Japan Times JUST BE CAUSE column May 5, 2009 on Alberto Fujimori

Japan Times: Sociopaths like Fujimori are by definition incurious about how they affect others, especially when granted power in young, weak constitutional democracies. At least Peru and Chile had the sense (and the chance) to lock him up and re-establish the rule of law.

No thanks to Japan, of course, from whom the world expects more maturity. Rumor has it the International Olympic Committee has been nudged by rival candidate cities about Ishihara and Fujimori. If this knocks Tokyo out of contention for the 2016 Olympics, more hurrahs for poetic justice.

In sum, Fujimori is a classic case of how power corrupts. A former math teacher comes to power, comes to believe that he can do anything, then comes to a dazzlingly rich society run by elites who shelter him and further encourage his excesses.

A pundit friend said it well: “Fujimori is an accident of birth. If he had been born in North America, he’d have been a dentist, not a dictator.”

At least this time, this kind of “accident” has not gone unpunished.

I know I know, I’ve commented on Fujimori ad nauseam in the past. However, with this sentencing to essentially life imprisonment (he’s 70 years old) by a Peruvian court, this column brings a sense of closure to his case, discussing the final good precedent of holding an outlaw president accountable for his international excesses. Alberto Fujimori really gets his–6 years’ prison; and that’s not all

Several news articles on former Peruvian dictator Alberto Fujimori, who took refuge in Japan as a “citizen” for five years before buggering off to Chile, on his eventual sentencing to 6 years’ prison on some charges (more charges to come)–with a little something on what this means for the world’s dictators on the lam. A good precedent.

Asahi on wanted criminal suspect Alberto Fujimori Diet candicacy: “[W]e are surprised at the news that a former president of a foreign country will run for the Upper House election. Former Peruvian President Alberto Fujimori, 68, decided to run as a proportional representation candidate of Kokumin Shinto (People’s New Party) for the July 29 election… But we definitely do not think [they have given] a good enough reason for anointing him as the party’s Upper House candidate….” Cyberspace commentary on what his case means for dual nationality in Japan also blogged.

Japan Times: “Fukuoka court rules ban on dual nationality is constitutional”. Debito.org makes the case for why banning dual nationality is unrealistic, not to mention just plain stupid, with an excerpt from my book “Embedded Racism”.

JT: The Fukuoka District Court ruled Wednesday that Japan’s law that bans dual nationality is constitutional, rejecting an argument by a Japan-born plaintiff who lost her Japanese citizenship after she naturalized as an American. Yuri Kondo, 76, had argued that the nationality law — which stipulates that Japanese nationals will lose their citizenship if they become a citizen of a foreign country — undermines fundamental human rights to pursue happiness, self-determination, and identity, as guaranteed under the Constitution. While the nationality law was deemed constitutional, presiding Judge Fumitaka Hayashi said the wish of the individual who would lose their nationality should be considered as it is part of a person’s identity.

COMMENT: Most arguments made by the Japanese Government dovetail around the idea that people will be somehow confused in terms of national allegiances if they have more than one nationality. For what if Japan went to war with the country you have a second passport for? Where would your allegiances lie?

Making public policy merely on the basis of hypotheticals is not the best way to make laws. As noted above in the article, the number of countries allowing dual nationality is in fact increasing (“the number of countries allowing dual nationality has increased from one-third to three-quarters worldwide”), as more people around the world travel, resettle, immigrate, marry, and have multinational children as well as lives.  Forcing them to give up their other nationality is to force them to give up part of their identity — a completely unnecessary and moreover psychologically damaging move just for the sake of bureaucratic convenience.  And that’s before we get into issues of arbitrary enforceability, as discussed in my book excerpt below.

The increase in diversity should be reflected in laws to accommodate reality.  Instead, we have pig-headed J politicians who can’t imagine a life beyond their own experiences (with the exception of the LDP’s Kouno Taro, who actually argued for dual nationality, albeit to coat the Kokutai in more glory, not for the sake of the individual’s identity) and refuse to legislate reality into reality.  And that feeds into a hidebound judiciary that claim they can only enforce the law as it’s written (even presiding Judge Hayashi above expressed regret at that).

To finish up, let me excerpt from my book “Embedded Racism” on this topic.  It’ll make the case about why public policy is as stupid as it is as best I can…

Kyodo: Japan-born American files suit against Japan’s dual nationality ban

Kyodo: A Japanese-born American said Thursday she has filed a lawsuit with a Japanese court claiming that the country’s nationality law, which bans its citizens from also holding a foreign nationality, violates the Constitution.

Yuri Kondo, 75, who currently lives in Fukuoka in southwestern Japan and filed the lawsuit at the Fukuoka District Court, said at a press conference with her legal team that acquiring U.S. citizenship should not have automatically stripped her of her Japanese one. Kondo, who was born in Kamakura, Kanagawa Prefecture, moved to the United States in 1971 to attend graduate school and began practicing law in Arizona in 1997.

After becoming a U.S. citizen in 2004, she attempted to renew her Japanese passport in 2017 but her application was rejected. She is currently in Japan on her U.S. passport. Kondo claims that Article 11 of the nationality law, which stipulates that Japanese citizens automatically lose their nationality upon gaining a foreign nationality, violates the right to pursue happiness and equality as guaranteed by the Constitution.

COMMENT: Let’s go through just how arbitrary, complicated, and racialized Japan’s Nationality Law is…

Kyodo: Tokyo District Court rules in favor of Japan’s ban on dual nationality. My, what paranoia and hypocrisy

In a landmark ruling yesterday (see articles below) first testing the waters for allowing Japanese to have more diverse roots in a legal sense, the Tokyo District Court has just ruled that Japanese who obtain other citizenships do not have constitutional protections from being subsequently deprived of Japanese citizenship. This means:

a) If you as a Japanese citizen naturalize in another country, then when the Japanese government decides to take away your Japanese citizenship, you have no legal recourse under the Japanese Constitution.  It can be unilaterally revoked at the government’s discretion.

b) If you as a native-born Japanese citizen have dual nationality due to having international parents, and if you do not declare to the Japanese government that you are a Japanese citizen only (and have renounced all other citizenships by age 22 — as Osaka Naomi, referred to below, reportedly did), then the Japanese government can revoke your Japanese citizenship and not deprive you of any Constitutionally-guaranteed rights.

Conclusion:  Essentially, nothing has changed in practice.  The lower judiciary has essentially just made its stance against dual nationality clear.  Take into account that this ruling, handed down by a notoriously conservative branch of Japan’s judiciary (yes, Tokyo District and High Courts are actually well-known around the Japanese legal community for their very conservative judgments), has merely affirmed what was already true: “two passports = untrustworthy”.  And their legal reasoning mentioned in the articles below reflects that logic, based upon paranoid pre-war arguments about individual mixed allegiances threatening the motherland, etc., with no need to update for the complexities of the modern world.  Should the plaintiffs decide to appeal this case, then the Tokyo High Court and probably eventually the Supreme Court will affirm the lower court’s ruling.  So it’s definitive.

What to do about it:  Continue to follow Debito.org’s advice:  If you have two passports, you always claim to be solely Japanese by age 22 but secretly keep renewing your foreign passport.  The Japanese government is still not fully enforcing any draconian “show us a revoked foreign passport by age 22 or we will revoke your Japanese citizenship” towards all its citizens with international roots.  Given Japan’s dropping population, that’s probably not in its interest.  But if the Japanese government ever gets around to doing that, based upon yesterday’s ruling, as far as the Japanese judiciary is concerned it will have free rein.

Kyodo: Princess Mako paid a visit to Peruvian President Martin Vizcarra on Thursday in Lima during her trip to mark the 120th anniversary of the start of Japanese immigration to the South American country. “I feel Japanese Peruvians are treated very well in Peru. I’m grateful that Peru accepted Japanese immigrants,” the 27-year-old princess, the eldest daughter of Crown Prince Akishino, said during the meeting at the president’s office.

Vizcarra said he is glad that Japanese Peruvians are actively involved in various fields. The president also showed his gratitude to Japan’s contribution to Peru in the areas of technological and economic cooperation and archaeology. [Princess Mako] later met at a hotel in Lima with representatives of Japanese people living in Peru and Japanese volunteers dispatched by the Japan International Cooperation Agency, thanking them for their efforts in the country. On Wednesday, she attended a ceremony marking the immigration anniversary and met with Peruvians of Japanese descent. She is scheduled to travel to Bolivia on Monday to mark the 120th anniversary of the start of Japanese immigration to that country.

BBC in 2002: More than 200,000 people in rural Peru were pressured into being sterilised by the government of former President Alberto Fujimori, an official report has revealed. The Health Minister, Fernando Carbone, said the government gave misleading information, offered food incentives and threatened to fine men and women if they had more children.

Poor indigenous people in rural areas were the main targets of the compulsive family planning programme until 2000, when Mr Fujimori left for Japan amid mounting corruption allegations against him. Mr Carbone said there was evidence that Mr Fujimori and a number of high-ranking ministers could be held responsible for “incorrect procedures” and “human rights violations”.

COMMENT FROM DEBITO:  Now, before anyone writes in and says, “Don’t be racist.  Alberto Fujimori didn’t do this BECAUSE he is Japanese.  He just happened to be of Japanese descent. (And self-claimed citizenship.)  While doing monstrous things.

However, remember that Fujimori WAS being funded by the right-wing Nippon Foundation (founded by war criminal Sasakawa Ryouichi), especially when it was being headed by self-proclaimed South African Apartheid supporter (and apparently personal friend of Fujimori’s) Sono Ayako.  

Meaning Fujimori, with the help of Japanese eugenicists, was cleansing Peru’s countryside of Peruvian indigenous peoples without proper medical procedure or oversight.

We’ve covered Sono Ayako’s ideological hijinks and Alberto Fujimori’s international criminal activity (which is why he is in prison now) on Debito.org before.  What’s missing from this celebration of Japanese history in South America, as JDG notes, is Japan’s hand in overseas modern human rights atrocities.

JT: “It’s no coincidence that [opposition party leader Murata] Renho’s detractors are the same people who are against allowing a female emperor. “Pure blood” ideology is at the root of Yawata’s philosophy — the “scoop” about Renho’s dual nationality was merely a delivery device. The law means nothing to them because their faith is invested in an occult mythos about the unbroken Imperial line. [Journalist] Kosugi Misuzu insists these beliefs amount to “racism,” since they limit the rights of some people born and raised in Japan due to genetics. Asahi reported on July 6, 2014 — well before the Renho controversy — that the pure blood faction wants to kick out permanent Korean residents as well as anyone with dual citizenship by making all Japanese sign a loyalty oath. They are not just rightists, said the paper, they are “anachronisms.”

“[Former bureaucrat] Yawata Kazuro says Renho can’t be trusted because she doesn’t use her Japanese married name and gave her children names that “sound Chinese.” These value judgments should mean nothing in a democracy. Zakzak, another Sankei organ, adds to the din by saying that Japanese people do not like the idea of someone with dual citizenship “rising to the top.” What about best-selling Japanese-American singer Hikaru Utada and all those bicultural athletes at the Rio Olympics? For that matter, what about former Peruvian president Alberto Fujimori, who was allowed to settle here and escape prosecution in his native country by asserting his Japanese nationality?”

COMMENT: All of these issues, particularly the “pure blood” conceit, have been brought up passim in book “Embedded Racism: Visible Minorities and Racial Discrimination in Japan”. Renho herself features prominently in the book (Chapter Seven), given that Japan’s racist politicians have questioned her loyalty many times before — for example when she was a Cabinet member in the previous DPJ government — simply because she’s to them a mudblood. And they can get away with it because the “pure blood” narrative is so strong.

DEBITO.ORG READER AM: Debito, I saw an internet banner ad on the asahi.com website that along with a cartoon figure, posed the question “gaikokujin no jinken mamotteru?” [Are you protecting the human rights of NJ?] I thought I must have been seeing things, but clicking through I landed on a Japan Ministry of Justice page offering advice on how to protect the rights of non-Japanese.

It seems that this is a campaign is part of Japan’s push to ready the country for the 2020 Olympics, addressing issues such as ryokan denying service to non Japanese. Definitely a nice change from the focus on hooliganism leading up to the World Cup in 2002.

DEBITO: I would agree. It’s much better to see Non-Japanese as people with rights than as rapacious and devious criminals who deserve no rights because, according to the Ministry of Justice’s own surveys, NJ aren’t as equally human as Japanese. And this is not the first antidiscrimination campaign by the Japanese Government, in the guise of the mostly-potemkin Bureau of Human Rights (jinken yougobu, or BOHR) nominally assigned to protect human rights in Japan (which, as Debito.org has pointed out before, have put out some pretty biased and insensitive campaigns specifically regarding NJ residents in Japan). And did I mention the Japanese Government in general has a habit of portraying important international issues in very biased ways if there’s ever a chance of NJ anywhere getting equal treatment or having any alleged power over Japanese people? It’s rarely a level playing field or a fair fight in Japan’s debate arenas or awareness campaigns.

So now that it’s 2014, and another influential Olympics looms, how does the BOHR do this time? (And I bother with this periodic evaluation because the Japanese Government DOES watch what we do here at Debito.org, and makes modifications after sufficient embarrassments…) I’ll take screen captures of the whole site, since they have a habit of disappearing after appearing here. Here’s the top page:

CONCLUSION: Again, much talk about NJ and their lives here with minimized involvement of the NJ themselves. As my friend noted, it’s better this than having NJ openly denigrated or treated as a social threat. However, having them being treated as visitors, or as animals that need pacifying through Wajin interlocutors, is not exactly what I’d call terribly progressive steps, or even good social science. But that’s what the BOHR, as I mentioned above, keeps doing year after year, and it keeps their line items funded and their underwhelming claims of progressive action to the United Nations window-dressed.

My Japan Times JUST BE CAUSE Column 57, November 6, 2012: “If bully Ishihara wants one last stand, bring it on”

JT JBC: On Oct. 25, Tokyo Gov. Shintaro Ishihara announced his resignation from office. He now plans to stand for election to the Diet as head of a new conservative party. He suggested political alliances with other conservative reactionaries and xenophobes, including Osaka Mayor Toru Hashimoto and Tachiagare Nippon (Sunrise Party of Japan) chief Takeo Hiranuma (Just Be Cause, Feb. 2, 2010). And all before a Lower House election that must be held within two months.

I say: Bring it on. Because it’s time for somebody to make clear which way Japan is heading.

The world’s media has largely misunderstood — or misrepresented — what kind of an elected official Ishihara is, often portraying him as a “nationalist” (which sounds like a patriot). He is in fact a hate-mongering racist bigot.

This is the man, remember, who began his governorship by calling for foreigners to be rounded up on sight in the event of a natural disaster — for they might (unprecedentedly) riot! Cue one natural disaster in 2011: No riots. Yet no retraction. Thus he got a free pass.

This is also a man who goes beyond the standard right-wing denials of the dark side of Japanese history, such as the Nanjing Massacre and the “comfort women.” He has called the 2011 tsunami “divine retribution” for Japan’s sins, insinuated that Africans in Japan are unintelligent, said commentators on Japan “don’t matter” if they’re foreign, likened foreign judo practitioners to “beasts,” claimed Chinese are criminals due to their “ethnic DNA,” called parts of Tokyo with higher foreign populations “hotbeds of crime” too scary for even Japanese crooks to enter, and stigmatized Japanese politicians who support more rights for foreigners by saying they must have foreign roots themselves (as if Japanese with tainted bloodlines are somehow unpatriotic).

He has also stated that old women are “useless” and “toxic” to civilization, gays “gadding about” are “pitiable,” French is unqualified as an international language because of its counting system — and so on ad nauseam, painting grotesque caricatures of foreigners and minorities in broad, bigoted strokes. Just listing them all would take up my entire column.

Yet, instead of pillorying this piece of work out of office, the media has generally dismissed his statements as “gaffes.” But a gaffe is technically an error or an unintended misstatement — and Ishihara’s are too frequent to be anything but deliberate.

Sadly, due to the limited attention span inherent in media cycles, Ishihara managed to out-stare the press. They then excused their own lack of tenacity by treating his outrageous comments like a personality quirk, as if he suffers from a particularly offensive form of Tourette’s — effectively handing him a free pass. Passes got freer after one re-election. Then another…

Ishihara resigns Tokyo Governorship, seeks Diet seat as new party head. I say bring it on.

Something very important happened a few days ago when Tokyo Governor Ishihara Shintaro made a surprise announcement that he would resign his governorship, launch a new political party, and run for a Diet seat in the next Lower House election due in two months.

I say bring it on. This xenophobic old bigot (now 80) has fallen for one of the oldest tricks in the book: self-delusion, brought on by decades of megalomania and ideological sound-chambering within a cadre of sycophants — which Alberto Fujimori (an old friend of Ishihara and his elite ruling circles) similary fell for when the self-deluded demagogue buggered off back to Chile (forfeiting his unextradictable safe haven in Japan) to stand for reelection in Peru. Fujimori, as you know, was then extradited to Peru for trial and is now doing essentially life in prison. But I digress.

I say bring it on for two reasons. One is that even if elected (which he will be, under Japan’s Proportional Representation system — the main avenue for celebrity schmoes to pad their resume and stroke their egos), Ishihara can do less damage as a Dietmember of a fringe party (analysts already are beginning to doubt the strength of the Rightist alliance between other fringe parties) than as Governor of Tokyo, with an entire Metropolitan Police Force (the strongest and most influential in all of Japan) at his disposal to target people he doesn’t like. One of the reasons he says he resigned his Diet seat in 1995 after 25 years in office is because of his frustration with the powerlessness of the Diet in the face of the pervasive Japanese bureaucracy (which, as he correctly claims, rules the country). Now he’s going right back to that same Diet, and I think he thinks he’ll stop at nothing short of becoming PM (He won’t. He won’t live long enough. Osaka Mayor Hashimoto is the bigger threat at half the age.)

The other reason is because it’s time to put some cards on the table. The Center-Left in Japan (in the form of the DPJ) tried their liberalizations (with NJ PR local suffrage, etc.) and lost badly due to the hue and cry over how NJ, if given any power in Japan, would automatically abuse it and destroy Japan). The image in Japanese politics nowadays is of a rightward swing. Alright, let’s see just how rightward. Japan’s bureaucrats like things just the way they are (their sole purpose is to keep the status quo as is, even if that means Japan irradiates itself and strangles itself to death demographically). It would take a miracle (something I think not even Ishihara is capable of) to dismantle that system. If Ishihara wins, Japan’s rightward swing is conclusive, and the world will have to stop ignoring a resurgent militarist xenophobic Japan. If Ishihara loses, that will take a lot of wind out of Rightist sails and push the country back towards centrism.

In this poker game, I believe Ishihara will lose. And NJ in Japan have already won a victory by having that bigot abdicate his throne/bully pulpit as leader of one of the world’s largest cities.

Kyodo: Soccer S-Pulse coach Ghotbi wants to meet banned fans over racial banner

We have some proactive treatment against discrimination towards a NJ coach in Japan’s soccer leagues. Witness the reaction of other fans towards a nasty fan banner singling him out by his nationality, attributing to him behavior that is unrelated and unwarranted: criticism and the taking of responsibility. Good. Regardless of whether one might argue this actually constitutes “racism” or not, it is still indicative of the zero tolerance of discrimination that should be (and is, under FIFA) a hallmark of world sport leagues worldwide, including Japan’s.

I am, however, of two minds about manager Ghotbi meeting the nasty fans to somehow enlighten them. It on one hand seems a good PR strategy — engage and convince the nasties that their targets are humans with feelings after all. On the other hand, it may encourage other trolls who want attention (not to mention get a meeting with a famous NJ — just insult them and you get an audience) to do the same thing — and enough of these banners and people may start claiming “cultural misunderstandings” as justification (you get that with nasty slogans against NJ in Japanese baseball, e.g., the racist banners against Warren Cromartie). In my experience it doesn’t always work to talk to discriminators (sometimes their names exposed to social opprobrium is enough), but sometimes it does, and at least there is social opprobrium and media attention this time. Let’s keep an eye on this and see how it flies. Hopefully buds get nipped.

Kyodo: Shimizu S-Pulse manager Afshin Ghotbi has turned the other cheek toward two Jubilo fans who have been indefinitely banished from Iwata games for hoisting a racially motivated banner in the Shizuoka derby two weeks ago, wanting to meet them to try to raise international awareness throughout the J-League.

The two teenage Jubilo supporters were outlawed by their club on Monday after writing a banner that read, ‘‘Ghotbi, stop making nuclear weapons,’’ in the May 28 J-League contest between Shimizu and Iwata at Outsourcing Stadium… Ghotbi, the ex-Iran national coach who is in his first season in Japan at Shimizu, is Iranian-American…

Yet rather than further fry the two fans amid arguably the nastiest controversy between the Shizuoka-based clubs, [Ghotbi] wants a clear-the-air meeting with the pair to stamp out racism in the J-League for good…

QB House Tameike Sannou, Tokyo, requires Japanese language ability for a haircut (UPDATE: Sign has been replaced)

Here is the latest permutation of the “Japanese Only” signs nationwide. Instead of saying they refuse all foreigners, QB House, an international bargain barbershop chain since 1995, has a sign up in one of their Tokyo outlets saying they may refuse anyone who doesn’t speak sufficient Japanese. While some may see this as an improvement (i.e. it’s not a blanket refusal of NJ), I just see it as another excuse to differentiate between customers by claiming a language barrier (which has been the SOP at exclusionary businesses in Japan for years now). Who’s to judge whether or not someone is “able to communicate” sufficiently? Some panicky manager? I’ve seen it in practice (in places like Wakkanai), where a barber sees any white face, assumes he cannot communicate, and reflexively arms the X-sign at you. This time, however, QB House has managed to make an exclusionary sign in perfect English in one of the more international areas of Tokyo. How about catering to the customers instead of finding ways of snippily enforcing a “culture of no”? Photo of the sign and note from submitter follows:

Japan Times JUST BE CAUSE Column Aug 3 2010: “The victim complex and Kim’s killer con”

It’s fascinating whenever someone cons people out of pots of money — doubly so when someone cons a whole government. Take, for example, Japan’s biggest news story two weeks ago: Kim Hyon Hui’s four-day visit to Japan.

You might recall that in 1987 this North Korean spy, traveling on a fake Japanese passport, blew up a South Korean commercial airliner, killing 115 passengers.

Last July 20, however, this agent of international terrorism was allowed into Japan for a reception worthy of a state guest. Bypassing standard immigration procedures, Kim had her entry visa personally approved by our justice minister, boarded a chartered flight that cost Japan’s taxpayers ¥10 million, and was whisked by helicopter to former Prime Minister Yukio Hatoyama’s private dacha to eat with political elites.

Then, flanked by a phalanx of 100 cops (who made sure nobody raised any uncomfortable questions), Kim got to meet the parents of Megumi Yokota, the cause celebre of North Korean kidnappings of innocent Japanese citizens decades ago. Next, at her request, Kim boarded another helicopter (at around ¥800,000 an hour) for an aerial tour of Mount Fuji. As a parting gift, she got an undisclosed amount of “additional remuneration.” Sweet.

And what did Japan get? Kim said she had information for the Yokotas about their missing daughter and other Japanese abductees who trained her to be a multilingual spy — even though, way back when, she said she had never met Megumi. So suddenly Kim has a quarter-century-old brain fart and gets the red carpet?

The Megumi Yokota tragedy has for the past decade been a political football in Japanese politics, a means for Japan as a whole to claim victimhood status…

Peru’s Fujimori really really gets his: 25 years jail for death squads

LIMA, Peru (AP) — Former Peruvian President Alberto Fujimori was convicted and sentenced to 25 years in prison Tuesday for death squad killings and kidnappings during his 1990s struggle against Shining Path insurgents.

The court convicted the 70-year-old former leader, who was widely credited for rescuing Peru from the brink of economic and political collapse, of “crimes against humanity” including two operations by the military hit squad that claimed 25 lives…

Fujimori, who proclaimed his innocence in a roar when the 15-month televised trial began, barely looked up, uttering only four words — “I move to nullify” — before turning, waving to his children, and walking out of the courtroom at the Lima police base where he has been held and tried since his 2007 extradition from Chile…

Fujimori’s congresswoman daughter, Keiko, called the conviction foreordained and “full of hate and vengeance.” She said it would only strengthen her candidacy for the 2011 presidential race.

“Fujimorism will continue to advance. Today we’re first in the polls and will continue to be so,” she said outside the courtroom. She has vowed to pardon her father if elected.

Excellent Japan Times roundup on debate on J Nationality Law and proposed dual citizenship

Here’s an excellent Japan Times roundup of the debate which came out of nowhere last year regarding Japan’s loopy nationality laws, which were once based on what I would call a “culture of no”, as in rather arbitrary ways to disqualify people (as in babies not getting J citizenship if the J father didn’t recognize patrimony before birth). A Supreme Court decision last year called that unconstitutional, and forced rare legislation from the bench to rectify that late in 2008. Now the scope of inclusivity has widened as Dietmember Kouno Taro (drawing on the shock of a former Japanese citizen getting a Nobel Prize, and a confused Japanese media trying to claim him as ours) advocates allowing Japanese to hold more than one citizenship. Bravo. About time.

The article below sets out the goalposts for this year regarding this proposal (and uses arguments that have appeared on Debito.org for years now). In a year when there will apparently be a record-number of candidates running in the general election (which MUST happen this year, despite PM Aso’s best efforts to keep leadership for himself), there is a good possibility it might come to pass, especially if the opposition DPJ party actually takes power.

2009 looks to be an interesting year indeed, as one more cornerstone of legal exclusionism in Japan looks set to crack.

LDP’s Kouno Taro submits J dual nationality proposal to Diet

LDP panel mulls easing law on dual citizenship
Mixed couples’ kids could have two nationalities

Liberal Democratic Party member Taro Kono said Thursday he has submitted a proposal to an LDP panel he heads calling for the Nationality Law to be revised to allow offspring of mixed couples, one of whom being Japanese, to have more than one nationality…

While the proposal allows for multiple nationalities, the government will not let Japanese hold nationalities of countries or regions that Japan does not recognize as nations, including North Korea.

Also under the proposal, foreigners would be able to obtain Japanese citizenship without giving up their original one. But the proposal does not say whether those who had had multiple nationalities and gave up one or more to retain their Japanese citizenship can regain other nationalities.

The proposal would also affect babies born in countries that grant nationality to those born there regardless of their parents’ nationalities, including the United States, Brazil and Australia.

Thanks to Kouno Taro, LDP Dietmember, for submitting a proposal to the Diet, after a good think about dual nationality following the paradoxes of Japanese-born American citizens winning Nobel Prizes. Let’s hope the proposal goes somewhere. It’s about time the unnecessary identity sacrifices of enforced mononationality are resolved. There is no need in this day and age to force multicultural people to legally deny themselves the existence of international roots.

Fujimori finally gets his–extradition to Peru

Former President Alberto Fujimori returned to Peru on Saturday to face charges of corruption and sanctioning death-squad killings, a grim homecoming for the strongman who fled the country seven years ago as his government collapsed in scandal. He was flying to Peru under police custody Saturday, a day after the Chilean Supreme Court ordered his extradition on human rights and corruption charges.

Yomiuri: Nikkei defecting from DPRK are stateless, have trouble becoming J citizens

“At least 24 defectors from North Korea living in Japan remain stateless, largely due to the lack of clear government guidelines on how to determine their nationalities. The statelessness of the 24 people, children or grandchildren of one Japanese citizen and a North Korean, is a result local governments being left to their own devices on how to deal with the registration of the defectors. Nationality law would otherwise grant them citizenship, since Japan confers nationality by blood, but politics inevitably gets in the way.” Contrast with wanted criminal candidate Alberto Fujimori and you really get a confusing application of Japanese citizenship laws…

Peru’s Fujimori Update: Running in J elections! (UPDATED)

Former President Fujimori is back… kinda. Kamei Shizuka has asked him to run in the July elections in Japan, and as of June 27, 2007, he has accepted. Amazing how low people can stoop to invite people who suspend constitutions, become corrupt robber barons, then run off to Japan, declare themselves Japanese citizens, evade extradition charges, then run back to Chile and try to stand for elections in Peru again. Somebody pass a stake and a hammer for this political vampire, please?

Nikkan Gendai reports that Japan’s lack of extradition treaties is causing problems when foreigners commit crimes in Japan and flee scot free overseas. Then it concludes, “at least it’s a good thing that Japan is not a place where foreign criminals typically flee in order to escape arrest for crimes they committed elsewhere”. Quite. It’s only the Japanese crooks that can flee here and get away with it.

Yamanashi English school want ad: “blonde hair blue or green eyes and brightly character” (with updates)

A school in Yamanashi is specifically advertising in the local international association jobs for “blonde blue-eyed brightly” foreigners, because the local kindergarten wants a typical foreigner for acclimatization to “eigojin”. It’s just business, you see, they explained to me. Well, the int’l association doesn’t agree, and according to sources on the ground they will be taking this issue up.

GOJ requires fingerprints and criminal history for long-term visas, yet refuses domestic means to produce them.

As of April 2006, Japan is now requiring fingerprints for long-term visas, yet now refusing to provide domestic police assistance to get them. US citizens, for example, are now told to give their fingerprints to the FBI and get a Rap Sheet–and pay for the privilege. Nice little money spinner for the USG on the behest of the GOJ, which requires compliance yet refuses to provide assistance. This is what people pay taxes for?
