Yomiuri: Nikkei Brazilian cannot be probation officer due to Nationality Clause

Yomiuri: The Shizuoka Probation Office has given up its bid to appoint a second-generation Brazilian of Japanese descent as a probation officer, after it received a Justice Ministry opinion indicating that foreigners may not be commissioned to exercise public authority. Probation officers are part-time, unpaid central government officials entrusted by the justice minister. The ministry said it is “problematic” to commission foreign residents as probation officers because some of their responsibilities involve exercising public authority. Even though the Shizuoka Probation Office invited karate school operator Tetsuyoshi Kodama, a second-generation Brazilian of Japanese descent, who is experienced in dealing with non-Japanese youths, to become a probation officer and stem youth crime. Nationality Clause and Chong-san Lawsuit defeat strike again.

Asahi on 2-Channel BBS: “Criticism mounts against forum”

Another (rather pedestrian, but something for the uninitiated; even the GOJ comments–albeit flacidly–this time) article about the rolling controversy that remains 2-Channel, the world’s largest BBS, and a hotbed of anonymized libel (the “den of criminals” comment is not mine).

As always, 2-Channel adminstrator Nishimura gets quoted. Wish they’d asked more comments from the victims.

Petitions re Comfort Women US Congress House Res. 121

Forwarding from other activists: “It has been more than 60 years of the women forced into sexual slavery by the Japanese Imperial government and justice has yet to be seen. A clear position of the United States (country to whom Japan, esp. the current Abe regime, is REALLY beholden to, as we know) via Congress will mark the perhaps the biggest blow to the Japanese government which has stepped up public efforts to re-legitimatize revisionist history… It’s been long recognized in Japan that an international or external pressure is a critical political force in order to delivery justice to this issue, and now it seems that the House Resolution 121 has gained so much momentum, we need to keep it up….and get it PASSED!”

Asahi: Kurashiki hotel refuses foreigners

Hotel Apointo in Kurashiki expressly refuses foreigners in violation of the Hotel Management Law. The city government kicks in. The Asahi article on the issue ends by saying the hotel would continue refusing, but a call to the hotel by Arudou Debito (on the same day of the article) indicates that they have abandoned that policy. Remains to be seen, but well done, Kurashiki City Govt. Now, if only Shinjuku would do something about its hotel Tsubakuro which has been refusing foreigners illegally for years now with complete impunity…

Lucie Blackman’s alleged killer acquitted, given life for other crimes

The alleged killer of hostess Lucie Blackman, whose body was found a short walk from serial racist and killer Obara Jouji, was aquitted of murdering Blackman due to “circumstantial evidence”. This in a system where circumstantial evidence has gone a long way in other verdicts which turned out guilty, and why does it increasingly seem like the police do a half-assed job when crime is committed against non-Japanese…?

Economist: UN Human Rights Council “adrift on human rights”

I’ve been wanting to present the indicative Otaru Onsens Case to the HRC for some years now, but bureaucratic snafus, and warnings from my activist friends that doing so would probably be a disappointment, have kept me at bay. Meanwhile, these articles from The Economist keep coming out and offering bad news about the meetings I’ve missed.

Would be nice to believe that human rights, from the organization which has established some of the most important conventions and treaties in history, still matter in this day when rules seem grey, and even the most powerful country in the world dismisses long-standing international agreements as “outmoded” and “quaint”…

Yomiuri on 2-Channel’s Nishimura: “I’ll pay court damages only if sentenced to death”

Yomiuri: Nishimura has up to now been the defendant in more than 50 civil suits nationwide, and the great majority of them have been losses for him. Unpaid damages and penalties assessed for not following injunctions and court rulings have now amassed to around 5 million dollars US. However, Nishimura has hardly ever paid up. Justifying this, Nishimura said, “If you turn deadbeat, nobody’s going to make you pay. With rules as stupid as this country has, it would be idiotic to pay up.” Huh?

UPDATE: Visiting Immigration re Spouse Visa questionnaire

I visited Sapporo’s very friendly Immigration Bureau (Nyuukoku Kanrikyoku) yesterday to find out more about the Questionnaire (shitumonsho) for people marrying Japanese and applying for the appropriate visa. I talked to the Inspection Division (shinsa bumon) for about an hour regarding the requirements for certain types of visas based upon conjugal status. A fascinating discussion ensued about how Japan is trying to suss out fake international marriages.

MDN Waiwai: J bad bath manners :-)

Assuming that this is true: Gracious old rural inns, traditionally, have been places where Japanese go to relax in natural surroundings while soaking away their aches and pains in mineral hot springs. But, reports Shukan Jitsuwa (10/13), inns’ clientele of late seem to have other ideas. “The idea of 24-hour bathing was to let you get up early, and soak in the tub while watching the rising sun burn off the morning mist,” continues the kami. “Or, you could go late there at night and gaze at the starry sky. It made things all the more relaxing. But when you’ve got to worry about families bathing within hearing range of these noisy young couples, it’s really vexing.”…

Asahi Dec 1 06: Osaka High Court rules Juki Net unconstitutional. OK, how about Gaijin Cards, then? (with update)

Osaka High Court ruled that the “Juki Net” residence registration network infringes on people’s constitutional right to privacy if they oppose the system. Great. Now how about Gaijin Cards? What the plaintiffs probably fear happening to them happens on a daily basis to foreigners in this country, who are also covered by the constitution. UPDATE–The judge who ruled on this case committed suicide days later.

A Japan Times article about another promotion to bring more tourists to Japan to spend money (remember Koizumi’s “Yokoso Japan” campaign?), specifically mentioning onsen as one of the places they want more foreigners to frequent. Funny they should mention onsens. Friend Hidesato Sakakibara makes a great rejoinder in a letter to the editor, questioning the effectiveness of such a campaign when there is no law to protect their rights from racial discrimination once tourists get here. JALT PALE Roundtable of Nov 3 06 Report re Japan’s future academic work

Continuing the Roundtable forum that packed the hall at JALT 2005, five PALE members paneled a meeting to discuss a variety of issues relevant to the conference’s theme of “Community, Identity, and Motivation”. All presentations touched in some way upon employment issues, including issues of job security, union representation, the relationship of nationality to job description and employment terms, and the growing role of dispatch teaching arrangements in Japanese universities. They dealt explicitly or implicitly with the proper roles and responsibilities of PALE and JALT in managing these issues.

Mainichi Oct 10 06: BBS 2-Channel’s Nishimura still on the lam

2-Channel’s Defendant Nishimura: “I’ve been sued in the north as far as Hokkaido and the south as far as Okinawa. It’s simply not possible to attend every court case where I’ve been named as a defendant. I figure if I can defend myself in every case, it’s exactly the same as not turning up in my defense,” he tells the weekly indirectly. Nishimura also strongly denies suggestions that he’s gone bankrupt, which many have speculated may be the main reason nobody seems able to find him
now.

Temple U Prof: “Japan’s Criminal Libel Laws vital for police intervention and arrest” (???)

A Temple University professor is publishing a paper in the University of Colorado Law Review asserting that, quote, “In Japan, however, criminal libel laws have become vital tools in policing injurious speech on the Internet. Defamatory posts lead to police intervention and even arrest.” Not according the 2-Channel Lawsuit, which I think proves Dr Mehra’s assertions quite inaccurate.

J Times Sept 23 2006: Tokyo Court rules against “forced patriotism” in schools

COMMENT: A blow against the tendency (especially in Tokyo, as you can see in Ishihara’s comments below) towards (re-)enforced patriotism in schools. SUCCESS STORIES: Article on Divorce in Japan

The author does not wish to give the impression that divorce is any more likely if the spouse is a Japanese. “Any marriage,” my lawyer sources dryly indicate, “is a gamble.” However, what raises the stakes of the transaction is the fact that Japan has weak-to-nonexistent recourse to prevent potential abuses. According to Colin P.A. Jones J.D., Associate Professor at Doshisha University Law School, the system is geared to support the distaff side of the divorce. The woman, as wife and mother, is given overwhelming priority in divorce cases, as opposed to viewing each divorce on a case-by-case basis (spawning a cottage industry of guidebooks on wringing the most out of your man). Yes, weak-to-nonexistent enforcement of laws and court rulings mean that men in the Japanese system (as compared to, for example, the American) do not stand to lose enormously financially. They will, however, lose their children.

Excerpted and adapted from our upcoming book, “Guidebook for Newcomers: Setting Down Roots in Japan” (working title), to be published in early 2007. I’d like to say “enjoy” as usual, but it’s not that kind of topic. Be advised, however, that the information within is very important to those hoping to stay and and create firmer roots in Japan.
