「人種差別」の日本、悲しい

外国出身者の入浴を拒否していて温泉施設と小樽市を相手取り、慰謝料などを求めて提訴した原告3人は1日、札幌市内で記者会見して、それぞれの思いを述べた。原告の1人、札幌市在住で米国籍のコンピュータープログラマー、ケネスリー・サザーランドさん(37)が訴えたメッセージの要旨は次の通り。

日本に住んで12年になります。ずっと札幌です。外国人に見えるけど、中身は日本人だと友達がよく言うってくれます。日本が大好きです。日本の人々も、和食も、温泉ももちろん大好きです。できれば、ずっと日本に住みたいと思っています。が、こういう「人種差別」があると、日本という国にしつぼう失望してしまいます。

英語で「You can't choose your neighbors」、「お隣さんを選べない」ということわざがあります。「日本人、ロシア人、中国人、韓国人、フィリピン人、世界の人々と仲良くしましょう!」 子供も、みな、知っていることです。

南アフリカでは「アパルトヘイトApartheid」、アメリカでは「Jim Crow」という「Whites Only」の暗いれきし歴史がありました。まさか、21世紀の日本で、「Japanese Only」というかんばん看板を見るなんて、と てもしん信じられなくてかな悲しいことです。

逆に日本人がもし、アメリカのプールやレストランに行ってじゅうぎょういん従業員に、「最近、日本人が多すぎて、アメリカ人の客が減って売り上げが落ちています。だから、日本人がおことわ断りします。」と言われたら、どんな気持ちになりますか。

提訴(ていそ)は、本当につらい道ですが、やむをえず、この道を取るしかないのかと思います。

私たちもマナーを守るようにがんばりますので、拒否(きょひ)をしないでください。

Here is my the English translation of the message I read to the press after submitting our law suit on February 1. This was published in Asahi Shinbun (one of the largest national newspapers in Japan) the next day.

Saddened by "Racial Discrimination" in Japan

Foreign-appearing people refused entry to a public baths are targeting an Onsen facility and the City of Otaru, demanding compensation. 3 plaintiffs sued on February 1. At a press conference in Sapporo, they expressed their various views. One plaintiff, an American Computer Programmer residing in Sapporo, Kenneth Lee Sutherland (37) delivered the following message (in gist).

Note: This is my message as I delivered it at the press conference, not the slightly edited form that was published in Asahi Shinbun.

I have lived in Japan for 12 years. All in Sapporo. I may appear to be a foreigner, but my friends often kid me that inside I am Japanese. I love Japan. I love Japanese people, Japanese food, and of course I love Japanese Onsen. If possible, I would like to remain in Japan forever. However, when I see such "Racial Discrimination", I feel completely despaired with Japan.

In English we say "You can't choose your neighbors". People of Japan, people Russia, people of China, people of Korea, people of the Philippines, all the people of the world, we should get along! Children, everybody, knows this.
 
In South Africa "Apartheid", in America "Jim Crow". This history of "Whites Only" exists. I was therefore shocked and saddened to see, in 21 Century Japan, "Japanese Only" signs posted,

How would you (and Japanese people in general) feel, on the other hand, if while visiting America, you tried to swim in a pool or enter a restaurant and a worker came up to you and said, "Oh, I'm very sorry, but lately we have been flooded by Japanese tourists, and our steady American customers have been staying away, causing a drop in revenues. We must therefor ask you to leave."?

Suing may be a drastic approach, but there is no turning back now. We have no choice but to follow this path.

We will do our best to mind our manners, so please do not refuse us outright.

私は温泉湯の花と小樽市に相手を取って提訴します。これを気軽に決心したことではありません。1年以上、1999年9月より湯の花を改善を懇願しても、小樽市、市長、市議会、道知事、道議会、日弁連、法務省人権擁護部各支部、市内国際交流関連団体連絡会議、商科大と道新主催の討論会(湯の花のみ欠席)を経て市民宛、国会、陳情提出を経て、総選挙におけた各政党に調査を経て、姉妹都市、各領事館にもアピールしても、解決がありませんでした。湯の花のみ(小樽市にて他の外国人排斥温泉オスパとパノラマでは譲歩があったものの)の場合で進展がありませんでした。しかも、小樽市は責任があります。日本が1996年に発行した国連の人種差別撤廃条約の通りに「すべての適当な方法により遅滞なくとること」第2条等)自分の責務を果たしてるとは感じられません。よって、司法的にこれがいけないと声明していただく方がいいと思ってきました。

それに、湯の花は「JAPANESE ONLY」という看板をたったものの、日本人に見えない日本人(私)を排斥し、日本人に見える外国人(私達の中国人の友達)を排斥しなかったが事実です。要は、来訪者の個人行動で線引きし若しくは国籍で線引きせず、明らかに外見及び人種で線引きして排斥しているのです。こんな乱用しやすい営業ポリシー及び解決姿勢を充分に示さない行政を 、 放っておいてはいけないと思います。ですから、私は提訴します。

STATEMENT
(Delivered Feb 1, 2001)

I am suing both Onsen Yunohana and the City of Otaru. I do not take this decision lightly. For over a year, since September 1999, we have appealed to the City of Otaru, the Otaru Mayor, the Otaru City Assembly, the Hokkaido Governor, the Hokkaido Prefectural Assembly, the Japan Federation of Bar Associations (Nichibenren), The Ministry of Justice's Division of Human Rights, to Otaru Citizens through local international organizations and fora sponsored by both the Hokkaido Shinbun and the Otaru University of Commerce (which Defendant Yunohana refused to attend), all the political parties through a survey given last general election, Otaru's Sister Cities, and each concerned embassy or consulate, all to no avail. Despite improvements from other exclusionary bathhouses within Otaru (Osupa and Panorama), there was absolutely no developments with Defendant Yunohana. Moreover, the City of Otaru has responsibility in this case. Japan as a nation effected the Convention on the Elimination of Racial Discrimination in 1996. According to Article Two, "States Parties... undertake to pursue by all appropriate means and without delay a policy of eliminating racial discrimination in all its forms". In my view, Otaru has not undertaken sufficient responsibility, which is why we have taken this to court--to get a clear legal decision on this matter.

Defendant Yunohana has since removed its "Japanese Only" sign, but the fact remains that a Japanese who does not look like a Japanese (I) was excluded, while non-Japanese who do look Japanese (our Chinese friends) were not excluded. The point is that they are not drawing lines between people based upon their individual behavior or nationality, but rather excluding clearly by physical appearance and race. One cannot allow such an abusable policy let stand, nor can one stand by while insufficient action to resolve this situation is taken. This is why we have brought about this lawsuit.
