura said the Ministry of Foreign Affairs and Ministry of Justice plan to start discussing the possible requirement. Komura didn’t say when the meeting would take place or provide further details on which residents might be affected.

Japan’s mulling of a language requirement may hint at preparations to accept — rather than reject — more migrants, said Hidenori Sakanaka, director of the Japan Immigration Policy Institute in Tokyo and formerly head of the Justice Ministry’s Tokyo immigration office. Officials realize that Japan’s aging society and pending labor shortage obliges them to boost immigration.

“I think this is a preparation for that,” Sakanaka said. “It’s a global trend to require language ability for immigrants to integrate them into society.”

Japan’s labor force will shrink to 55.8 million in 2030 from 66.6 million in 2006 if more women and the elderly aren’t allowed to work, according to a labor ministry report.

“This shows that the government and business circles want to increase foreign workers,” said Ippei Torii, secretary general of Solidarity Network with Migrants Japan, an advocacy group for foreign laborers in Tokyo. A language rule, however, may prevent some workers from coming and may force non-Japanese speakers to leave, he said.

‘Quality of Life’

Komura said officials may not necessarily deny foreigners long-term residency just because they have no Japanese language ability. Establishing language as one criterion for residency would improve foreigners’ quality of life in Japan and encourage foreign students to learn Japanese abroad, he said.

“There are positive and negative aspects” of a language requirement, Komura said during a press conference in Tokyo today. “Because there may be more positive aspects we’re going to consider it.”

Wenzhou Song, 44, a consultant who founded the Tokyo software company Softbrain Co., said a language rule shouldn’t exclude talented people from immigrating.

“It’s a very difficult line to draw,” he said. “It makes sense to require long-term residents to speak the local language but you can’t make the requirement too harsh or you will discourage people who want to come to Japan.”

Song spoke little Japanese when he came to Japan from China as a student in 1985, he said.

On Nov. 20 Japan began fingerprinting and photographing foreigners entering the country to prevent terrorism.

COMMENT: As I told a reporter from ABC Radio Australia in an interview today (should be online fairly soon at http://www.radioaustralia.net.au/), I agree that Japanese language proficiency (meaning reading, writing, and speaking) is crucial for life in Japan. Functional illiteracy in any society is deprivational–it limits your world and voids your ability to control your fate here. And incentives should be there for those who are willing to make the investment and learn the lingua franca.

However, the GOJ as usual is making the incentives a matter of sticks, not carrots. Learn or we boot you out. No suggestion of how the GOJ is going to make it easier for NJ to learn–free language classes, for example, paid for by national and/or local governments, are de rigeur in other societies (such as the USA).

Other problems:

1) It is unclear what “long-term resident” (chouki taizai suru gaikokujin in Japanese) actually means. That could mean anyone from a one-year visa, to several one-year visas, all the way up to Permanent Resident. Are we saying that people who apply for PR will also have to take a language test? What “level of improvement” counts as valid at each stage? How high will that bar be raised the longer you stay?

2) It seems like yet another hurdle put up to keep the tide of immigration in check. With all the other languages out there with more use in other countries (English, for example, or even Spanish or French), are people going to be willing to put in all this investment in language just for the dubious honor of paying taxes, being treated like second-class residents with few labor rights and even fewer human rights, being assigned only 3K jobs with little chance of advancement (and no guarantee of education for their children), and being told in the end anyway they don’t belong here phenotypically–when they could just bog off to another set of countries where one language works for all of them instead? Nihongo is limited to this archipelago. Other multicultural languages beckon. Japan risks being passed by again.

3) How is this “language test” going to be administered? Is there a clear standard and grading regime, or is it just something administered by haughty Immigration officials–or worse yet, corporate bosses, to hold over their NJ employees like a Sword of Damocles? “You don’t speak like we do. You still have an accent. Either take a pay cut or we won’t approve your language improvement certificate and you’ll lose your visa”. And if there is a family of visas involved, what happens if some members of the family pass and others don’t?

I repeat, in principle, I think everyone should learn Japanese if they’re going to live here. But as I wrote before when this proposal was first floated years ago (Komura saying it now came as no surprise to me–it’s been in the pipeline; see links below), this requires more homework and concrete policy before floating anything as complicated as this as a mere policy trial balloon.

 政府は日本に長期滞在する外国人の入国や在留許可審査の際、日本語能力を要件として重視する具体策を外務、法務両省が検討することを決めた。就労目的などで増加傾向にある外国人が地域社会に溶け込みやすい環境整備につなげるとともに、来日する外国人にも日本語学習意欲を高めてもらうのが狙い。

 高村正彦外相が15日の閣議後会見で明らかにした。外相は「日本語能力は、外国人自身の生活の質を高めるためにも、日本社会のためにも大切」と強調したうえで「『日本へ行くために日本語を勉強しよう』という機運が高まれば大変よいことだ」と述べた。

 具体的には、入国時の上陸審査基準に日本語能力を新たに盛り込むかどうかや、在留期間の更新、資格変更時に日本語能力の向上について確認するなど、何らかの形で考慮することが検討対象となる見通し。外務省によると、カナダでは就労目的の永住者が査証申請時に提出する略歴で、語学力を含む6項目をポイント化し、総ポイント数に応じて許可。英国、ドイツ、フランスで語学能力を重視する移民政策を取っているという。

 ただ、政府内には、要件を厳しくすることで「査証(ビザ)の発給・更新などに影響が生じ、貴重な人材が入国できなくなる可能性もある」との課題を指摘する声もある。【上野央絵】

Jeff on Japanese police documenting neighborhood residents

Hi Blog. Jeff sends this post (blogging with adaptation and permission) on how tracking NJ in Japan doesn’t end at the border with fingerprinting and photographing, or at the local government office with registering, or on the street with Gaijin Cards (with criminal charges for NJ only for not carrying ID 24-7).

According to Jeff, it’s also happening at the home, with the cops making house calls, asking for data to store at the local police station. I’ll let the Comments section hold court on how widespread this is (is there a national campaign going on?). But this has never happened to me in all my twenty plus years here, both as a NJ and a Japanese living in Sapporo and Niigata. Has it happened to other readers?

If it happened to me, I would just take the form politely and later throw it away. I doubt I am under any legal obligation to provide data like this to the local police station (you aren’t, after all, obligated to answer the National Census (kokusei chousa) in part or at all). Japanese police documenting neighborhood residents

Hi Debito, this is the first time I have mailed or commented. I have been in the same apt in tokyo for about 6 years and in the past the police have come around once in a while to write down names and do their “rounds”, to keep the neighborhood safe, as they describe their activities. I was fine with that.

Last month and again last week, one officer came around with a green form (see below) and asked my wife and I to fill it out. The first time I threw it away. The form asks for name, birthdate, occupation, honseki, date began living at residence, address, contacts for an emergency including name, add, and tel number; as well as a description of any vehicles owned including bicycles. The top of the form, and I will paraphrase in English from Japanese, the form is intended for use to contact people in case of emergencies and the information will not be shown to anyone else.

The way the form is printed suggests that it was printed by the NPA for use all over the country, not just in Tokyo. I have no doubt that this is their primary intent, but I am reluctant for a number of reasons to supply this info and this much info not relevant to emergencies. We called the local police and they reiterated everything the officer said and what is written on the form. My first thought was that if they were going keep this form at my local koban, its not a bad idea, because it would make it easier for the police to do their job locally in case of a major emergency.

But after confirming that the information cards will be stored at the actual police station, I questioned whether there was any relevant argument for actually collecting this info. All of the info, except for the emergency contact person’s details is stored at the ku-yakusho (apart from vehicle info), along with all of the other info they have on me, being a foreign national. So, why don’t they just call the ku-yakusho and get the info from there, there is probably a law against that.

In addition, juki-net got shot down and I believe this is an attempt for the police to create there own juki-net by getting people to volunteer their information in the name of safety. It would not be all that difficult for the police to collect info locally and then put all of the info into a single database. This is starting to go long so I will leave it here.

Have you heard of this before? If you have, what are other people’s reactions? Any thoughts? Is this another step in the slowly degrading state of our civil rights here in Japan, after the reinstatement of fingerprinting what is next; national ID cards with pics and fingerprints for all residents regardless of nationality or maybe just a chip in our necks? I am not paranoid or anything, I just don’t like dealing with the police.

The backlash against immigrants in the rich world is a threat to prosperity everywhere

ITALIANS blame gypsies from Romania for a spate of crime. British politicians of all stripes promise to curb the rapid immigration of recent years. Voters in France, Switzerland and Denmark last year rewarded politicians who promised to keep out strangers. In America, too, huddled masses are less welcome as many presidential candidates promise to fence off Mexico. And around the rich world, immigration has been rising to the top of voters’ lists of concerns—which, for those who believe that migration greatly benefits both recipient and donor countries, is a worry in itself.

As our special report this week argues, immigration takes many forms. The influx of Poles to Britain, of Mexicans to America, of Zimbabweans to South Africa and of Bangladeshis to the Persian Gulf has different causes and consequences in each case. But most often migration is about young, motivated, dynamic people seeking to better themselves by hard work.

History has shown that immigration encourages prosperity. Tens of millions of Europeans who made it to the New World in the 19th and 20th centuries improved their lot, just as the near 40m foreign-born are doing in America today. Many migrants return home with new skills, savings, technology and bright ideas. Remittances to poor countries in 2006 were worth at least $260 billion—more, in many countries, than aid and foreign investment combined. Letting in migrants does vastly more good for the world’s poor than stuffing any number of notes into Oxfam tins.

The movement of people also helps the rich world. Prosperous countries with greying workforces rely ever more on young foreigners. Indeed, advanced economies compete vigorously for outsiders’ skills. Around a third of the Americans who won Nobel prizes in physics in the past seven years were born abroad. About 40% of science and engineering PhDs working in America are immigrants. Around a third of Silicon Valley companies were started by Indians and Chinese. The low-skilled are needed too, especially in farming, services and care for children and the elderly. It is no coincidence that countries that welcome immigrants—such as Sweden, Ireland, America and Britain—have better economic records than those that shun them.

Face the fears

Given all these gains, why the backlash? Partly because politicians prefer to pander to xenophobic fears than to explain immigration’s benefits. But not all fear of foreigners is irrational. Voters have genuine concerns. Large numbers of incomers may be unsettling; economic gloom makes natives fear for their jobs; sharp disparities of income across borders threaten rich countries with floods of foreigners; outsiders who look and sound notably different from their hosts may find it hard to integrate. To keep borders open, such fears have to be acknowledged and dealt with, not swept under the carpet.

Immigration can, for instance, hurt the least skilled by depressing their wages. But these workers are at greater risk from new technology and foreign goods. The answer is not to impoverish the whole economy by keeping out immigrants but to equip this group with the skills it anyway needs.

Americans object to the presence of around 12m illegal migrant workers in a country with high rates of legal migration. But given the American economy’s reliance on them, it is not just futile but also foolish to build taller fences to keep them out. Better for Congress to resume its efforts to bring such workers out of the shadows, by opening more routes for legal, perhaps temporary, migration, and an amnesty for long-standing, law-abiding workers already in the country. Politicians in rich countries should also be honest about, and quicker to raise spending to deal with, the strains that immigrants place on public services.

It is not all about money, however. As the London Tube bombers and Paris’s burning banlieues have shown, the social integration of new arrivals is also crucial. The advent of Islamist terrorism has sharpened old fears that incoming foreigners may fail to adopt the basic values of the host country. Tackling this threat will never be simple. But nor would blocking migration do much to stop the dedicated terrorist. Better to seek ways to isolate the extremist fringe, by making a greater effort to inculcate common values of citizenship where these are lacking, and through a flexible labour market to provide the disaffected with rewarding jobs.

Above all, perspective is needed. The vast population movements of the past four decades have not brought the social strife the scaremongers predicted. On the contrary, they have offered a better life for millions of migrants and enriched the receiving countries both culturally and materially. But to preserve these great benefits in the future, politicians need the courage not only to speak up against the populist tide in favour of the gains immigration can bring, but also to deal honestly with the problems it can sometimes cause.

One more reason to support the DPJ (or the New Komeito, depending on your politics–hopefully enticing it out of its Faustian deal with the devil just to share power with the LDP).

Lawmakers in the Democratic Party of Japan are stepping up efforts to resubmit a bill that would grant permanent foreign residents the right to vote in local elections, according to sources.

With New Komeito also strongly demanding local suffrage for permanent foreign residents, DPJ lawmakers hope in the upcoming Diet session “to split the ruling camp by submitting the bill to the House of Councillors and call on New Komeito to endorse it,” according to one of the sources.

But some conservative lawmakers in the party are determined to block the resubmission.

“Looking at this constitutionally and from the state of the nation, there’s no way we can approve this,” one party conservative said.

The DPJ previously submitted the bill to the House of Representatives on two occasions–in 1998 and 2002–but it was scrapped after failing to pass both times.

New Komeito also submitted to the lower house in 2005 a bill for granting permanent foreign residents voting rights in local elections, and discussions have spilled over into the current Diet session.

The passing of any bill of this nature has been stopped in its tracks mostly due to deep-rooted resistance mainly in the Liberal Democratic Party.

Yoshihiro Kawakami, a DPJ upper house member, plans to call on supporters in the party and establish a league of Diet members aimed at resubmitting the DPJ’s bill.

In the new bill, a “principle of reciprocity” will be introduced, in which local voting rights would only be granted to permanent residents who hold the nationality of a country that allows foreigners to vote in elections.

“New Komeito’s proposed bill has for sometime contained the principle of reciprocity, and so New Komeito won’t be able to oppose the DPJ’s bill,” Kawakami said.

Kawakami and his supporters hope to gain approval from the party leadership and submit the bill for prior consideration by the upper house. (Jan. 7, 2008)

 民主党は、同法案を1998年と2000年の2度にわたって衆院に提出したが、いずれも成立せず、廃案となった。一方、公明党は05年に衆院に「永住外国人地方選挙権付与法案」を提出、今国会でも継続審議になっている。自民党を中心に慎重論が根強いことが背景にある。

 民主党の川上義博参院議員は、党内の有志議員に呼びかけ、民主党案の再提出を目指す議員連盟を近く結成する方針だ。今回の法案には、相手国で外国人に対する選挙権を認めている場合にのみ、その国の国籍を持つ人に選挙権を付与する「相互主義」を新たに採用することを検討している。「公明党案にも、当分の間は相互主義をとることが盛り込まれており、公明党も民主党案に反対できなくなる」との判断がある。

 民主党の小沢代表は、「一定の要件のもとに地方参政権を与えるべきだ」と主張してきた経緯がある。川上氏らは、党執行部の賛同を得て、参院先議で法案を提出したい考えだ。

 これに対し、党内の保守派議員は「選挙権は、日本国籍を有する者に対してのみ保障されている。政局的な狙いから、『国のかたち』をゆがめるべきではない」と反発している。

To Defense Minister Shigeru Ishiba:

I urge you to reconsider your comment that UFOs “can’t be categorized as coming from a foreign country” (Yomiuri December 21, page 2). Please take a moment to think about the dangerous precedents this policy would set.

If UFOs could enter Japanese airspace without resistance, they could easily spirit away Japanese citizens. Japan has enough abduction issues already! But even worse, what if the extraterrestrial visitors liked our beautiful country so much that they decided to stay – and without the limitations that apply to humans from other countries?

First of all, with no visa restrictions, they could take jobs away from Japanese citizens. In the fields of astrophysics and aeronautics, an interstellar pilot would have a grossly unfair advantage over a Japanese graduate who shuffled through university with a perpetual hangover. Do you want more of our young people to become NEETs?

And if men from Mars, or women from Venus, were to marry Japanese citizens, what would prevent their names from being recorded in the juminhyo? Tama-chan was cute as a one-time joke, but do you really want to see Qrlzak Wzaxo from Jupiter listed on equal terms with Hanako Sato from Morioka? And their children, with one parent from a planet with higher gravity, would always beat their Japanese classmates in athletic competitions! How unsporting!

Our course of action should be clear: Treat extraterrestrials the same as any other aliens. When they arrive at the UFO terminal at Narita, take prints of their claws, tentacles, antennae or whatever they use for fingers. Make them carry Space Alien Registration Cards that the police could inspect at any time. Interplanetarization is all very well, but we Japanese must take measures to prevent these aliens from going where no gaijin has gone before.

Hi Blog. Here is a situation covered only infrequently by the media and by the likes of Debito.org (mainly because there is so little public information out there, and it’s a topic I’m not at liberty to research myself)–how sex trafficking, particularly that involving non-Japanese, is a flourishing business. And how Japan is one of the world’s major trading posts for it.

I’ve dealt with issues of slavery before (to this day, it exists in just about every country on the planet), but Japan’s has always had a wink-wink attitude towards the water trades–even by Prime Ministers regarding Japan’s historical connections–and especially when it comes to its particularly nasty variant involving foreigners. NJ “entertainers” (there was even an official visa category for it) are in a much weaker position linguistically (language barrier), economically (in more desperate straits) and legally (NJ have visas, meaning bosses can use denial of visa status as a further means for forcing compliance). This means it took gaiatsu (i.e. an unfavorable report from the US State Department) before the GOJ actually did anything meaningful about it.

Japan Installs Caution Signal for Sex Traffic

Japan has revised its criminal law to stipulate human trafficking as a crime and punish those involved. Activists, however, remain alarmed by foreign-staffed sex parlors that have made the country a haven for traffickers.

TOKYO (WOMENSENEWS)–There are about 10,000 parlors in Japan that offer sex to patrons.

Many advertise that they have foreign women by using such names as Filipina Pub, Russian Bar or Thai Delight. The patrons pay $60 to $100 for drinks and then an additional $150 to $300 to take women out of the bar to have sex with them.

Most of these women come to Japan on falsified passports or with entertainer or short-term visas, says Hidenori Sakanaka, who until a year ago was the director of the Tokyo Immigration Bureau. They are told that they have to pay off fake debts and their passports often are taken away upon arrival in Japan. The women are beaten and controlled by threats to family members in their home countries.

“Most women are moved from place to place and are too scared to complain,” Sakanaka says.

Sakanaka, who now directs the Japan Aid Association for North Korean Returnees, is credited with pushing through revisions to the law to combat trafficking while in his former post. Passed by the National Diet last month, it has helped abate international concerns about a country that has long been criticized for a too-tolerant an approach to trafficking.

On Saturday, the National Police Agency said police had uncovered 29 cases of human trafficking of foreign women from January to the end of June, up by five from the same period last year.

Despite these and other promising moves by Japan–brought about in part by the activism of Japanese women’s groups–international and local advocates continue to worry about the country’s problem with human trafficking, the world’s third-largest underworld business after trade in drugs and arms, netting $9.5 billion annually.

In a recent report the Japan Network against Trafficking in Persons said that the government’s heightened anti-trafficking efforts had so far not “made a dent.”

Fact-Finding Mission Last Week

Last week, Sigma Huda, the special rapporteur on trafficking for the U.N. Commission on Human Rights, came here on an unofficial fact-finding mission with activists, lawyers, lawmakers, academics and others concerned about human trafficking. The visit followed widespread reports–including by Amnesty International Japan–of South Asian women from developing nations being trafficked in this highly developed country.

“It’s the dark side of globalization,” says Huda, who is based in Bangladesh.

Reports indicate that about 130,000 women come to Japan on entertainer visas every year, but only about 10 percent of them actually perform in legitimate shows at hotels and other venues. Many obtain entertainment visas through agents who recruit them to Japan with promises of jobs that don’t exist.

Sakanaka traces the problem to immigration officials who bend to politicians and businessmen who hire foreign women for illicit purposes. “Some men even said I was out of my mind to try to do something about human trafficking,” he says. “They claimed it was part of Japanese culture to have sex with foreign women. They were addicted to the parlors. I received phone calls from politicians and anonymous threats on my life.”

Japan Kept Off Worst-Trafficker List

Earlier this month, the U.S. State department removed Japan from a special watch list of countries that were to be included on an updated listed as the worst condoners of human trafficking after the Japanese government compiled an action program to combat human traffickers. The State Department had put Japan on that list a year ago.

Under the new Japanese legislation, those who “purchase” people in order to control their activities will face punishment of up to five years in prison. The maximum punishment could be increased to seven years imprisonment if the victim is a minor.

The new legislation will also grant victims, on a case-by-case basis, special residency status even if they have overstayed their original visa, so that they can be rehabilitated.

Before these revisions, police dealt with trafficking by arresting the victims as illegal aliens, jailing them and deporting them as soon as they had enough money to fly home. Traffickers received a fine or a short jail sentence.

One of the most notorious traffickers, Koichi Hagiwara, known as Sony for his habit of videotaping his victims while he humiliated and tortured them, was sentenced in March 2003 and served less than two years in prison for violating labor laws.

Japanese Women Enraged

Japanese women have also pressured the government to do something about human trafficking.

“Many women were enraged by an article in the Asahi Shimbun, a major daily newspaper in Japan, about the practice,” says Sakanaka, the former director of the Immigration Bureau, referring to an investigative article published Oct. 18, 2003. “Until this article came out, Japanese women knew little about the situation. Women’s groups mobilized, and called up magazines and newspapers to protest the treatment of the women victims.”

The government, Sakanaka says, has neglected to investigate many of the abuse cases. These women, he says, live horrific, lonely lives, forced into having unprotected sex and perform other risky acts with dozens of customers a day. “These new laws are valuable. But they also need to strike at the center of organized crime.”

Sakanaka is concerned that most foreign women will be too scared to go to the police because they think they will be killed if they try to escape.

Chieko Tatsumi, an official in the International Organized Crime Division of Japan’s Foreign Ministry, disagrees. She believes the victims would seek protection from the police.

“There has already been an increase in the number of women asking for protection,” Tatsumi says. “In 2002, there were only two Thais who sought help, but in 2004 there were 25.”

She says that the government set a budget of $100,000 in April for helping women who come to a public shelter.

“The government will pay for rehabilitation for the victims of sexual enslavement and tickets for them to return to their home countries,” Tatsumi says. Not enough, says Sono[ko] Kawakami, campaign manager for Victims of Violence of Japan Amnesty International. The government’s measures fail to sufficiently protect victims and the amount of money budgeted to stop trafficking is insufficient, she says.

Her organization wants separate facilities for trafficking victims, rather than housing them with victims of domestic violence. Many victims are so traumatized that they won’t talk to anyone, so they require specialists to handle them, Kawakami says. Since many do not speak Japanese she also wants language translation support for the victims and specialists in human trafficking to assist them.

Although she believes the government can do more, she says the revisions to the criminal law affecting trafficking are a good start.
Keiko Otsu, director of Asian Women’s Shelter in Tokyo, is also pleased with the new laws, but says there are currently only two shelters available for these women.

“The women don’t have any income, assistance or support,” she says. “Some may be pregnant and many have mental and other health problems, including AIDs and other sexually transmitted diseases and need expensive medial care.”

Tangent: Europe becoming passport-free. Contrast with Japan.

Hi Blog. Here’s evidence that other countries are putting up less immigration controls, not more (unlike Japan with its new fingerprinting policy, justified on overtly xenophobic grounds). Yes, the article mentions that border controls are toughening outside the Schengen Zone, but it’s still an amazing feat to be able to drive from Estonia to Portugal without a single passport check. Or, despite the multitude of languages, cultures, and differences in standard of living, fingerprinting at any border.

America should also take note (and I do believe it will within the next few years, given the rising voices talking about the damage being done the US by ludicrously tough border controls). So should Japan, which is taking advantage of things to go even farther.

Sure, I hear the counterarguments–Japan’s “shimaguni” island society and all that. But do you think that being surrounded by an ocean makes you insular and impregnable? It arguably easier to sneak into Japan than into landlocked countries! Which shows how even more useless these border controls are–when anyone who really wants to get in here surreptitiously just has to pay a boatman and then hop a rubber dinghy. More and more, Japan’s fingerprint policy just seems a useless taxpayer boondoggle. As does the American.

LONDON — As midnight approached in the centre of Europe yesterday, hundreds of border guards left their posts for good and began tearing down the last remains of the old Iron Curtain.

At the border of Germany and Poland, the guards spent the day removing kilometres of tall steel fence, leaving unmarked and unguarded fields between the two once hostile nations. On the road between Vienna and Bratislava, Austrian and Slovakian leaders met to saw through border-crossing barriers. In Estonia, the government put its border-inspection stations up for auction.

This morning, for the first time in history, you can drive from the Russian border in Estonia to the Atlantic beaches of Portugal, across 24 countries, without encountering a single border crossing or having to show your passport at any point.

For the people who live inside the core countries of the European Union and especially in the old Eastern Bloc, today marks a historic moment, the long-awaited expansion of the EU’s Schengen zone, a huge space, named for the Luxembourg town where it was first devised, in which national borders have been eliminated and 400 million people are treated as citizens of a single country.

The addition of nine new countries to this borderless zone today, eight of them formerly Communist members of the old Warsaw Pact, means that the distinction between the “old” and the “new” Europe is beginning to vanish and freedom of movement is expected to create an economic boom as eastern workers continue to move westward and carry their earnings back home.

“A freedom is being restored which this country has been wanting for a hundred years,” Hungarian President Laszlo Solyom said last night as he opened his country’s borders to Austria, Slovakia and Slovenia. Residents of the Czech Republic and Slovakia, who have been isolated since Czechoslovakia split apart in 1993, were delighted to discover last night that they no longer have a border between them.

So there was a mood of celebration yesterday inside Poland, Hungary, Estonia, Latvia, Lithuania, the Czech Republic, Slovakia, Slovenia and Malta. But in the countries that now find themselves outside the borders of this free-living enclave, the mood was considerably different.

In Ukraine and Belarus, citizens made panicked last-minute shopping forays into Slovakia and Poland yesterday, loading their cars with meat, clothing, liquor, cigarettes, Christmas presents and automobile parts. The wait at the Poland-Belarus border, until last night a relatively lax crossing, was several hours long, with lines of cars and trucks backed up for dozens of kilometres.

As they crossed back eastward, it was easy to understand the alarm: Along a suddenly fortress-like border, hundreds of new border guards, equipped with high-technology surveillance equipment, were busy setting up a security cordon that has been two years in the planning and will make it far more difficult to enter Europe.

A 679-kilometre steel fence has been erected along the border of Belarus. Armed, fast-moving squads, known as Rapid Border Intervention Teams, monitor surveillance data. In eastern Slovakia, a large detention centre has been constructed along the Ukrainian border; it already houses dozens of people from as far away as Ghana who have recently tried to slip into Europe through this mountainous, sparsely populated frontier. It has room for hundreds more.

“It’s going to be a new Iron Curtain for all intents and purposes,” Samuel Horkay, a Ukrainian citizen who has discovered that it will be much harder to visit his mother in neighbouring Hungary, told the Bloomberg news agency yesterday. “That’s a strong way to put it, but Europe loves to guard its borders.”

That is the central paradox that lies behind today’s celebrations: Even as Europe is turning its national borders into historical footnotes — European Union countries currently have fewer independent powers, in most areas, than Canadian provinces do — the 27-nation federation is making entry from outside the EU far more difficult.

While the continent’s booming economies in places like Spain, Ireland and Britain (the latter two are not part of the Schengen zone) are hungrily trying to grab as many immigrants as they can in both skilled and unskilled fields, in order to fill hundreds of thousands of job vacancies, other countries such as France and Italy are facing unemployment and political crises over immigration. On the whole, there is a growing Western European consensus against non-European immigration.

While the borders are being toughened, many European citizens fear that the expansion of the Schengen zone will lead to increases in human trafficking, undocumented immigration and smuggling. One poll showed that 75 per cent of Austrian citizens are opposed to the expansion.

And the official responsible for Europe’s new high-security external borders, Ilkka Laitinen of the EU’s Warsaw-based Frontex border agency, agreed that freedom of movement is going to make it harder to control who lives in Europe, regardless of the level of border security. “It is a deliberate choice of the European Union to focus more on the free movement of persons than on security aspects,” he said.

We all notice it eventually: how nice individual Japanese people are, yet how cold — even discriminatory — officialdom is toward non-Japanese (NJ). This dichotomy is often passed off as something “cultural” (a category people tend to assign anything they can’t understand), but recent events have demonstrated there is in fact a grand design. This design is visible in government policies and public rhetoric, hard-wiring the public into fearing and blaming foreigners.

Start with the “us” and “them” binary language of official government pronouncements: how “our country” (“wagakuni”) must develop policy for the sake of our “citizens” (“kokumin”) toward foreign “visitors” (rarely “residents”); how foreigners bring discrimination upon themselves, what with their “different languages, religions, and lifestyle customs” an’ all; and how everyone has inalienable human rights in Japan — except the aliens.

The atmosphere wasn’t always so hostile. During the bubble economy of the late ’80s and its aftermath, the official mantra was “kokusaika” (internationalization), where NJ were given leeway as misunderstood outsiders.

But in 2000, kicked off by Tokyo Gov. Shintaro Ishihara’s “sangokujin” speech — in which he called on the Self-Defense Forces to round up foreigners during natural disasters in case they riot — the general attitude shifted perceptibly from benign neglect to downright antipathy….

Mainichi Poll: 63% of Japanese favor immigration of unskilled foreign laborers

More than 60 percent of people in Japan support accepting entry-level workers from overseas, in spite of the government’s policy of generally refusing such workers, a survey by the Mainichi has found.

In a nationwide telephone poll conducted by the Mainichi, 63 percent of respondents agreed with accepting foreign entry-level workers. Another 31 percent were against the idea, citing reasons such as that it would have a negative effect on Japanese employment or public peace.

A special employment plan approved by the Cabinet in June 1988 agreed to actively accept specialist and skilled foreign workers, but to take a “cautious” approach with regard to entry-level workers, and as a result, foreign unskilled laborers are generally refused entry to Japan.

When questioned about the government’s policy, 58 percent of respondents in the survey agreed with accepting unskilled foreign workers in fields where there was a lack of workers. Five percent said entry-level foreign workers should be accepted unconditionally.

When the 31 percent of respondents who said that such workers should not be accepted were asked to give a reason for their stance, 51 percent replied that it would have a negative effect on the employment and working environments of Japanese nationals. Another 35 percent said that public security would worsen, while 10 percent said trouble would occur as a result of differences between customs. Three percent cited an increased burden in areas such as social security costs and education costs.

When asked who would cover social security and education costs, the answers “the businesses employing the workers” and “industries that need workers” each received 38 percent. The answers “foreign workers themselves,” and “the whole public” each marked only 11 percent.

Hidenori Sakanaka, head of the Japan Immigration Policy Institute, who formerly served as a director of the Tokyo Regional Immigration Bureau, said Japan’s entry into an age with a dwindling population was behind the rising acceptance of allowing entry-level workers into Japan.

“Another reason is probably that the relationship with foreigners in Japan has taken a turn for the better,” he said. Sakanaka added that the work done by entry-level workers, such as nursing and work in the agriculture, forestry and fisheries industry, required specialist knowledge and skills, as well as the ability to adapt to Japanese society, and was certainly not simple. He added that a system to accept foreigners under a policy of cultivating human resources was urgently needed.

 労働力不足の分野では、外国人の単純労働者を受け入れてもよいと考える人が63%いることが、毎日新聞の全国世論調査(電話)で明らかになった。政府は、単純労働者を認めない方針だが、労働力不足の分野で容認する人が半数を超えていた。しかし、日本人の雇用に悪影響があるなどの理由で、受け入れに反対する人も31%あり、方針の転換に慎重な人たちも少なくない。

 外国人労働者については、88年6月に閣議決定された「第6次雇用対策基本計画」で「専門的・技術的労働者は積極的に受け入れ、(単純作業の繰り返しである)単純労働者は慎重に対応する」とし、単純労働者は事実上受け入れない施策が続けられてきた。

 政府方針について聞いたところ、労働力不足の分野での受け入れ容認が58%あり、「条件を付けずに単純労働者を受け入れるべきだ」が5%だった。一方、「現行通り、受け入れるべきではない」は31%だった。

 「受け入れるべきでない」と回答した人に理由を聞くと、「日本人の雇用や労働環境に悪影響を与える」が51%と最も多く、次いで「治安が悪化する」35%、「風習の違いによるトラブルが起きる」10%、「社会保障費や教育費などの負担が増える」3%だった。

 社会保障や教育費の負担を主に誰が担うかは、「雇い入れる事業主」と「労働者が必要な産業界」がいずれも38%。「外国人労働者自身」「国民全体」は双方11%と低かった。

 ◇若者は容認傾向

 毎日新聞の世論調査では、約6割が外国人の単純労働者受け入れを「労働力不足の分野」という条件付きで容認したが、特に若者にその傾向が強かった。しかし、受け入れ拒否の理由に、労働環境悪化を挙げる人が多かったことは、労働力不足への懸念に加え、雇用不安が広がったことを示している。

 労働力不足の分野で容認した人を年代別でみると、70代以上は44%と半数以下だが、20代は73%に達していた。若者に抵抗感が薄まっているとみられる。

 04年5月の内閣府世論調査では、(1)「単純労働者は受け入れるべきでない」26%(2)「労働力が不足する分野では受け入れてもよい」39%(3)「条件を付けずに受け入れるべきだ」17%--だった。

 調査方法が違うため単純比較はできないが、今回調査では、(2)の条件付き受け入れが19ポイント増え、逆に(3)の条件なし受け入れが12ポイント減ったのが目立つ。

 また、受け入れ拒否の理由は、内閣府調査では、「治安が悪化する」が74%と突出し、「風習の違いによるトラブルが起きる」49%、「日本人の雇用や労働環境に悪影響を与える」41%だったが、今回は、治安悪化は少なく、雇用への懸念が半数あった。

 04年当時は不法滞在者が急増しており、内閣府調査では治安悪化への懸念が色濃く出た。今回は雇用不安が影響したとみられる。【外国人就労問題取材班】

Mediocre Economist Survey on Japan Business Dec 1 2007

Hi Blog. December 1st 2007’s Economist (London) magazine had a 14-page survey on business in Japan.

As is true of almost all Economist articles (and much more so than the US-published glossies such as Time and Newsweek, which is why I have been a subscriber for nearly twenty years), there were plenty of useful statistics and some valuable insights.

But the author, Tom Standage, seems to be a neophyte to Japan, trying too hard to use his metaphor of a hybrid car as a grand allusion for Japan’s economy (contrasting it with “Anglo-Saxon capitalism”–cutely rendered as “JapAnglo-Saxon capitalism”, as if there is such a clear contrast or even such a concrete economic model). He winds up making what could have been an interesting survey into a graduate-school term paper. It even feels as if he swallowed the lines fed him by the GOJ Gaijin Handlers, that Japan’s economics and business practices are that transparent and quantifiable.

Also, I have the feeling Mr Standage might have been reading a bit of Debito.org. I complained on the blog about how an Economist article last July talked about Japan’s demographics and labor market, without even one word considering foreign labor. One sentence, “if only to dismiss immigration as a possibility”, is what I said I wanted.

Oh, it’s culture. The end. “Culture” is a category people throw information into when it’s too taxing to understand. It’s the analytical category for lazy people. Especially when most things that are “cultural” are actually perfectly rational–you just have to understand the rationale behind people’s behavior. And that takes acculturalization, which I feel the author lacks a bit of.

If Mr Standage thinks Japan’s antipathy towards foreigners and immigration is merely a cultural issue, I would ask him to read and consider my upcoming Japan Times column (#42) coming out Tuesday, December 18, 2007, where I try to demonstrate that Japan’s rising xenophobia is in fact by grand design. And how it is serving the country poorly. I even use some statistics from his survey, thanks.

Tucked in a corner of the Aichi Prefecture city of Toyota, the Homi Danchi housing estate most famous for its racial problems, may offer a vision of the Japan of the future, according to Spa! (12/4).

The estate opened in 1975 and, like many public housing complexes at the time, was then a highly desirable residence for many families.

But an influx of Japanese-Brazilian immigrants from the start of the 1990s saw the housing estate split along racial lines as Japanese residents complained fiercely about loud Latino music, cars parked illegally and rubbish dumped everywhere.

Three decades after it opened, Homi Danchi was no longer so homey. The housing estate had turned into a slum divided between its Japanese inhabitants and the descendants of other Japanese who had earlier left the country for greener pastures overseas.

The brawl between Japanese and Japanese-Brazilians saw its roots in 1990 changes to the Immigration Law that allowed any descendants of Japanese who had previously left this country to come into the country without any other visa restrictions, ironically in the belief that such a move would smooth over perceived cultural gaps brought by other foreigners lacking the blood of Yamato flowing through their veins.

Homi’s racial battle began when rules about public housing were relaxed a decade ago to allow foreigners to live there without restrictions, opening the floodgates to a swarm of non-Japanese moving in to the housing estate a short trip from the Toyota Motor Co. factories where many of the immigrants work.

“They literally popped up everywhere in no time at all,” a Japanese resident of the housing estate for over 20 years tells Spa! “Before you knew it, you would never see Japanese in the housing estate anymore.”

Many of the gripes Japanese residents had about their Brazilian “brethren” seem trivial, such as the propensity for partying and loud Latin music, but others point to the old adage of being in Rome and doing as the Romans do, urging the immigrants to lead a quieter lifestyle along the lines of the inhabitants who had been there longer.

But the Brazilian-Japanese were not going to take things lying down. When confronted by a group of right-wing thugs driving a loudspeaker screaming out messages along the lines of “Foreigner Go Home,” the foreigners took on the harassers in a very non-Japanese way: they firebombed the soundtruck.

Homi’s battle lines had been drawn and threatened to flare, but the government intervened, brokering a peace deal between the Japanese and Japanese-Brazilians. Now, the housing estate is a peaceful place, but Spa! notes that doesn’t mean the two groups get along, with the Japanese sticking to themselves and the foreigners clustering among their own, with each group ignoring the other.

Foreigners blame the Japanese for the uneasy stand-off.

“All the Japanese ever do is complain about us,” a Japanese-Brazilian resident of the housing estate tells Spa! “They don’t accept us at all. We try to greet them and they just ignore us. They don’t want to have anything to do with us.”

And here’s where Homi can serve as a harbinger. Danchi housing estates across Japan are losing their inhabitants as the country’s population shrinks. Japan’s current population of 126 million is estimated to drop below 100 million by 2050 unless something is done. More than likely, foreigners are going to be needed to make up for the lost 20-odd million. More and more public housing estates are going to become like Homi, where over half the current 8,000 inhabitants are non-Japanese.

With Homi’s Japanese and Japanese-Brazilians agreeing to mutually ignore each other, the weekly notes it’s not possible to say the problems between the two groups have been solved. But, to its credit, the magazine argues that the issue needs to be cleared.

 みなさまこんにちは。有道 出人です。いつもお世話になっております。

 さて、ご存知かどうかは分かりませんが、今週は「人権週間」でございます。法務省と全国人権擁護委員連合会は税金を使って色々なイベントを開催します。ただ、有意義であるのか、効果的であるのか、ましてや根本的にどんなような「主義」に基づき差別撤廃・意識高揚を行うのか、をこのメールで私は批評したいと思います。(私のコメントは引用するテキストの後です。)

 近年の国際化時代を反映して,我が国に在留する外国人は年々急増しています。憲法は,権利の性質上,日本国民のみを対象としていると解されるものを除き,我が国に在留する外国人についても,等しく基本的人権の享有を保障していますが,現実には,我が国の歴史的経緯に由来する在日韓国・朝鮮人をめぐる問題のほか,言語,宗教,生活習慣等の違いから,外国人に対する就労差別やアパートやマンションへの入居拒否,飲食店等への入店拒否,公衆浴場での入浴拒否など様々な人権問題が発生しています。
 平成8年1月には,「あらゆる形態の人種差別の撤廃に関する条約」(人種差別撤廃条約)が我が国において発効し,人種差別や外国人差別等あらゆる差別の解消のための更なる取組が求められています。
 今後ますます国際化が進むことが予想される状況の中で,外国人のもつ文化を尊重し,その多様性を受け容れることが,国際社会の一員として望まれています。
 法務省の人権擁護機関としても,国民のすべてが,国内・国外を問わず,あらゆる人権問題についての理解と認識を深め,真に国際化時代にふさわしい人権意識をはぐくむよう啓発活動を展開していきます。

有道 出人よりコメント:
もちろん、人権週間を開催しないよりも、した方がいいと思います。ただ、上記のテキストの中では、色々な面から人権が委ねている人権擁護部の盲点が現れています。

1)なぜ上記の文で「人種差別・身元差別」などではなく『外国人差別』のみと言われていますか。『国籍』が要因ですか。それだけではなく、国際結婚の子供は「日本人離れ」の顔があるならば、「外人扱い」になるケースがかなりある。日本人・日本国籍が有する人であるので、これは「外国人差別」に該当しません。これは人種差別です。これも「真に国際化時代」の一部です。人種差別は日本人にも悪影響となります。私は以前いくらでも人権擁護部に注意してもきかないです。

2)なぜ「我が国」に外国人が「在留」しているのみとの言い方ですか。「我々対外国」なら、外国人は「住民」ではないみたい。短期的な「在留」よりも「在住」や納税や社会貢献についてもう少し言及できませんしょうか。それこそ「多様性を受け容れること」だと思います。

3)なぜ「言語,宗教,生活習慣等の違い」が排他的の行動の説明になるのでしょうか。必ずしも違いがあるわけではいし、習慣などの違いがあったという証拠がなくても「外国人」は外見・身元のみで門前払いするケースが多いです。かえって「違いがあるから」を主張するのはたいてい差別主義者の弁解となり、同様に政府もそうやって言及するのは若干皮肉です。「習慣が違っても他国の人はちゃんと学べる」ことも無視となります。

4)人権擁護部がよく「尊重しよう」と言うが、なぜ人種差別撤廃法整備も唱えませんか。96年から「遅滞なく法律も作る」と国連条約で公約したものの、ほぼ12年間が経過しても「外国人差別」を撤廃措置と機能は行政府には未だにありません。人権擁護部さえ自分が「差別撤廃の拘束力はない」と認め、よって、立法がないと綺麗言葉に留まることとなりました。

GOJ Jinken Shuukan: “Human Rights Week” and its flaws

If you’ve been watching TV or been out in a few public places, you might have seen two cute-ish big boy and girl mascot dolls named “Ken” (for “kenri”, one’s rights, or “jinken”, human rights), drawing attention to issues of discrimination in Japan. Otherwise you might not know that we are in the middle of Japan’s official week for human rights. “Jinken Shuukan” started on December 3 and ends on December 10, or “Jinken Day”. Sponsored by the notorious Ministry of Justice’s Bureau of Human Rights (Jinken Yougo Bu, or BOHR–“notorious” for doing nothing much otherwise).

The website with this year’s 59th proceedings (thanks Stephanie) lists up these issues of note (my translations):

“LET’S RESPECT THE HUMAN RIGHTS OF FOREIGNERS”

Reflecting the era of Japan’s Internationalization in recent years, every year the number of foreigners staying (zairyuu) in our country (sic–waga kuni) has been increasing. According to the Constitution, and by the nature of the rights of man, and leaving out the interpretation that the Constitution only applies to Japanese citizens, foreigners staying in our country also are guaranteed fundamental human rights. However, in practice, our country has had issues originating in history towards the Zainichi North and South Koreans [sic–Chinese/Taiwanese etc. not included]. There are also various incidents of human rights problems with foreigners facing discrimination in the workplace, as well as being refused apartments, entry into eating and drinking establishments, and public baths [thanks]. This is due to differences in language, religion, and lifestyle customs [sic–not also race].

Our country effected the United Nations Convention on the Elimination of All Forms of Racial Discrimination in January 1996, which demands that we take further action towards the elimination of racial discrimination and discrimination by nationality.

As Japan’s internationalization is anticipated to further proceed from now on, it is desirable that we respect the customs of foreigners, and as a member of the international society we accept diversity.

The Ministry of Justice Bureau of Human Rights as an organization will develop enlightenment activities that will cultivate an awareness of human rights suitable for Japan’s international era, where all citizens (kokumin) here or abroad will deepen their understanding and awarenesss of all human rights problems.

COMMENT: I’m not going to completely douse the fireworks here with acerbic comments (as it’s better that the GOJ is doing this than not, as long as they don’t claim to international bodies that this is enough–which they have a history of doing). But let’s do a quick roundup of the flaws in all the “human rights awareness” so ably called for by the BOHR:

a) Note how the BOHR still couches discrimination in terms of nationality, not as race or national origin. For what about the Japanese children with international roots, who face discrimination because they don’t “look Japanese”? This blind spot ignores one more facet of Japan’s true internationalization–where racial discrimination affects Japanese citizens too.

b) Note how the issue is still couched in terms of “us” and “them”–our citizens and those foreigners with their differences (which is not necessarily true–and this sort of thing is used more often as an excuse and a justification than an explanation). It’s not even clear that foreigners are even residents of Japan–only “staying” (zairyuu) as opposed to “residing” (zaijuu).

c) Still no call from the BOHR for an actual law outlawing racial discrimination–only for the “respect” for people (which, with 300 yen, might get you a cup of coffee; if the restaurant even lets you in).

d) And as I said above, the BOHR is famous for calling for action yet not effecting much (or any) action of its own–after all, as they will tell you at the very beginning of any interview you have with them over a human rights issue, they have no real power to stop a discriminator from discriminating, and (this they won’t tell you) have no legal obligation to call you back or tell you any results of any investigation (if any) they undertake (this is, they say, “for privacy concerns”). Glad to see that “discrimination against foreigners” is now up to eighth in the ranking. Now if we could get it rendered as “racial discrimination”, it would more reflect reality. And treaty obligation.

If you or anyone you know is planning to go to Japan, be advised that beginning Nov. 20, all non-Japanese people will be fingerprinted and photographed upon entering Japan.

Unlike other fingerprinting laws, such as the U.S.’s, Japan requires permanent residents (the equivalent of Green Card holders in the U.S.) to be fingerprinted and photographed every time they re-enter the country. Those fingerprints and photographs are kept on file for 70 years and can be made available to the police and other government agencies.

While one could argue that permanent residents should just apply for Japanese citizenship, obtaining citizenship is a long and arduous process, which requires residents to give up their current citizenship. Unless you are willing to make those sacrifices, you are a foreigner, and you must give up your biometric information every time you cross the Japanese border.

History of the fingerprinting law

This Japanese fingerprinting law is an updated version of a fingerprinting program implemented in 1952, after the American occupation of Japan following the Second World War. The original fingerprinting law met with firm opposition from foreign residents in Japan, especially the Zainichi. The Zainichi are ethnic Korean and Chinese people born and raised in Japan. Despite living most or all of their lives in Japan, and despite 90 per cent of Zainichi adopting Japanese names, the Zainichi must go through the same application process as other foreign residents to obtain citizenship.

The 1952 law was opposed on the grounds that it was an official expression of mistrust for all things foreign. It was an unnecessary humiliation and alienation of residents who had lived their whole lives alongside their Japanese peers — Zainichi children were often not aware that they were of a different ethnic background than their schoolmates until they were contacted at their school to have their fingerprints taken. Further, it associated all non-Japanese people with crime. By law, a Japanese person may only be fingerprinted if officially charged with a crime.

Eventually, people started refusing to submit to fingerprinting; first the Zainichi, then other foreign residents. Since this refusal meant jail for some, the number of legal battles skyrocketed — enough so that overseas media like Time Magazine and the New York Times picked up the story. In 1989, under heavy pressure, the government of Japan granted general amnesty, and by 1998 the law was completely abolished.

After the dust had settled, Immigration Bureau officials said that “the fingerprinting system appears to be ineffective in stopping or reducing the growing number of illegal immigrants and visa overstays in Japan.” The Ministry of Justice noted that “the practice could be construed as a violation of human rights.” Then why is this law being reinstated?

Fears of terrorism and foreign crime

Japan’s Ministry of Justice explains the motivation for reinstating the fingerprinting law: “By collecting personally identifying data, such as fingerprints and facial photos of visitors to Japan, we will be able to identify persons considered to pose security risks, such as terrorists, and persons travelling with passports that are not their own. This will help us prevent terrorist attacks.”

If Japan wishes to fight terrorism, then history tells us that it is the Japanese population that should be policed. The Sarin gas attack that took place on the Tokyo subway in 1995 was perpetrated by members of the Japanese religious group Aum Shinrikyo. In the 1970s, two Japan Airlines flights were hijacked by a terrorist group called the Japanese Red Army. There have been no terrorist attacks in Japan by non-Japanese in recent history.

The public support for the fingerprinting law could also be attributed to a fear of foreign crime among the Japanese. Since 2000, the National Police Agency (NPA) has been releasing updates on foreign crime every six months with detailed press releases. The media has been quick to report on these releases, and further support this with unbalanced reporting of foreign crime compared to Japanese crime. One study found that crimes by foreigners were 4.87 times more likely to be covered than crimes by Japanese. Even more frustrating is the way the NPA twists the statistics.

The semi-annual press releases note increases in foreign crime without a comparison to the state of Japanese crime. The increases in foreign crime do not take into account the increase in the foreign population; while the Japanese population has remained relatively static, the foreign population has been growing steadily over the past decade. Foreign crime is inflated by including visa overstays (a crime that a Japanese person cannot commit) with harder crimes. When proper statistical practices are used, foreign crime is rising in proportion to the rate of population increase, while Japanese crime has doubled within the past 10 years.

It is interesting to note that in 1999, before the first press release detailing foreign crime statistics, the NPA established the “Policy-making Committee Against Internationalization.” Would such a committee receive taxpayer money if foreign crime was on the decline?

If fears of terrorism and foreign crime are unfounded, then what is the main issue that surrounds the fingerprinting debate? It’s the same issue that has been the subject of many recent legal battles: racism and xenophobia.

Racism and xenophobia

By most accounts, since the Second World War, Japan has a good international record as a modern industrialized nation. Japan has the third largest economy in the world, manufacturing and designing goods for a worldwide market. Despite claims of homogeneity, Japan is home to over 2.5 million residents of non-Japanese ethnic backgrounds. Japan is a member of the United Nations Human Rights Council. Yet walking through Tokyo, you can find buildings with “Japanese only” signs posted on the front door. “Japanese only” signs have been found at bathhouses, bars, stores, hotels, restaurants, karaoke parlors, and pachinko parlors. How is this legal?

The unfortunate answer is that Japan has no law against racial discrimination. It is unconstitutional — article 14 of the Japanese Constitution states that there shall be no discrimination on the basis of race. Further, Japan signed and ratified the UN Convention on the Elimination of Racial Discrimination in 1996. So, in theory, racial discrimination should not be tolerated; in practice, the lack of a law forbidding racial discrimination allows discriminatory behaviour, such as the “Japanese only” signs, to continue.

And these signs are unarguably discriminating on the basis of race. Social activist Arudou Debito became a naturalized citizen in 2000, after being denied entrance to a public hot springs in Hokkaido. Upon returning to the establishment a Japanese citizen, he was still refused entry to avoid confusion from the other customers. He sued the owner of the hot springs for racial discrimination and was met with moderate success. While he won some judgments, he lost an important decision when his appeal to the Supreme Court was dismissed for “not involving any constitutional issues.” The story of the incident at the hot springs and the ensuing legal battle is chronicled in his book Japanese Only.

Debito is not the only person to take these matters to the courtroom. In 1997, Brazilian Ana Bortz was asked by a jewelry store’s owner to leave his store, which had a strict no-foreigners policy. The store owner accused Bortz of planning a robbery. Bortz sued the store owner for violating her human rights, using the security camera footage as evidence. The judge ruled in Bortz’s favour, sentencing the store owner to pay 1,500,000 yen (approximately C$12,300) in damages and legal fees. The judge cited two articles of the UN Convention on the Elimination of Racial Discrimination, setting a good legal precedent for future discrimination cases.

Or did it? In 2004, Steven McGowan, a 41-year-old black man residing in Kyoto, was refused entry to an eyeglasses store in Osaka. Steve claims that the store owner said, “Go away. I hate black people.” Steve lost his case in a lower court because the judge did not believe that Steve’s Japanese language ability was good enough to accurately determine what the store owner said. Even after further investigation by McGowan’s Japanese spouse, the judge was not convinced that Steve was discriminated against because of his race, rather than his foreign status (the Japanese words for black person and foreigner are very similar). McGowan appealed to a higher court and was awarded 350,000 yen in damages; yet even at the high court, the judge remarked that the store owner’s remarks were “not enough to be considered racially discriminatory.” These decisions set the dangerous precedent that testimony by non-Japanese cannot be trusted if they are not completely fluent in Japanese. It also demonstrates the power one judge can have in Japan’s juryless court system.

A plea to Japan

In discussing these issues, it may seem that I have some disdain for Japanese culture. This can’t be farther from the truth — it is my fascination with and interest in Japanese culture that compels me to bring these issues to the forefront. It is only through open dialogue that conditions will improve for both Japanese and non-Japanese residents.

If Japan does not change its immigration policies, and birth rates continue at the current rate, Japan’s population will plummet from today’s 127 million to 100 million in 2050. It will become very difficult to maintain economic strength with such a reduced work force. Immigration is the easiest and most sustainable answer to Japan’s population crisis.

With increased immigration, there will have to be widespread changes in media and education. Though this seems prohibitively difficult at the moment, Japan’s rapid industrialization is proof that it is possible. By working together with its new generation of international citizens, I foresee Japan having a modernization of culture that will rival its rise to economic greatness.

Towards founding a “Permanent Residents/Naturalized Citizens” organization

Hi Blog. With all the NJ anger regarding the new Fingerprint Laws–moreover the GOJ’s tendency of consistently showing indifference, if not outright antipathy, towards the needs and interests of Japan’s international residents–there have been comments in several Debito.org blog entries calling for the creation of a new organization to represent the Permanent Residents and Naturalized Citizens of Japan.

I agree the time is nigh. And I am very supportive of the founding of such an organization. We are talking as far as establishing a dues-paying registered NGO/NPO to that end, with the ability to lobby and lend support to other groups to pursue the interests of Japan’s international residents.

The organization is still in its embryonic stage. But let me create this separate special blog entry for people to discuss and pound out questions and concerns.

Steve Koya (who says he can take care of accounting, a job I detest) and I will meet sometime next week in Sapporo to chew things over. If you’d like to contribute your thoughts and feelings, please do so now.

It appears that the call for an association of resident foreigners is gathering steam. To that end, I have some questions and would like to take a stab at a mission statement here.

QUESTIONS:

1) Is this association for PRs only or for all foreign residents, regardless of status? If for all, how do we handle issues which may affect only certain segments of the foreign resident population, such as voting rights (which could be reasonably applied only to PRs)?
2) What are our membership requirements? (i.e. can anyone join, even if they are not living in Japan? In other words, for instance, can someone living in England who has a strong interest in Japan join?)
3) Related to 2) above, what different level of memberships could be available?
4) Can Japanese nationals join? (Of course they can, but we need to attend to other details, such as: are they given voting status in issues, can they hold official titles, etc.)
5) What is our stance on illegal immigrants? This is a policy debate that we can take up after we do form, but I want to put this on deck now so we can all start to consider the kinds of questions we will be tackling after forming.

MISSION STATEMENT DRAFT

The association is committed to protecting and enhancing the rights of foreign residents in Japan, abolishing systematic discrimination and changing the perception of foreign residents in Japan. We are committed to instituting persistent campaigns to educate, inform and motivate change at all levels of Japanese society in order to integrate new and progressive attitudes of foreign residents.

Our goals

– To promote the image of foreign residents of Japan to the indigenous population as well as globally.
– To highlight the benefits and positive impacts of foreign nationals to Japanese society
– To organize and campaign against negative or demeaning views of foreign residents as stated by certain politicians, pundits and media outlets.
– To educate foreign residents on the immigration laws of Japan
– To negate and diminish the negative views of foreign residents among the Japanese public
– To organize as a group and lobby for equal rights for resident foreigners under the law.
– To abolish systematic discrimination against the foreign community
– To participate in activities highlighting discriminatory practices against foreign residents

QUICK OPINION PIECE

The association is, by its very definition, an activist organization, but the activities must take on a multiple facets. Naturally, we must continue to highlight those instances where discrimination does exist and call with a unified voice for its removal. However, we should not focus only on the perceived wrongs committed by society as that tends to play us as victims and people tend to tune out after hearing complaint after complaint, but we should shed light on the positive aspects of resident foreigners in Japan. We know that the system can be rigged against us in many instances. We should concentrate on those who have overcome the difficulties, who have succeeded against the challenges. We can show that people can move to Japan and make a change for the better.

“NO BORDER” Nov 18 Meeting: Kokusaika & Keidanren laid bare

GROUP “NO BORDER” SECOND FORUM 2007 REPORT
HOSEI DAIGAKU, ICHIGAYA, TOKYO NOV 18, 2007

I spoke at the above gathering (http://www.zainichi.net) for about 40 minutes today. This is a little note to tell you what transpired:

1) HEARING FROM THE NEW GENERATION OF “NON JAPANESE”

This is essentially a misnomer, as these kids (college age already) are fluent in Japanese with some background in the native tongue of their immigrant parents. I met youth from China, Brazil, Peru, and most famously a young lady from Iran who came here at age seven, overstayed with her parents for a decade, and was granted a visa after much misgivings from the GOJ. Same with a young Chinese lady whose family had to go through the courts (lower court denied, high court granted) for a stay of deportation and one-year visas. Although all of these kids were just about perfectly culturally fluent in Japan (having grown up here as a product of the new visa regime, which started from 1990), they had a variety of faces and backgrounds that showed a lovely blend–a very hopeful one for Japan’s future. They made the best argument possible for visa amnesties for NJ with families–an extended life here that they have not only adapted to, but even thrived under.

The problem was they were grappling with things they really shouldn’t have to to this degree–identity. Being pulled one way by family ties overseas, and then another by the acculturation of being in a society they like but doesn’t necessarily know what to do with them. And refuses to let them be of both societies, either way their phenotypes swing. I suggested they escape this conundrum of wasted energy by ignoring the “identity police” (people who for reasons unknown either take it upon themselves to tell people they are not one of them, or who find the very existence of Japanized non-Japanese somehow threatening their own identity). They should decide for themselves who they are. After all, the only person you have to live with 24 hours a day is yourself (and believe me it’s tough)–so you had better do what you have to do to be happy. That means deciding for yourself who you are and who you want to be without regard for the wishes (or random desires) of millions of people who can’t appreciate who you are by any means considered a consensus. Trying to second-guess yourself into the impossibly satisfied expectations of others is a recipe for mental illness.

2) SPEAKING ON WHAT’S NECESSARY FOR JAPAN’S FUTURE

3) HEARING FROM A POWER THAT BEES–KEIDANREN

Coming late to the second talk sessions was a representative of Keidanren (Japan’s most powerful business lobby), Inoue Hiroshi, who was actually in charge of the federation’s policy towards business and immigration. He gave us a sheet describing future policy initiatives they would undertake, focusing optimistically on creating synergy between the varied backgrounds and energies of NJ and the diligence of Japanese companies.

Yet still trying to create an ultracentrifuge of “quality imported foreigners” over quantity (or heavens forbid–an open-door policy!). Orderly systematic entry with proper control, was the theme. And Taiwan’s system (for what it was worth, unclear) was cited.

When question time came up, I asked him whether Keidanren had learned anything from the visa regime they helped create (something he acknowledged) in 1990. All this talk of orderly imports of labor and synergy are all very well, but business’s blind spot is the overwhelming concern with the bottom line: People are imported and treated like work units, without adequate concern for their well-being or welfare after they get here. After all, if their standard of living was ever a concern, then why were the hundreds of thousands of people brought in under Researcher, Intern, and Trainee Visas made exempt from Japan’s labor laws–where they have no safeguards whatsoever (including health insurance, minimum wage, unemployment insurance, education–or anything save the privilege of living here with the dubious honor of paying taxes into the system anyway). Did they expect to create a system where there are no legal sanctions for abuse, and not expect employers to abuse it?

The Keidanren rep’s answer was enlightening. He said, in essence:

1) Japan’s labor laws are sloppy anyway, and don’t protect people adequately enough as they are (so that justifies exempting people from them completely?).

2) Japanese society is not wired for immigration (so why bring in so many foreigners then? the expectation was that they would not stay–meaning the system was only designed to exploit?)

3) There are plenty of elements of civil society out there filling the gaps (so you’re trying to take credit for those who try to clean up your messes?)

To me, quite clear evidence that they powers that be just don’t care. And it’s very clear it’s not clear that they’ve learned anything from the 1990s and the emerging NJ underclass.

The meeting closed with a really fine performance from a Nikkei Brazilian rapper who sang in Portuguese, English, and Japanese (I think–I find rapping indecipherable in any language). Now that’s synergy.

An Isseijin’s Outcry

Before reading any further, let me inform the readers that I am keeping my whole identity confidential, for the sole reason of protecting myself. But what I can tell you is this: that I am a Japanese citizen by birthright (born in Japan, and my father being a Japanese) and a half-Filipino half-Japanese in terms of ethnicity. I can understand Nihongo, but I have yet to become fluent with my native tongue. I was raised in my mother’s homeland to become an educated and responsible person and I have returned here in Japan with the hopes of pursuing my goals and aspirations.

Prior to my return, I have been informed of many accounts about the realities that people have faced during their stay here. I kept all these in mind but made utmost effort not to make hasty assumptions about the Japanese people in general. But now, only after 3 months of my stay, I am writing this entry because I am beyond compelled to relate to the readers an encounter that has exacerbated my growing skepticism about this country:

November 1, 2007. For Christians, it was a day designated in commemoration of the Church’s role models, the saints. Here in Japan it was just a typical autumn morning… or at least it was supposed to be. My brother walked out of our apartment as I was left making final preparations for a day’s work. When the clock struck 6:20 am, I knew I had 3 minutes left before I miss the train ride en route to the city where we work. And without a second thought, I hurriedly took the usual route on the way to the train station. And just when I was about a corner away, I caught a
glimpse of a scene that rendered me speechless for events to come – my sibling backed against a wall, holding his Japanese passport while being surrounded by not less than 8 men clad in blue suits or work clothes (genba). They were representatives from the local police and the immigration office, who disguised themselves as civilians to catch us off our guards.

Two of them saw me coming and tried to stop me from going any further. But they didn’t have to. I stood still, dumbfounded with what I saw, wondering how this could have happened to us. As I approached my brother, he told me that they are in pursuit of illegal immigrants and we appear to be their targets. But what baffled me was the fact that my brother had already shown his passport yet these individuals continued to bombard him with questions. Nor did they even back down to give my brother some personal space to explain that we are Japanese but have been raised elsewhere. Shouldn’t his passport suffice to let him continue to go to work? And what confused me even more was that I recall a policeman conducting a census in our area less than a month ago. My brother himself showed the proper documents as a proof of our legitimate residence.

I was so lost in my thoughts that I can hardly respond to their multiple queries. Then one of them asked if I was his brother. We responded “yes” and I was asked if I brought my passport. The first thing that entered my mind was “Why in the world do I have to bring it with me to work?” Obviously I didn’t have one, and so we were asked to escorted to our house and get it. And then it struck me. What if I was the one who went ahead to the station?

As we showed them my passport, they knew they were left with squat. My brother was psyched out and so he decided to stay in the apartment. I chose to go to work and explain the incident to our supervisor; but as I rushed back to the station, I noticed that there were more men than ever surrounding the vicinity of our house. I wasn’t there for their explanation, but I was told later that a tip from a source prompted them to make a move against us as soon as they heard it. But as far as I know, a tip in itself does not establish enough grounds to arrest someone. Just because of the way we look, we were tagged as criminals. Because of our complexion and facial features, because of our heritage… it was enough to send an armada of men to put us down, as if we were highly dangerous to the society. We felt debilitated, humiliated and dehumanized. And as an added insult to injury, I have to bear with the fact that I have to keep a passport handy whenever I go out for personal or work purposes, ironically, in a country where I bear a citizenship.

Now, I know for a fact that this incident is not as rare as a solar eclipse; there are some who may contend that everyone who is “gaijin” or considered to be one will most likely go through similar troubles here in Japan, thus it does not hold much gravity. But this experience is enough to stir thoughts that have been welling within me for quite some time; for this is just one facet of what my brethren, the so-called Japanese-Filipino (or Ja-pino) issei-jins go through in this country. Allow me to speak for those who share these burdens but are not able to articulate themselves, as I share to the readers our story that is perhaps unknown to many.

We, the isseijins, are children born out of the Japanese bandwagon during the 80’s until the 90’s, when a great interest in the Philippines (among other Southeast Asian nations) and its people was highly prominent. (Nowadays, it is apparent that the people from the West are getting the attention.) And when the time came for our country to lose its popularity, it is as if the Filipinos were reduced to almost non-existent. Nowadays, I have noticed that there is not a single Filipino featured in any television show that involved representatives from other countries. But that’s nothing compared to our current state of living. Today, isseijins like me, whether raised in Japan or elsewhere, are far from being recognized to be a part of the society. Most, if not all, are subjected to tough working conditions in a factory, required to produce perhaps twice the output of the “true” Nihon-jins and compelled to work longer hours when “requested” (they will deem us irresponsible if we decline). And while we do just that, at the end of the day, we will still be “arubaitos” (temporary workers) – and as such, we do not have the support of labor laws. Is this a predetermined social script that has been handed down to our kin? And unlike the “gaijins,” we have nowhere else to go; in our “other” homeland, we cannot easily get a job as the locals take precedence over us.

I myself have taken steps to get out of this social milieu. I tried vying for an English teaching job for almost a year now, but I only managed to merit three interviews in that length of time, all of which were from a reputed learning center. I recall the first one wherein I almost lost the chance for an interview from a branch within the prefecture, as the Japanese manager was deliberately deferring me to another school. I was told that the latter is nearer, only to find out that the opposite is true! Fortunately, the interviewer still gave me that chance, although I did not make the cut because “someone was in the immediate area and is willing to train immediately.”

It’s really sad, but I to continue the fight as I refuse to say “shoganai” and just stick to the program. I am willing to exert 10 times more effort in order to secure a job that I can be proud of, one that can inspire my fellow people to strive for excellence, instead of being kept in the shadows of a backbreaking unskilled labor job in a factory. I truly seek for recognition, if not acceptance, of our kind in this society; and I feel that that time has yet to come.

Subject: My story about harrassment by the yoshikawa police

I would like to start off by asking Japanese people who have traveled overseas a very simple question: while overseas, how many of you actually had problems with police harassment. How many of you were asked to show your passports or proof of alien registration or visa just because you were not the right color, or because you just looked different? Chances are, most of you would say ”never!”

Now please sit back and read about the following situations that I, an Englishman, have had to endure. These incidences have taken place in the city of Yoshikawa in Saitama Prefecture and the authorities mentioned here are all members of the Saitama-ken Yoshikawa Keisatsu.

This is the incident that caused me to finally say enough is enough and tell someone about this. I was having the oil changed in my car and I had decided to take a walk to the local police box by Yoshikawa station, because I had lost my mobile phone the week before and I was wondering if they had found it. While walking, a police car passed me, and the two coppers inside stared at me intensely. I ignored the stares and walked on. I was close to the station, when the car pulled up beside me, coming to a screeching halt; there was only one cop inside. The other had snuck up behind me. I hadnft done anything wrong, yet both were treating me like a fugitive on the run, trying to cut my avenue of escape, as if I would try to run anyway! The one behind me asked if I was working here. (this whole conversation was conducted in Japanese) I said yes. He asked to see my GAIJIN card, a word that I find extremely offensive, as do most foreigners I know.

I asked him, ”Why? Have I done anything wrong?

”Nothing at all” he replied. ”We’re just checking foreigners’ GAIJIN cards, making sure that they are all legal. Recently there have been a lot of problems with Chinese people.” Did I miss something here?

I asked him, ”Do I look Chinese to you” (I’m white)? He said no. I continued, “As a matter of fact, you two look more Chinese than I do, correct?” They both laughed uncomfortably, not knowing whether to agree or disagree with my statement. The older one spoke up.

”Its not just the Chinese now days. Recently wefve been having many problems with Middle Eastern people. They are terrible people.” Now I was starting to get upset. My grandparents on my mother’s side came from Egypt. I told him that.

”Oh! Well, I don’t mean all of them are bad. Just some of them,” he said. ”And the Iranians. We have so many problems with Iranians.”

“In Yoshikawa?!” I was shocked.

“In Misato. But they are right next to each other.”

“I’ve never heard about anything happening,” I said.

”They’re minor infractions, but they do happen.”

“This is discrimination. Do you know that there are more than 100,000 Japanese nationals living in the UK alone? And what about America, Canada, Australia, etc. When Japanese nationals go overseas they don’t get treated this way. Why do you do this to us?”

”Over there, that’s England. This is Japan,” was the reply.

”And you are a racist,” was mine.

”We are often told that by people when we stop them, but it’s really not true.”

“You just stopped me simply because I don’t have an Asian face. That’s discrimination.”

“Oh, thatfs not true! We stop the Fillipinos and the Chinese as well!” was the enthusiastic reply.

”Well, that’s racism. You’re basically discriminating against non Japanese.”

“We have a lot of problems with foreign crime!” he protested.

“You don’t have problems with Japanese people committing crimes?” I asked.

”Yes we do,” he said.

”You don’t go around stopping THEM, do you?”

”They’re JAPANESE. They donft have Gaijin cards.” He laughed in a condescending way at me, as if to tell me my comment was stupid.

”That’s still discrimination. Both groups commit crimes. Both have good and bad people among them. Yet, you only stop the foreigners. That’s discrimination.”

”All right,” he challenged me. ”What DO YOU think we should do? What DO YOU think we should do?” I was quite frankly taken aback. I thought for a second. I looked at him.

”Nothing,” I said. ”Don’t do anything. You can’t do anything. You can’t arrest someone before they commit a crime, right? You have to wait until they commit a crime. Am I correct?”

”This is all we can do. We have to do this to check up on foreigners living here,” he insisted.

”Do you really think that most, much less all the foreigners in Japan who commit crimes donft have proper visas. There are foreign criminals who are married to Japanese women who are living on spouse visas. There are people living in Japan without a proper visa, but who have never committed a crime. There is absolutely no relation being a criminal and having a proper visa.”

”Hmm,” was all that came out of him.

“Therefore, you have done nothing. You have gained nothing. And you know that. This is nothing more than a racist gesture.”

He tried to argue some more, but at that moment I realized that this could go on for hours. So I gave him the ”Gaijin Card” he so badly wanted to see. He noted it momentarily, and gave it back, insisting that he shake my hand. I did reluctantly. We parted our separate ways.

A year before that, I was on my way home, riding my bike, and was a few feet from my house when 2 police cars flashing their lights and sirens told me through their loudspeakers in Japanese to stop. I did. Eight coppers got out of the car and surrounded me. Needless to say, I was quite alarmed.

”Have I done anything wrong?” I asked the one nearest to me.
”No,” he said. ”Routine Checku.” He pronounced it in katakana English.

Another one came up to my right side and growled for my Gaijin card (I really hate that word). I gave it to him. A third snuck up to me from behind and when I turned to face him, he leaned in close to me and asked me in a threatening voice that was meant to be intimidating which country I came from.

That was the last straw. Fear and alarm turned into outrage and downright fury. I leaned even closer so that our noses were almost touching and said, ”EGIRISU” in a loud and challenging voice. I glared at him, in a challenging way. He backed off, and retreated back into the safety of his comrades. I was asked a whole series of questions to which I responded to with as much patience as I could muster. I went home feeling pretty much the same way I felt after the last incident a few weeks ago: drained, tired, depressed, helpless, upset, and most of all furious.

What’s going on here? Why is Japan treating her foreigners like they are ALL criminals? Yes there is foreign crime in Japan. But it is significantly lower than in other countries and nothing when you compare it to crime committed by Japanese nationals. I can also tell you right now, the Yakuza are creating massive problems for us in London. They practically run Little Tokyo in Los Angeles and they are very powerful in parts of New York as well as North Vancouver. Contrary to popular belief, Japanese do commit crimes in other countries too, but nobody singles THEM out and forces them to show their proof of status.

Also, a very small number of foreigners actually commit crimes. I know this, because had the number been significant, there would have been martial law declared on all foreigners. This forcing people to show their passports or gaijin cards only incites hatred, disdain, and rage toward the Japanese people as a group, and does no one any good. You’re not stopping foreign crime. Anyone can get married to a national and get visa status. This happens around the world. This forcing of foreigners to carry ID with them at all times is nothing more than a racist gesture. It solves no problem. It adds to it. And believe me, it adds to Japanese people’s problems too.

Japanese people love to travel. Imagine having experiences like mine in a foreign country and coming home feeling nothing but negative about that country. Now imagine you just met someone from that country in your own country enjoying life, smiling, and enjoying the very privileges that were denied you when you were in that country. How would you feel towards that person? Hostile? Would you want revenge? All these foreigners you are mistreating have a home country. They will probably go back someday. Your friends, relatives, children, etc might someday find themselves as Gaijin in these countries. Heaven help them if they run into a disgruntled foreigner whose experiences in Japan were negative. Heaven help any Japanese national who runs into me in the UK and tells me he is a police officer in Japan.

See what you have done? And for WHAT? We are human like you.

For your information the KR&AC was given a manifesto way back in the late 1800’s by the Embassies that said that the President and Committee of the KR&AC were to be the de facto leaders of the foreign community of Kobe, something that has never been changed though has not been used in decades either. I intend reminding City Hall of this.

When i was at immigration this morning the tanto sha did mention that there would be officials pointing out booths for re-entry permit holders but that these booths would be the ones that the Japanese go through. Hello Dr Sadhwani. Arudou Debito in Sapporo here. Thank you very much for your email. Received with great honor and gratitude. Let me take this opportunity to make a few suggestions to your membership about activities you might engage in to protest the fingerprinting policy:

ACTIVE:
1) At any public opportunity you have, in any venue you deem appropriate, slip in a subtle (or not so subtle) indication that you have serious misgivings about a policy that follows the logic of treating all non-Japanese axiomatically as “terrorists and carriers of infectious diseases”.

And one that treats all long-term non-Japanese residents and taxpayers as tourists, non-residents, and aliens unconnected to their Japanese families–no matter how long they’ve lived here and contributed to this society’s demographically-troubled future.

Suggested venues include meetings with public officials, members of the government and bureaucracy, the diplomatic corps, press outlets, agencies connected with tourism and foreign exchange, and especially politicians. A mention in passing is fine. But do a little something. Remind them that this issue is not going to go away, and we are not just good little “guests” that will take a slight as deep as this lightly.

2) Encourage your friends to take their trips elsewhere–tell them you’ll meet them overseas. Even encourage them to join in the fight. For example, a contributor wrote me tonight:

PASSIVE: Refuse to be separated from your Japanese families at the border. Stand in the same line. Slow things up. Make it clear that Japan is not immune to the effects of immigration and globalization, and that it must remember that Japan’s international residents are as integrated into and contributing to this society as any other citizen.

In short, please don’t do nothing. Please consider showing that the “gaijin” being targeted by this policy (essentially anyone who is not US Military under SOFA, Diplomats, or Zainichi Korean/Chinese etc.–since their being exempted is purely political; they would have more effectively fought back if fingerprinted as well) are neither docile nor impervious to being treated as suspicious criminals–by a government that is happy to take their resident taxes and tourist dollars, yet not treat them with the commensurate respect.

Now some quick counterarguments for the pedants, for what they’re worth:

Yes, there are restrictions on other things, such as pianos, but pianos and other material effects are not people. Same with pets, of course.

Yes, there are restrictions on students and children. But one does not remain a student or a child all their life, so it’s not the same as discrimination by nationality. (And for the record, I do not support “Women Only” apartments by the same logic. In any case, the default mode for apartments is accepting women, whereas the default for “gaijin” is rejection.)

What a lovely way to welcome newcomers who have enough hurdles to jump over in this society, without having the most fundamental thing they need in their life–a place to rest their head every day–denied them when they first arrive or need to move. Moreover relegate them to lousy housing regardless of income.

And the fact that this company is bold enough to make exclusionism so explicit (the realtor will no doubt counterargue that this is done by the landlord’s wishes; they’re just following orders) makes them an accessory to the discrimination in black and white.

Debito.org wishes to discourage this type of systematic discrimination in any way possible. I have put this company on the “Rogues’ Gallery of Exclusionary Establishments”.

Suggest you take your business elsewhere if you’re looking for apartments in Fukushima-ku, Osaka. Someplace less tolerant of intolerance.

The Land, Infrastructure and Transport Ministry launched the Web site Anshin Chintai (safe rental housing) in June to provide rental housing information and lists of real estate agents and NPOs that can support foreign apartment-seekers. So far, Tokyo, Fukuoka, Osaka and Miyagi prefectures and Kawasaki have joined the project. For example, 237 real estate agents in Tokyo are listed as supportive firms.

Despite government claims it is necessary to counter terrorism, a new immigration procedure obliging most foreigners to be fingerprinted and photographed upon entry to Japan has come under fire as an unwarranted invasion of privacy.

Critics also contend the new policy, which takes effect Nov. 20, will result in even longer waits at immigration control gates.

More to the point, experts doubt whether it will even stop potential terrorists from entering the country.

Under the procedure, visitors whose biometric data match those on confidential terrorist watch lists will be denied entry to Japan. The lists are believed to include one compiled by the U.S. government and contain the names of about 750,000 “terror suspects.”

Justice Minister Kunio Hatoyama has said Japan will cooperate with U.S. authorities in exchanging immigration data.

But Barry Steinhardt, director of the American Civil Liberties Union’s Program on Technology and Liberty, said the U.S. watch list is “bloated and full of inaccuracy.”

“The U.S. immigration policy is a total failure,” Steinhardt warned, expressing concern that Japan’s version of biometric verification will likely be built on a flawed foundation.

Exempt from the new measure are “special permanent residents” of Korean and Taiwanese descent who had Japanese nationality before the end of the war and their descendants. Also exempt are diplomats, children under age 16 and those visiting at the invitation of the government. Foreigners with permanent residency status will be obliged to submit to fingerprinting every time they enter the country.

Speaking at the Foreign Correspondents’ Club of Japan in Tokyo last month, Steinhardt alleged that not only will the immigration system put all visitors to Japan into an antiterrorist database, it will also fail to provide the defenses against terrorism that it promises.

He questioned the credibility of the U.S. terrorist list, noting it remains unclear how it is compiled — and how people get onto or off of it.

Steinhardt pointed out that pop singer Yusuf Islam, formerly known as Cat Stevens, was denied entry to the U.S. in 2004 apparently after being mistaken for another person with the same name (though spelled differently) on the watch list.

“It’s full of mistakes. That is the reality in the U.S. and it’s likely to become reality in Japan,” Steinhardt said. “Whether or not the loss of liberty is worth the security gained is not a question — because no security is gained.”

According to the Justice Ministry’s Immigration Bureau, all foreigners ineligible for exemption will be directed to special equipment — similar in appearance to a small computer display — for taking fingerprints and photos upon arrival in Japan.

Questioning by an immigration inspector will follow. Those who refuse will be automatically deported.

Naoto Nikai, an Immigration Bureau official, said passengers who preregister their biometric data can use an automated gate system. But of all Japan’s international airports, such gates are scheduled to be installed only at Narita International Airport, while preregistration can only be accepted at an immigration office in Shinagawa Ward or at Narita’s departure area beginning on Nov. 20.

“This is an important tool against international terrorist activity,” Nikai repeated to reporters during a briefing last month.

Asked whether the new process will cause longer lines at immigration, Nikai only said the bureau will try to maintain its current goal of getting each passenger through immigration within 20 minutes.

He wouldn’t answer whether foreign mothers traveling with Japanese infants would be separated at immigration gates. “The immigration officer at the airport will (make the judgment),” Nikai said.

Japan has also not decided how long biometric information collected under the new procedure will be stored in the system.

Although Nikai gave assurances that only the minimum number of personnel would have access to the data, Makoto Teranaka, secretary general of Amnesty International Japan, called the procedure a “violation of human rights to privacy.”

During a recent news conference, Teranaka pointed out that the database will likely be shared by police and other government agencies — and possibly their counterparts in other countries as well.

“We can’t see any justification for introducing this system,” he said, adding that the group will ask the government to reconsider.

Stressing the need to fingerprint and photograph even Japan’s longtime foreign residents, however, Justice Minister Hatoyama claimed to know about a disguised al-Qaida member who repeatedly entered the country on fake passports.

“A friend of a friend of mine is a member of al-Qaida,” the minister said in a speech at the FCCJ last month — a remark that stirred up controversy for which Hatoyama was rebuked by his fellow Cabinet members. He also said he had been told that terrorists were sneaking across borders using fake IDs.

“I realize this is arduous, but (biometric verifications) must be carried out (even on permanent residents) to fight terrorism,” Hatoyama said.

Daisuke Arikado, a representative of Tokyo-based nonprofit group Foreign Criminal Expulsion Movement, welcomes the strict procedure in hopes that it will make Japan safer “not only for Japanese, but for foreigners living here as well.”

While acknowledging cases of human rights abuses overseas resulting from strict immigration procedures, Arikado argues that as a country that hosts many U.S. military bases, Japan is obliged to ensure that terrorists are stopped at its borders.

Arikado also says the system will help keep previous deportees from re-entering the country, which he claims will reduce the crime rate by foreigners in Japan.

“It wouldn’t bother me to provide fingerprints and photographs upon arriving in the U.S.,” Arikado said. “When visiting a foreign country, it’s obvious that one should abide by its rules.”

The United States has fingerprinted and photographed visitors since 2004. Japan will become only the second country in the world to introduce such a system.

Longtime permanent foreign residents in Japan have protested the new procedure.

Louis Carlet, deputy general secretary of the National Union of General Workers Tokyo Nambu, whose members include many foreign workers, claimed that the system would be ineffective because any determined terrorist would likely find a way through the biometric verifications.

“The union is against the system,” said Carlet, 41, who has lived in Japan for 12 years and holds a permanent resident visa. “Fingerprinting blameless foreigners and treating them as criminals is counterproductive, and a violation of their human rights. If Japan wants to fight terrorism, it should stop cooperating in a war that is itself an act of terror.”

Protest pays off: Now separate lines for residents when fingerprinting NJ at Narita

“On the way out of the country, I picked up an Immigration form. There WILL be a special booth for re-entry visa holders. But there WON’T be a card and we WILL have to be fingerprinted and photographed EVERY time we re-enter the country.”

COMMENT: You see, protest does have an effect.

But it still hasn’t resolved the problem of how this is going to impede businesspeople (especially APEC Business Travel Card holders…), not to mention the issues of treating every non-Japanese as a potential Typhoid Mary or Osama Junior… every time. Or the fact that the letter of the law is still not being followed nationwide. As Steve Koya poignantly commented today:

It is a simple argument, following on from my note yesterday about the Automatic gates. A chat to Sapporo Immigration confirmed that there were no plans to have the gates at Chitose or at any other airport other than Narita, giving lack of time and money as a reason.

Well, despite the fact they may have no time or insufficient funds, unfortunately Immigration are required by the new law to make the Automated Gates available to non-Japanese residents, at all airports within 18 months from the promulgation of the legislation, 24th May 2006. There is no “Only Narita” clause, there is no post promulgation amendment.

If they are not able to apply the law, then it should be rescinded. You could also state that failure to apply the law in full would also make it non-binding, so refusing to give your prints would theoretically not be illegal.

All we need is a decent lawyer! Amnesty, show us your muscle!

European Business Council and Australian/ NZ Chamber of Commerce protest NJ fingerprinting laws

Both the European Business Council in Japan and the Australian and New Zealand Chamber of Commerce in Japan have agreed that Immigration’s new NJ Fingerprint Laws “impose unacceptable costs” on businesses, and finds regrettable the “grouping [of] long-term residents and taxpayers in Japan with occasional visitors”.

“WE BELIEVE THAT THE INTRODUCTION OF MANDATORY FINGERPRINTING AND PHOTOGRAPHING OF FOREIGNERS ENTERING AND RE-ENTERING JAPAN MUST BE CONDUCTED IN SUCH A WAY THAT IT DOES NOT ADVERSELY AFFECT FOREIGN RESIDENTS, BUSINESSMEN AND COMPANIES IN JAPAN.” [emphasis added]

This is to inform you about the implementation of the revised immigration law, scheduled for November 20. In short, the revised law says that all foreigners have to leave their fingerprints and take a photo when entering Japan. The EBC has over the past year strongly insisted that the implementation of the law should not complicate or delay the re-entry procedure of foreign residents in Japan. We have especially objected to forcing re-entry permit holders to line up in long queues with all other foreigners (tourists e.g.) to take fingerprints each time re-entering Japan.

After long discussions with the Ministry of Justice, it is now clear that re-entry permit holders will be able to pre-register fingerprints and photo at either Shinagawa or at Narita on the way out. Undergoing this procedure once should grant swift re-entry at Narita (not other international airports) as long as the passport/ re-entry permit is valid. Information about this system is not yet available in English but can since October 26 be found in Japanese on the MOJ website:

The Ministry of Justice has also said that for those re-entry permit holders who have not yet pre-registered their fingerprints and photos, there should be a line separate from other foreigners (e.g. tourists) at the immigration counter. However, the MOJ not yet made this commitment in writing – because they may not be able to staff the extra lines at all times of the day.

EBC Chairman Richard Collasse sent a letter on October 26 (please see attached) jointly signed with the Australia New Zealand Chamber of Commerce to demand that information about the new system is made available in English ASAP and that the commitment to set up separate lines at immigration counter for re-entry permit holder are not pre-registered is made also in writing. At this time, the semi automatic gate system will not be available at Kansai and Nagoya International airports. The solution for Kanto residents appear to be to go to Narita airport early and preregister (you only have to do this once).

We will continue to ask for more clarity on the new procedures from MOJ and will be sure to get back to all of you as soon as we have more information on this urgent issue.

I am getting really annoyed at being treated like a criminal what with all this fingerprinting. We seemed to be moving nicely away from that trend in recent years with the fingerprints being removed from our Alien Registration Cards. I am feeling distinctly unwelcome in the country I have called home for ten of the past twelve years… Shaney.

I called immigration just now. I talked with a wise lady who has been at Nagoya immigration ever since I applied for my first visa extension over 12 years ago, she advised me when I got my first marriage visa, and my permanent visa. She also advised me when I wanted to sponsor a friend for permanent residence. So far she’s never steered me wrong.

She was completely baffled by me calling and said *I* personally have absolutely nothing to worry about, no one will be asking for my FBI records.

I tried to explain to her, I wasn’t necessarily concerned for myself but wanted to know if anyone else might have to at some point provide such FBI records. She said the only people she was aware of that required records from the FBI were American nikkeijin. She said this was indeed a new law, and that must be what the US state department is talking about. Even here, I think it might have only been third generation Americans that needed FBI records.

Now, I read her in English what was at the State Departments site, and explained it in Japanese as well. She could not make any sense of the idea that I would have to provide FBI documents merely to renew my gaikokujin toroku sho. (Gaijin card). She said that didn’t make any sense to her as it has nothing to do with your visa.

That was that. She could be in error.

1) “Long term resident (teijusha)” is one of 27 Status of Residence (visa) categories.

The word “long term” is just a translation of “teiju” and has nothing to do with the validity of the Status of Residence nor the number of years you have lived in Japan. It’s just a name of the Status of Residence. So some have three year “long term resident” and others have one year “long term resident” on their passport. You can even obtain “long term residence” on arrival if you have a corresponding Certificate of Eligibility.

“Permanent Resident (eijusha, or eijuken)” is another Status of Residence. It is different from “Long term resident.”

Below is a list of all 27 Status of Residence categories. It has been like this for about 20 years, nothing new.

2) However, the requirements for each Status of Residence have changed frequently. Part of it is stricter requirements for “Long term resident” because of, I think, recent crimes by the Japanese descendents (nikkei) with “Long term resident” Status of Residence who came to Japan with false documents or criminal records in home country (police clearance was not required back then.)

Not all “Long term resident” holders are required to submit police clearance, but only Japanese descendents (nikkei) and their spouse.

The new requirements below. (Only in Japanese) The phrase “sokou ga zenryou dearu mono = those whose behavior and conduct are good” was recently added to Item 3, 4, 5, 6 (i.e. requirement categories for Japanse descendents and their spouse), and is the legal basis for requiring police clearance.

Summary

Despite an express policy against importing unskilled foreign labor, the Government of Japan (GOJ) since 1990 has been following an unacknowledged backdoor “guest worker” program to alleviate a labor shortage that threatens to become chronic. Through its “Student”, “Entertainer”, “Nikkei repatriation”, “Researcher”, “Trainee”, and “Intern” Visa programs, the GOJ has imported hundreds of thousands of cost-effective Non-Japanese (NJ) laborers to stem the “hollowing out” (i.e. outsourcing, relocation, or bankruptcy) of Japan’s domestic industry at all levels.

As in many countries including the United States, France and South Korea, immigration has become a hotly-debated subject. While Japan’s immigrant population is much smaller than that of many European and North American countries, there is growing reliance on foreign labor resulting in a doubling of the number of registered NJ in Japan since 1990.

Despite their importance to Japan’s economy, this has not resulted in general acceptance of these laborers as “residents”, or as regular “full-time workers” entitled to the same social benefits under labor laws as Japanese workers (such as a minimum wage, health or unemployment insurance). Moreover, insufficient GOJ regulation has resulted in labor abuses (exploitative or coercive labor, child labor, sundry human rights violations), to the degree that the GOJ now proposes to “fix” the system by 2009. The current debate among ministries, however, is not focused on finding ways to help NJ workers to assimilate to Japan. Rather it has the effect of making it ever clearer that they are really only temporary and expendable. The most powerful actor in the debate is the Justice Ministry. Its minister under the former Abe administration proposed term-limited revolving-door employment for NJ workers. Meanwhile, one consequence of the present visa regime is a growing underclass of NJ children, with neither sufficient language abilities nor education to develop employable skills and adjust to Japanese society. Nevertheless, immigration continues apace. Not only does the number of foreign workers grow, but Regular Permanent Residents (RPRs) also increase by double-digit percentages every year. By the end of 2007, the number of RPRs will surpass the number of generational Zainichi Permanent Residents of Korean and Taiwan origins. In conclusion, Japan is no exception to the forces of globalization and international migrant labor. The GOJ needs to create appropriate policies that will enable migrant workers and their families to integrate into Japanese society and to find appropriate jobs that will maximize their contributions at a time when Japan faces acute labor shortages that will increase the importance of migrants.

STOP THE “JAPAN VERSION OF THE US-VISIT PROGRAM”
APPEAL FOR THE OCTOBER 27, 2007 SYMPOSIUM

The introduction of the Japan version of the US-VISIT Program, where almost all non-Japanese residents and re-entrants will have their fingerprints, face photographs, and personal details taken and recorded upon (re-)entry, is imminent.

Although this system, which was approved by the 2006 regular session of the Japanese Diet (Parliament) mainly as a means of combating terrorism, has not in our opinion been properly deliberated and considered by our policymakers.

For example:

1) Is it acceptable for these measures to be adopted without clear legislation regarding the collection, processing, use, and disposal of fingerprints, which is highly personal and biotic data?

2) Is it acceptable to entrust this kind of data, which as fingerprints and photos are of a highly personal and distinguishing nature, to all governmental bodies in this manner?

3) Is the technology behind biometric data collection really all that reliable?

4) Can we truly say that the definition and classification of “terrorist” has been clearly defined by law?

5) Have proper restrictions been put in place so that this information is not given to other governments?

These questions were neither adequately addressed nor answered when this program was passed by our legislators. Further, based upon our legislators’ answers and misunderstandings about these measures, it is clear that this program has been adopted without an adequate degree of preparation. Even though a year has passed since this program was approved, the above concerns remain unaddressed.

For these reasons we make this public appeal. We oppose this “Japanese version of the US-VISIT Program”, and add the following reasons:

The basis for requiring non-Japanese to give biometric data when entering Japan is the presupposition that “foreigners are terrorists”. This is discrimination towards non-Japanese people. With the exception of the Special Permanent Residents etc., taking fingerprints, photos, and other biometric data from almost all non-Japanese is an excessive and overreaching policy. In light of Japan’s history of using fingerprinting as a means to control and track non-Japanese residents, one must not forget that thus equating non-Japanese with criminals is a great insult and indignity.

It has also become clear in Diet deliberations that this biometric data will not only be utilized for “anti-terrorism”, but also in regular criminal investigations. This use is of sensitive biotic data is clearly beyond the bounds of the original goal of these measures, something we cannot allow our government to do.

Further, there an assumption that this data will be kept on file for at most 80 years, which means it will amount to millions of people being recorded. It goes without saying that keeping this much sensitive data (given that biometric data is the ultimate in personal information) for this long is highly dangerous.

Add the fact that the very definition of “terrorist” is vague, and that it is being applied not merely to people who “undertake action with the goal of threatening the public”. People who are “probable agents” of terrorism, or “can easily become probable agents” of terrorism, or who are even “acknowledged by the authorities as having sufficient grounds for becoming agents” of terrorism, are also included. This is completely unclear, and creates fears that Immigration officials will deliberately use this as a means to expand their powers.

Meanwhile, it is nowhere acknowledged that the US-VISIT Program is in any way an effective means of preventing terrorism. In fact, the very model for this system, the United States, has been advised by its Government Accountability Office that the US-VISIT Program has some serious weaknesses.

In other words, the US-VISIT Program, nominally introduced for anti-terrorism purposes, has not been clearly adjudged as fulfilling such purposes adequately. In fact, introducing said system has created clear and present human rights abuses. Even if such system was proposed for the express purposes of “anti-terrorism”, any country duty-bound to hold human rights in high regard has no mandate to do this. This point has been stressed several times by the United Nations, and in other international organizations debating anti-terror. It is hard to deny the danger that this means to control foreigners, under the guise of “anti-terror”, will lead to a deliberate disadvantaging of specific races, religions, and ethnic groups–in other words, the embodiment of racial profiling and racial discrimination.

This “Japan version of the US-VISIT Program” is thus laden with problems. There is not enough reason for it to be introduced in this version at this time. For this reason, we who have gathered at this symposium strongly oppose this program and demand its cancellation.

New MHLW requirements Oct 1: Employers must report their NJ workers to the govt

Hi Blog. I’ve been getting a lot of questions recently from people being approached by their employers and asked for copies of their Gaijin Cards.

The MHLW says, in its link below:
 平成19年10月1日から、すべての事業主の方には、外国人労働者(特別永住者及び在留資格「外交」・「公用」の者を除く)の雇入れまたは離職の際に、当該外国人労働者の氏名、在留資格、在留期間等について確認し、厚生労働大臣(ハローワーク)へ届け出ることが義務付けられます。(届出を怠ったり、虚偽の届出を行った場合には、30万円以下の罰金の対象となります。)

“From October 1, 2007, all employers are now legally bound to formally submit (by todoke) to the Minister of Health, Labor, and Welfare (Hello Work) a report on all their pertinent foreign laborers (confirming their name, status of residence, and duration of visa) when they are hired or leave work. Exceptions to this rule are Special Permanent Residents [the Zainichis], or people here on Government Business or Diplomatic Visas. Those who do not do so promptly and properly will face fines of no more than 300,000 yen.” (Translation Arudou Debito)

I knew that the GOJ had long proposed taking measures against visa overstayers, and I too agreed that employers who employ illegals should take responsibility (as opposed to the standard practice of punishing the employee by merely deporting them at a moment’s notice). But I wish there was a less intrusive way of doing this. And I wish more care had been made to inform NJ workers in advance and explain to them the reasons why. (In comparison, the recent Fingerprint Law amendments were enlightened in their PR. And that’s not saying a lot.)

The law came into effect on the first of October, so don’t be surprised if someone from your workplace comes round asking for copies of your alien card. Perhaps I am simply clueless, but I hadn’t heard a single thing about this, and was therefore quite surprised to hear about it. Considering that all foreigners’ addresses are on file in the ward/town/city offices, one would think the government could make a bit more of an effort to inform us of changes in the laws… I suppose that may be expecting too much. Anyway, I haven’t been asked for any information yet, but we’ll see how things pan out. FWIW.

Debito, After reading your many articles I NEVER show my gaijin card to hotels etc. Thanks so much for all your work and research on this topic!

Yesterday I got an email from a university where I teach part time. They said:

“The University Office called me to ask you for a photocopy of your ID Foreigner Registration Card). As you may know, our government has set a new law to protect foreign workers, so U of Toyama needs to keep the copy.”

Are you familiar with this “new law?” I am not. And do schools have the right to request a copy?

Reading the rules at the website given, it seems that employers should use common sense in determining if a potential employee is a foreigner, e.g. their name, appearance or japanese ability.

I can expect to hear of returnees and the spouses/children of foreigners gettin some hassle over this.

BTW, nowhere do the rules require submission of the ARC to an employer. They are required to verify the details on it, which can be done without actually physically surrendering it (if you want to pick a fight about it that is.)

As regards not telling us about it, the rules seem to be aimed at employers rather than employees. Tony

P.S. Did anybody else get a letter from their tax ofice last month asking to confirm if you were a resident or domicile for tax purposes?

With the changes to the law that came into effect on Oct. 1, companies employing foreigners must report their names, visa status, address and date of birth to the government.

Those in Japan’s adult entertainment world are bemoaning the crackdown, saying the existence of cheap pubs and clubs where many foreign women work will be threatened.

“Up until now, the only companies that have had to report all this stuff have been those with 50 or more employees and they only had to do that once a year, while reporting was voluntary for companies with fewer staff than that,” a writer on the adult entertainment world tells Nikkan Gendai. “Now, under the new law, every company is legally obligated to report on each and every foreigner it employs. With employers facing fines of 300,000 yen if they fail to comply, everybody’s getting really antsy.”

Entertainment joints staffed by foreign women are popular among salarymen as they are typically cheaper than equivalent nightspots with Japanese women employees, and 3,000 yen to 4,000 yen is usually good enough to get a couple of stiff drinks and female companionship to make other things stiff, according to the lowbrow afternoon daily.

Nikkan Gendai says establishments that typically ignore their employees’ visa status, like South Korean nightclubs, Chinese massage parlors and Philippine pubs, may be terminally effected by the legal changes.

Aki Wakabayashi, author of a book called “Sarada Bouru ka shita Nihon (Japan Turned Into a Salad Bowl)” which advises Japanese to get used to a multicultural future, says the crackdown on foreigners could create plenty of problems.

“What this new law does is offer authorities a pretext to do a sweep of illegal aliens,” Wakabayashi tells Nikkan Gendai. “But just making it obligatory for companies to report on their foreign staff doesn’t mean they’re going to obey the law blindly. The move could, in fact, drive these places underground and quite possibly lead to an increase in crime.” (By Ryann Connell)

Dear Debito,

On return from a business trip this evening Oct 17 I began to distribute a protest letter to Kansai International Airport (KIX) Immigration staff re the amended Immigration Law.

The official who had started to process my re entry documentation refused to accept the letter, which resulted in my having a lengthy conversation with, to be fair, a sympathetic KIX Immigration official who was prepared to listen to my complaints, and to respond –

1) Immigration have no way to accept my demands to pre register my biometric data before Nov 20, as there will be no Automated Gate established at KIX by that date.

2) My statements that there was no plan to establish the Automated Gate at any other International Airport in Japan were denied – yes, eventually Automated Gates would be established at all other Airports – but as to when ref KIX, no idea now! ( Impression – not during 2008!)

3) My letter would be given to more senior officials, and the more resident foreigners complained about the situation the more likely it was to speed up the Automated Gate establishment process.

4) Meanwhile my situation was understood – a 2 minute immigration queue up to now going to a 2 hour one, each time, from Nov 20, 2 or 3 times per month – but KIX Immigration could do nothing except follow the law!

So the message is clear, all resident foreigners – at least those of us living outside of the immediate Tokyo area – must complain repeatedly in writing , to MOJ and Immigration officials at the Airports they regularly use!!

TOKYO — In the Turkish village of his birth, Deniz Dogan endured years of discrimination and harassment by police who jailed him twice for his political activities on behalf of the Alevi religious minority. So he decided to escape to a country that seemed peaceful and tolerant: Japan.

Seven years later, he says he has found less freedom in Japan than in the country he fled. For a time, he had to work illegally to put food on his table. Police stop him to check his documents almost every day. He has suffered deportation threats, interrogations and almost 20 months in detention. In despair, he even considered suicide.

His brother and his family, who fought even longer for the right to live in Japan, finally gave up and applied for refugee status in Canada, where they were quickly accepted.

“We had an image of Japan as a very peaceful and democratic country,” Mr. Dogan said.

“It was very shocking to realize that we had less freedom in Japan than in Turkey. We did nothing wrong, except to try to get into this country, yet we were treated as criminals. We felt like insects.”

Despite its wealth and democracy, Japan has one of the world’s most intolerant regimes for refugees and immigrants. And despite its labour shortages and declining population, the government still shows little interest in allowing more foreigners in.

From 1982 to 2004, Japan accepted only 313 refugees, less than 10 per cent of those who applied. Even after its rules were slightly liberalized in 2004, it allowed only 46 refugees in the following year. Last year it accepted only 34 of the 954 applicants.

Those numbers are tiny in comparison with Canada, which accepted more than 42,000 refugees last year, despite having a much smaller population than Japan.

But they are also tiny in comparison to European countries such as France and Italy. On a per capita basis, Japan’s rate of accepting refugees is 139th in the world, according to the United Nations.

Japan’s attitude toward immigrants is equally unwelcoming. It has one of the industrialized world’s lowest rates of accepting immigrants. Only about 1 per cent of its population is foreign-born, compared with 19 per cent in Canada and 9 per cent in Britain.

Yet paradoxically, Japan is in greater need of immigrants than most other nations. Because of a sharp drop in its birth rate, its population is on the verge of a decline unprecedented for any nation in peacetime. The latest projections have the number of its citizens – 127 million – plunging to just 95 million by 2050.

At the same time, the population is rapidly aging. By mid-century, about 40 per cent will be over 65, leaving a relatively small labour force to support the country.

Demographic decline has emerged as one of Japan’s most hotly debated and angst-ridden issues. Yet the obvious solution – allowing in a substantial number of immigrants – is rarely considered. The tight restrictions on foreigners have remained in place. Robots, rather than immigrants, are seen as the potential solution to labour shortages. One government panel has recommended that foreigners should never comprise more than 3 per cent of the population.

Much of Japan’s hostility to immigrants and refugees is the result of prejudice against foreigners, who are widely blamed for most of the crime in the country. Ignorance is widespread. In one survey, more than 90 per cent of Japanese said they don’t have any regular contact with foreigners, and more than 40 per cent said they rarely even see any.

Politicians are reluctant to allow any challenge to Japan’s racial homogeneity. Their beliefs are typified by a top leader of the ruling party, former foreign minister Taro Aso, who described Japan as “one culture, one race.” The government has refused to pass laws against racial discrimination, making Japan one of the few industrialized countries where it is legal.

“We do not often see Japanese people praising the work of foreign residents and warmly welcoming them as friends and colleagues,” wrote Sakanaka Hidenori, former director of the Tokyo Immigration Bureau who retired after 35 years in Japan’s immigration system and now heads the Japan Immigration Policy Institute.

“The native Japanese have lived as a single ethnic group for nearly 1,000 years and it will be a difficult task for them to build friendly relationships with other ethnic groups,” he wrote in a recent book, Immigration Battle Diary.

These attitudes have shaped a system of tight restrictions against foreigners who try to enter Japan. One of the latest laws, for example, requires all foreigners to be fingerprinted when they enter the country. Japan’s rules on refugee claims are so demanding that it can take more than 10 years for a refugee to win a case, and even then the government sometimes refuses to obey the court rulings. Hundreds of applicants give up in frustration after years of fruitless effort.

Japan demands “an unusually high standard of proof” from asylum seekers, according to the most recent United Nations report. They are asked to give documentary evidence of their claims, including arrest warrants in their home country, which can be impossible to provide. They are often required to translate those documents into Japanese, which is costly and complicated. Then the documents are often rejected as invalid.

“It has been a very legalistic approach, showing no humanitarian sense to those who had to flee,” said Sadako Ogata, the former UN high commissioner for refugees, in a recent Japanese newspaper interview.

“From the perspective of Japanese officials, the fewer that come the better.”

While they struggle to prove their cases, asylum seekers are often interrogated by police and confined to detention centres, which are prisons in all but name. When not in detention, asylum seekers cannot legally work and are required to live on meagre allowances, barely enough for subsistence.

In one notorious case in 2005, Japan deported two Kurdish men after the UN refugee agency had recognized them as refugees. The UN agency protested the deportations, calling them a violation of Japan’s international obligations.

“We really hesitate to tell asylum seekers to apply to Japan,” said Eri Ishikawa, acting secretary-general of the Japan Association for Refugees.

“Work permits are not given to them, but they have to work to survive, so they work illegally.”

In one of the most bizarre twists in its refugee policy, Japan sometimes sends its officials on fact-finding missions in the home countries of the asylum seekers, accompanied by local police and army troops, even when the police and soldiers are the ones accused of the persecution.

“This is really shocking to us,” Ms. Ishikawa said. “It puts their families in danger.”

In the case of Deniz Dogan and his brother, for example, Japanese officials went to their family’s home in Turkey, accompanied by local police. The families felt frightened and intimidated. Then the family were repeatedly called to the police station for questioning after the visit. “It was an indignity and a violation of our human rights,” he said.

Mr. Dogan’s lawyer, Takeshi Ohashi, says the long process of applying for refugee status is like a “mental torment” for asylum seekers.

“The government is very negative about accepting refugees,” he said. “It’s worried that there will be social unrest and crime if it allows too many foreigners into Japan.”

Mr. Ohashi, a refugee specialist for the past 11 years, says the process is heavily influenced by Japan’s diplomatic objectives. Because it is seeking good relations with countries such as China and Turkey, for example, it almost never accepts any refugees from those countries, he said.

Hundreds of Kurdish people from Turkey have applied for refugee status in Japan in recent years, but not a single one has been accepted.

Consider the case of Kilil, a 35-year-old Kurdish activist, who fled from Turkey fearing for his life after he was repeatedly detained by police and soldiers in his hometown because of his political activism.

He arrived in Japan in 1997, stayed illegally for two years, and then applied for refugee status. His application was twice rejected and his third appeal is now before the courts. In the meantime, he was put into custody for eight months at a detention centre. To support himself, he now works illegally as a labourer, demolishing buildings and removing asbestos. It is dirty, dangerous work – and asylum seekers are among the few who are willing to do it.

He lives in constant fear of being arrested for working illegally. “It’s very stressful,” he said. “The worst is the uncertainty. It’s been 10 tough years here, without any result. I can’t even afford to go to a hospital if I get sick. Every day is like being in prison.”

In many ways, he regrets his decision to flee to Japan. “But I want to keep fighting to change the system here. I want to fight to the end.”

Deniz Dogan and his brother, who endured the same kind of conditions, became so frustrated by 2004 that they held a sit-in for 72 days at the Tokyo office of the UN refugee agency. When it failed to influence authorities, his brother made the decision to emigrate to Canada.

This summer, Deniz was finally given a one-year visa to live and work in Japan, but only because he had married a Japanese woman.

“My visa could be cancelled at any time,” he said. “I feel a lot of unease. But for the other refugees, it is even worse. We all have the same goal: freedom.”

FIGHTING TO STAY

Win Soe, a political activist from Myanmar, knows from painful experience how difficult it can be to survive in Japan’s refugee system.

As one who took part in protests against Myanmar’s military junta before fleeing the country, he knows he would face persecution if he returned to his homeland. He has been seeking refugee status in Japan for four years, but the government has twice rejected his application.

Most asylum seekers end up working illegally to survive. But because he wants to abide by the rules, Win Soe is trying to live on the official monthly allowance, which amounts to $760.

Most of it is needed for rent, electricity, utilities and transportation costs, leaving him about $90 a month for food, barely enough for survival in this expensive country.

He can’t afford new clothes, shoes, or medicine for his hay fever. He eats only two meals a day and often goes hungry.

“Sometimes I can’t even afford rice,” he said. “I eat mostly bread, potatoes and bananas. I’m trying to abide by the law very carefully.”

He believes the meagre allowance is part of the government’s attempt to put pressure on refugees to give up their claims. “They want me to surrender. But I will never give up.”

Decent rosy article, with some ideas on how the government tackled certain problems. Wish the reporter had also mentioned the Hamamatsu Sengen, and how the Hamamatsu city government has been spearheading efforts to make things more equitable throughout Japan for NJ. In Traditionally Insular Japan, A Rare Experiment in Diversity
School Fills a Gap for Immigrants Returning to Ancestral Homeland

HAMAMATSU, Japan — Five years ago, in this coastal city southwest of Tokyo, Mari Matsumoto sank her life savings into building a school for the children and grandchildren of immigrants coming to Japan. But at Mundo de AlegrXXa (World of Happiness), the students aren’t what one might expect: Children with Japanese faces and names like Haruo and Tomiko dart around the two-story building chattering in Spanish and Portuguese.

The school is the result of an unusual social experiment. Faced with labor shortages, the Japanese government opened the doors in 1990 to allow immigrants to come to the country — so long as they were of Japanese descent. Government officials thought they would blend into the country’s notoriously insular society more easily than people from other ethnic backgrounds.

But many found they didn’t quite fit. Their names and faces were Japanese, but they didn’t speak the language. They didn’t understand local customs, such as the country’s stringent system for sorting garbage into multicolored containers. In cities such as Hamamatsu, where many settled, government officials and Japanese neighbors didn’t know what to make of newcomers who seemed familiar but foreign at the same time.

Despite the frictions here and in other communities, pressure is building in Japan to take in more immigrants, forcing the country to reconsider its traditional bias against outsiders. Its population is aging and shrinking. Analysts say Japan must find new sources of labor if it is to preserve its economic power and support its retirees.

Hamamatsu was a natural magnet for the newcomers because its many factories offered entry-level employment and required virtually no language skills. Officials here like to brag that their community became the most “international” of Japan’s cities. About 30,000 of its residents, or 4 percent, are foreign-born. That’s almost twice the proportion of foreign-born residents in Japan as a whole. (About 13 percent of the U.S. population is foreign-born.) Most newcomers are from Brazil and Peru. They are offspring of Japanese who immigrated to South America in the early 1900s to work in coffee fields and take other jobs.

The new arrivals here brought Latin culture with them. In Hamamatsu’s downtown, billboards in Portuguese advertise cellphones and air conditioners. In a popular market, Brazilians who long for a taste of home can buy a platter of bolinho de queijo — cheese croquettes — fresh from the fryer or rent DVDs of popular Brazilian shows.

Other parts of the city have Brazilian and Peruvian churches. One enterprising woman has built a small catering business making box lunches for homesick Peruvians.

But even as officials here tout their international credentials, they struggle to manage the diversity. That’s where Matsumoto, her life savings and the school come in.

For years, Matsumoto, a Japanese who learned Spanish and Portuguese in college, worked for Suzuki Motor, where she trained foreign workers from South America.

She soon grew alarmed by the number of immigrant children who were dropping out of Japanese public schools. Because many didn’t understand Japanese, they were falling behind in their studies. Others were bullied because they didn’t look Japanese (some of them are biracial, having Latin parents). Even though some schools hired aides to help the children, many were left to flounder, she said.

The parents urged Matsumoto to open a school for their children. Unable to get funding from government or school officials, she sank her savings into the enterprise. She began recruiting teachers willing to work for very little pay.

One recent day, as she watched her spirited charges dash around the makeshift classrooms in an office building on the city’s south side, Matsumoto said she wouldn’t have had to do this if the government had made an adequate effort to accommodate immigrant children. “That’s the root of the problem,” she said.

Problems in schools were just one sign the newcomers weren’t going to simply “blend in.” Those who lacked health insurance began turning up in local emergency rooms when they got sick. Since many depended on employers for housing, they ended up homeless if they lost their jobs.

Hidehiro Imanaka, director of Hamamatsu’s International Affairs Division, shook his head recalling angry citizens who would call city hall to tattle on foreign-born neighbors who didn’t sort the garbage properly or parked in the wrong places.

Some newcomers threw all-day barbecues with large crowds and loud music — just as they had back home. Their Japanese neighbors were horrified. At one point, tensions were so high that some merchants banned certain groups from their stores, until a lawsuit prompted them to stop.

But many immigrants say the struggle is worth it.

Roberto Yamashiro, who came to Japan from Peru when he was 15, said the adjustment was difficult. He didn’t know the language and didn’t like the food. He worked in a factory that made ice chests for several years. Now 24, he is one of a handful of immigrant students at Hamamatsu University. “I like it here a lot,” he said. “There is much more opportunity if you work hard.”

Officials in Hamamatsu say they never expected the outsiders to live in Japan for more than a few years. But now they realize they’re here to stay and must be helped along.

At city hall, officials have moved the foreign registration desk to a prominent spot on the first floor. Signs and forms are printed in Portuguese, Spanish, Japanese and English. The International Affairs Division, which used to focus on foreign exchange programs, now concentrates on the needs of the immigrant community. In an attempt to quell disputes over garbage, instructions on how to sort it are now available in four languages.

But the broader question of Japan’s traditional reluctance to accept outsiders remains.

Eunice Ishikawa, who was born in Brazil, teaches cultural policy and management in the Department of International Culture at Shizuoka University of Art and Culture in Hamamatsu. She said that when people learn where she was born, they can’t believe she’s a college professor.

For many of the immigrants from South America, “it’s almost impossible to assimilate because people have such negative images” of outsiders, she said. Sometimes her husband, a Japanese American who was born in San Diego, complains that people look down on him because they see him as an American.

Ishikawa said the Japanese may have no choice but to learn to live with outsiders, because their numbers are growing, not only in Hamamatsu, but in the country as a whole.

In 1990, about 1 million registered foreign residents lived in Japan; by 2004, that figure had nearly doubled, to just below 2 million. Most say the actual numbers are probably higher because not all foreigners register.

The pressure to let in more immigrants is building. Population experts project that by 2050, Japan’s population, about 128 million in 2005, will shrink to 95 million, about 40 percent of whom will be 65 or older. By some estimates, Japan will lose more than 4 million workers.

“With the age of globalization, these borders are going to open up,” said Fariborz Ghadar, director of the Center for Global Business Studies at Pennsylvania State University. “Unless they don’t want to see their economy grow as rapidly, they’re going to have to do something about it.”

Recently, the country struck an agreement with the Philippines to bring in qualified nurses and certified care workers. “In the near future, Japan must make a decision to receive immigrants into this country,” said Kazuaki Tezuka, professor of labor and social law at the University of Chiba, who has studied immigration policy around the world.

Joao Toshiei Masuko, a Brazilian immigrant of Japanese ancestry who opened the first Brazilian Japanese restaurant in Hamamatsu and then expanded his business to include a bakery and supermarket, predicted that immigrants will be accepted.

As he strolled through the aisle of his shiny new supermarket next to the downtown branch of Japan’s Entetsu department store, he noted that his customers are both Japanese and non-Japanese. Pointing to aisles that stock U.S., Peruvian and Brazilian products, he said his market — decorated in green and yellow, the colors on the Brazilian flag — has an “international flair” that he’s certain will translate in his adopted country.

“I opened my market to sell to Brazilians,” he said. “But now everyone comes.”
