Kobe Shinbun on new GOJ requirements on employers to report NJ laborers

Kobe Shinbun: Beginning October 1st, according to new amendments in the Employment Promotion Law, all firms employing foreign workers will be obliged to report employment conditions to labour offices. The goal of the reforms are two fold – to provide foreigner workers with job support and to help curb illegal employment. As awareness about the amendments is still relatively low, officials at the Hyogo Labour Department are eager to distribute leaflets to business groups. However, some have pointed out the danger that such reforms might invite new kinds of prejudice toward foreigners.

Mainichi: Pregnant NJ woman rejected by 5 hospitals 7 times, in 2006!

Mainichi: A foreign woman seeking medical help in Japan after giving birth at home was rejected by five hospitals where officials said her Japanese wasn’t good enough and they didn’t have proper facilities, authorities said Thursday. The incident happened in August 2006, but was reported in Japan only after a similar thing recently happened to a Japanese too.

Fujimori finally gets his–extradition to Peru

Former President Alberto Fujimori returned to Peru on Saturday to face charges of corruption and sanctioning death-squad killings, a grim homecoming for the strongman who fled the country seven years ago as his government collapsed in scandal. He was flying to Peru under police custody Saturday, a day after the Chilean Supreme Court ordered his extradition on human rights and corruption charges.

Peru’s Fujimori Update: Running in J elections! (UPDATED)

Former President Fujimori is back… kinda. Kamei Shizuka has asked him to run in the July elections in Japan, and as of June 27, 2007, he has accepted. Amazing how low people can stoop to invite people who suspend constitutions, become corrupt robber barons, then run off to Japan, declare themselves Japanese citizens, evade extradition charges, then run back to Chile and try to stand for elections in Peru again. Somebody pass a stake and a hammer for this political vampire, please?

Yomiuri: Latest Stats on registered NJ numbers (2006)

Latest figures for the population of registered NJ residents (2006) demonstrate the 45th year of unbroken rise. Now at 2.08 million and rising by about 3.6% per year, under compounding rates, this means the NJ population will double in about 20 years. This regardless of all the disincentives to immigrate (crappy visa conditions, ministerial indifference, and official waruguchi).

REPORT: Immigrant children and Japan’s Hair Police

During one of my recent speech tours, I was told by a Nikkei Brazilian student (I will call her Maria) that her sister (call her Nicola) had been victimized by a Japanese high school’s rules. According to Maria, Nicola had been forced by her school to dye her hair weekly because it was not as dark as her peers’. Maria said she herself escaped the Hair Police (she looks more phenotypically “Japanese” than her sister), but Nicola was told to darken and even straighten hers. Although graduated from the high school, Nicola still has not only mental trauma from the ordeal, but also damaged hair which to this day has not recovered. An example of how Japan’s cookie-cutter educational rules are doing a disservice to Japan’s imminent internationalization…

Asahi: Kurashiki hotel refuses foreigners

Hotel Apointo in Kurashiki expressly refuses foreigners in violation of the Hotel Management Law. The city government kicks in. The Asahi article on the issue ends by saying the hotel would continue refusing, but a call to the hotel by Arudou Debito (on the same day of the article) indicates that they have abandoned that policy. Remains to be seen, but well done, Kurashiki City Govt. Now, if only Shinjuku would do something about its hotel Tsubakuro which has been refusing foreigners illegally for years now with complete impunity…

Joe Jones on surrogate mothers and J citizenship (UPDATED)

Japanese citizenship issue: According to a fascinating new blog by friend Joe Jones, we have yet another facet of Japanese citizenship up for dispute: If Japanese infertile couples seek Surrogate Motherhood overseas, the Supreme Court has ruled that citizenship is conferred not by DNA (after all, they didn’t have DNA tests back in the Meiji Era) but by whose womb the baby emerges. Better not outsource overseas. And because the parents refused to register their children on April 11, 2007, their kids are now foreigners.

Asahi Column: Tokyo JH school refuses education to NJ child

“Currently, the most important law on education in Japan, as well as the very Constitution, does not guarantee the right to education for children with foreign nationalities. Our eldest daughter, who has only Brazilian nationality, was once denied entrance to a public junior high school in Setagaya Ward, Tokyo, when trying to transfer from a school in Brazil at the age 15 in the ninth grade. Officials said our daughter was a year older than the proper age for obligatory education. They explained that exceptions cannot be made because the obligatory education system does not apply to a child without Japanese nationality.”

MOJ Immigration Bureau violates privacy of marriage with new visa “shitsumon sho”

Want a visa of any duration longer than three months, and just happen to be married? Well the Immigration Bureau has instituted a new questionnaire, which asks you breathtakingly personal questions, such as what language you use at home, who came to your wedding, how much rent you pay, how and where and when you met (include photos, love letters, international phone bills), and how you learned Japanese. Why? Because they are Immigration and they can do whatever they damn well please to foreigners and their unfortunate Japanese spouses.

Mysterious Asahi translation: “IC cards planned to track ‘nikkeijin'”

Funny translation of an Asahi article. The English version is entitled “IC cards planned to track ‘Nikkeijin'”. The Japanese version is entitled “Gaikokujin ni IC kaado–touroku jouhou no ichigen kanri he seifu gen’an” (“IC Cards for Foreigners–a proposal before the Diet to unify all registered data for administrative purposes”). Sounds quite different, no? What’s going on? Why this downplaying?

Asahi Dec 1 06: Osaka High Court rules Juki Net unconstitutional. OK, how about Gaijin Cards, then? (with update)

Osaka High Court ruled that the “Juki Net” residence registration network infringes on people’s constitutional right to privacy if they oppose the system. Great. Now how about Gaijin Cards? What the plaintiffs probably fear happening to them happens on a daily basis to foreigners in this country, who are also covered by the constitution. UPDATE–The judge who ruled on this case committed suicide days later.

J Times Nov 10 06 on tourism promotion, with great Letter to the Ed Nov 19

A Japan Times article about another promotion to bring more tourists to Japan to spend money (remember Koizumi’s “Yokoso Japan” campaign?), specifically mentioning onsen as one of the places they want more foreigners to frequent. Funny they should mention onsens. Friend Hidesato Sakakibara makes a great rejoinder in a letter to the editor, questioning the effectiveness of such a campaign when there is no law to protect their rights from racial discrimination once tourists get here. JALT PALE Roundtable of Nov 3 06 Report re Japan’s future academic work

Continuing the Roundtable forum that packed the hall at JALT 2005, five PALE members paneled a meeting to discuss a variety of issues relevant to the conference’s theme of “Community, Identity, and Motivation”. All presentations touched in some way upon employment issues, including issues of job security, union representation, the relationship of nationality to job description and employment terms, and the growing role of dispatch teaching arrangements in Japanese universities. They dealt explicitly or implicitly with the proper roles and responsibilities of PALE and JALT in managing these issues.

Racist remarks against foreign baseball coach result in suspension, fine

However, that was vastly overshadowed by the actions of Fighters starter Satoru Kanemura, who threw a major hissy fit due to being pulled by manager Trey Hillman in the fifth inning needing just one out to become the first Nippon Ham hurler to rack up five straight ten win seasons since Yukihiro Nishimura. After the game, he told the press that. yanking him was “absolutely unforgivable” and then took a racial shot at Hillman, grumbling that, “because he’s a foreigner, he doesn’t care about players’ individual goals.” He then challeneged reporters to print his remarks. “I don’t even want to look at him,” Kanemura said of Hillman. In addition, he accused the former Rangers farm director of being more indulgent with Iranian-Japanese righthander Yu Darvish than him. In the context of this little explosion, that also has a racial tinge to it. Kanemura also beefed that he didn’t think Hillman trusted him.

Yomiuri Sept 23 06: Govt to have employers report info on foreign employees

By making it obligatory for companies to report foreign workers’ details, the government hopes to keep track of people on an individual basis, and to enhance measures for clamping down on those working illegally. In addition, it is hoped the measures will encourage foreign workers to take out social insurance, and allow central and local governments to offer better support to workers who have to change jobs frequently due to unstable contracts.

The government’s three-year deregulation program, finalized in March, discusses making it mandatory for firms to submit reports on their foreign employees and whether reports should include detailed information such as workers’ names and residence status. The policy is likely to prove controversial in light of the protection of foreign workers’ privacy and the impact of the new system on the economy.

SUCCESS STORIES: Article on Divorce in Japan

The author does not wish to give the impression that divorce is any more likely if the spouse is a Japanese. “Any marriage,” my lawyer sources dryly indicate, “is a gamble.” However, what raises the stakes of the transaction is the fact that Japan has weak-to-nonexistent recourse to prevent potential abuses. According to Colin P.A. Jones J.D., Associate Professor at Doshisha University Law School, the system is geared to support the distaff side of the divorce. The woman, as wife and mother, is given overwhelming priority in divorce cases, as opposed to viewing each divorce on a case-by-case basis (spawning a cottage industry of guidebooks on wringing the most out of your man). Yes, weak-to-nonexistent enforcement of laws and court rulings mean that men in the Japanese system (as compared to, for example, the American) do not stand to lose enormously financially. They will, however, lose their children.
