I&#8217;m sorry for taking some time to get to this: I&#8217;ve been rather busy recently, and I was hoping that an English-langauge article would take this issue up and save me the need to carve out some time translating from the vernacular press. Found a couple references (<a href=\"http:\/\/www.dailymail.co.uk\/news\/article-3021032\/First-mixed-race-Miss-Japan-Ariana-Myamoto-hits-spasmodic-vomit-racial-abuse-suffered-father-African-American.html\">a passing one\u00a0here<\/a>\u00a0and a <a href=\"http:\/\/www.japantimes.co.jp\/news\/2015\/04\/09\/national\/social-issues\/anti-discrimination-laws-sub-par-expert\/\">more elaborate contextualizing in the Japan Times here<\/a>), but they&#8217;re missing a couple of important nuances, so here goes:<\/p>\n<p>47News.jp (article below) reports that the <a href=\"http:\/\/houmukyoku.moj.go.jp\/\">Ministry of Justice Legal Affairs Bureau<\/a> has refused to acknowledge a &#8220;No Foreigners&#8221; apartment as a violation of human rights. \u00a0This is the outcome of a<a href=\"http:\/\/www.japantimes.co.jp\/community\/2013\/04\/23\/issues\/student-seeking-kyoto-flat-told-no-foreigners-allowed\/\"> case back in 2013, where an exchange student at Ryuukoku University was denied a flat despite going through the Student Union<\/a>, and he took it to the Bureau of Human Rights for the official word on the subject. \u00a0Now more than two years\u00a0later (presumably the poor chap wasn&#8217;t living on the street in the interim), the MOJ determined that the foreigner-averse landlord had not violated anyone&#8217;s human rights, refusing to elaborate\u00a0further. \u00a0Great. \u00a0Job well done and great precedent set, BOHR.<\/p>\n<p>Two things of note before I get to the article: \u00a0One is a media bias. \u00a0Note how once again the 47News.jp article portrays the issue incorrectly in its sidebar illustration:<\/p>\n<p><a href=\"https:\/\/www.debito.org\/wp-content\/uploads\/2015\/04\/foreignerdiscrim47Newsjp033015.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-13219\" src=\"https:\/\/www.debito.org\/wp-content\/uploads\/2015\/04\/foreignerdiscrim47Newsjp033015.jpg\" alt=\"foreignerdiscrim47Newsjp033015\" width=\"422\" height=\"666\" srcset=\"https:\/\/www.debito.org\/wordpress\/wp-content\/uploads\/2015\/04\/foreignerdiscrim47Newsjp033015.jpg 422w, https:\/\/www.debito.org\/wordpress\/wp-content\/uploads\/2015\/04\/foreignerdiscrim47Newsjp033015-190x300.jpg 190w\" sizes=\"auto, (max-width: 422px) 100vw, 422px\" \/><\/a><\/p>\n<p><em>(from <a href=\"http:\/\/www.47news.jp\/47topics\/e\/263652.php\">47News.jp, March 30, 2015<\/a>)<\/em><\/p>\n<p>It&#8217;s not &#8220;Foreigner Discrimination&#8221; (<em>gaikokujin sabetsu no jirei<\/em>). It&#8217;s <em>racial<\/em> discrimination, because the first case they cite (the <a href=\"https:\/\/www.debito.org\/otarulawsuit.html\">Otaru Onsens Case<\/a> in 1999) eventually has a Japanese being refused too. \u00a0Yet <a href=\"https:\/\/www.debito.org\/?p=12179\">the Japanese media will almost always refuse to undermine\u00a0the incorrect narrative that racial discrimination never happens in Japan<\/a>.<\/p>\n<p>Second thing is that\u00a0<a href=\"https:\/\/www.debito.org\/whattodoif.html#protest\">Japan&#8217;s generally\u00a0ineffective Potemkin Bureau of Human Rights<\/a> (<em>jinken yougobu<\/em>) has a long history of blind-eyeing the very thing it&#8217;s charged with protecting against. \u00a0As further evidence of its ineffectuality \u2013 even complicity with discriminators \u2013 here\u00a0is an example where the Sapporo BOHR advised a local government (Otaru) that it has no legal obligation to pass ordinance against racial discrimination, only suggesting that the city make such an ordinance if it considers it necessary. \u00a0This from my book &#8220;<a href=\"https:\/\/www.debito.org\/japaneseonly.html\">Japanese Only: \u00a0The Otaru Hot Springs Case and Racial Discrimination in Japan<\/a>&#8221; (Tokyo: Akashi Shoten) , pg. 347 in the English version:<\/p>\n<p><a href=\"https:\/\/www.debito.org\/wp-content\/uploads\/2015\/04\/jinkenyougobu112999.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-13221\" src=\"https:\/\/www.debito.org\/wp-content\/uploads\/2015\/04\/jinkenyougobu112999-626x1024.jpg\" alt=\"jinkenyougobu112999\" width=\"626\" height=\"1024\" srcset=\"https:\/\/www.debito.org\/wordpress\/wp-content\/uploads\/2015\/04\/jinkenyougobu112999-626x1024.jpg 626w, https:\/\/www.debito.org\/wordpress\/wp-content\/uploads\/2015\/04\/jinkenyougobu112999-183x300.jpg 183w, https:\/\/www.debito.org\/wordpress\/wp-content\/uploads\/2015\/04\/jinkenyougobu112999.jpg 1369w\" sizes=\"auto, (max-width: 626px) 100vw, 626px\" \/><\/a><\/p>\n<p>(Annotations within the document by the Sapporo BOHR.) \u00a0Further, the BOHR\u00a0has <a href=\"https:\/\/www.debito.org\/policeapology.html\">denied information to claimants on the pretext of protecting claimants from their own privacy<\/a>, so I wholeheartedly agree with the exchange student&#8217;s complaints about the lack of transparency. \u00a0So this latest event of saying\u00a0a blanket exclusionary policy as not a violation of human rights is but one more example to record on Debito.org for posterity.<\/p>\n<p>Translation of the article without footnotes follows, with full article in Japanese. Any\u00a0errors are mine. \u00a0Dr. ARUDOU, Debito<\/p>\n<p>\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/\/<\/p>\n<p><strong>(Foreigner Apartment\u00a0Refusal) Ministry of Justice on &#8220;No Foreigners&#8221; apartments: \u00a0not acknowledged as a violation of human rights. \u00a0Student Union that introduced the apartment\u00a0apologizes to student.<\/strong><\/p>\n<p><strong>47News.jp, from Kyodo, March 30, 2015, provisional translation by Dr. ARUDOU, Debito<\/strong><\/p>\n<p><strong><em>A European exchange student in his twenties who wished to rent an apartment in Kyoto could not get\u00a0a rental contract because the apartment was &#8220;No Foreigners&#8221;. \u00a0He asked for recourse from the Ministry of Justice&#8217;s Legal Affairs Bureau in Kyoto for\u00a0discrimination against foreigners, but the Legal Affairs Bureau refused, stating, &#8220;We cannot determine that the facts constitute a violation of human rights.&#8221;<\/em><\/strong><\/p>\n<p><strong><em>The Student Union at Ryukoku University in Kyoto, who acted as the interlocutor to the\u00a0realtor, apologized to the student, and has ceased introductions to places that refuse foreigners. \u00a0The university has advised the Student Union to improve its services. \u00a0The student&#8217;s supporters have voiced the need for seeing\u00a0how the\u00a0Legal Affairs handled the issue as a problem.<\/em><\/strong><\/p>\n<p><strong><em>Lack of Transparency<\/em><\/strong><\/p>\n<p><strong><em>The Ministry of Justice has called for the end of street demonstrations expressing discrimination\u00a0against\u00a0foreigners that may be called hate speech [sic]. \u00a0On\u00a0its\u00a0online home page it introduces a case of &#8220;a barber who refused customers on the basis of them being foreigners&#8221; as a violation of human rights. \u00a0As to\u00a0this\u00a0case of the refused student, the Ministry of Justice refused to explain further why this was not acknowledged as the same. \u00a0The student criticized the situation, saying &#8220;the Legal Affairs Bureau&#8217;s handling lacks transparency.&#8221;<\/em><\/strong><\/p>\n<p><strong><em>The <a href=\"http:\/\/www.japantimes.co.jp\/community\/2013\/04\/23\/issues\/student-seeking-kyoto-flat-told-no-foreigners-allowed\/\">student attempted to rent the apartment in Kyoto through the Student Union in January 2013<\/a>, but was told at the Union that the landlord refused. In September 2014, the Bureau notified him that &#8220;We decided that it was unclear that there had been\u00a0a\u00a0violation&#8221;. \u00a0&#8220;We admonished (keihatsu, or &#8220;enlightened&#8221;) the Student Union.&#8221; \u00a0According to Ministry of Justice guidelines, even in cases where there has not been a violation of human rights, admonition can be carried out. \u00a0<\/em><\/strong><\/p>\n<p><strong><em>However, the exchange student raised the question, &#8220;Wouldn&#8217;t most Japanese think that this is discrimination? \u00a0Would only admonishing without any legally-binding force\u00a0actually stop this from happening again?&#8221; \u00a0He repeated, &#8220;I had the chance to learn and grow from learning Japanese culture, but I was quite hurt by this problem.&#8221;<\/em><\/strong><\/p>\n<p><strong><em>Easing the Unease<\/em><\/strong><\/p>\n<p><strong><em>Ryuukoku&#8217;s Student Union leader Doumen Yuuko sees\u00a0that this landlord&#8217;s refusal to rent to foreigners is but a &#8220;vague feeling of unease&#8221; (bakuzen to shita fuan). \u00a0Thanks to this case, the Student Union no longer refers students to renters that have &#8220;no foreigners&#8221; policies. \u00a0She said that recently the Union is\u00a0politely explaining to landlords that the former\u00a0will handle any troubles that result from unpaid rents and differences in lifestyles. \u00a0Ms. Doumen added, &#8220;As a university, we accept many kinds of people. \u00a0It&#8217;s important that we see diversity not only in regards to foreign exchange students.&#8221;<\/em><\/strong><\/p>\n<p><strong><em>When contacted by Kyodo News for a comment, the representative for the Bureau, a Mr. Ohyama Kunio, responded, &#8220;We cannot comment on that case, or on whether we took up that case.&#8221; \u00a0For the sake of preserving privacy, the Bureau does not publicly speak as a matter of principle on cases that have been raised for relief.<\/em><\/strong><\/p>\n<p><strong><em>Ms. Moro-oka Yasuko, a lawyer that takes on cases of foreigner discrimination, suggested, &#8220;They probably are thinking that because the landlord refused the exchange student before it got to the contract stage, that&#8217;s why it didn&#8217;t become an explicit violation of human rights.&#8221; \u00a0<\/em><\/strong><\/p>\n<p><strong><em>The Japanese Government, a signatory to\u00a0the UN Convention for the\u00a0the Elimination of Racial Discrimination, has the duty to forbid discrimination. \u00a0However, Japan&#8217;s human rights organs have a deep-rooted image of having &#8220;insufficient enforcement power&#8221;. \u00a0Ms Moro-oka charged, &#8220;As agreed to in the treaty, Japan must make a law to eliminate all forms of acknowledge &#8220;No Foreigners&#8221; apartments as a violation of human rights.  This is the outcome of a case back in 2013, where an exchange student at Ryuukoku University was denied a flat despite going through the Student Union, and he took it to the Bureau of Human Rights for the official word on the subject.  More than two years later (presumably the poor chap wasn&#8217;t living on the street in the interim), the MOJ determined that the foreigner-averse landlord had not violated anyone&#8217;s human rights, refusing to elaborate further.  Great.  Job well done and great precedent set, BOHR.<\/p>\n<p>Two things of note:  One is a media bias.  Note how once again the 47News.jp article portrays the issue incorrectly in this scan of the sidebar illustration: It&#8217;s not &#8220;Foreigner Discrimination&#8221; (gaikokujin sabetsu no jirei). It&#8217;s racial discrimination, because the first case they cite (the Otaru Onsens Case in 1999) eventually has a Japanese being refused too.  Yet the Japanese media will almost always refuse to undermine the incorrect narrative that racial discrimination never happens in Japan.<\/p>\n<p>Second thing is that Japan&#8217;s generally ineffective Potemkin Bureau of Human Rights (jinken yougobu) has a long history of blind-eyeing the very thing it&#8217;s charged with protecting against.  As further evidence of its ineffectuality \u2013 even complicity with discriminators \u2013 here is an example where the Sapporo BOHR advised a local government (Otaru) that it has no legal obligation to pass ordinance against racial discrimination, only suggesting that the city make such an ordinance if it considers it necessary.  This is a scan of a BOHR document from my book &#8220;Japanese Only:  The Otaru Hot Springs Case and Racial Discrimination in Japan&#8221; (Tokyo: Akashi Shoten) , pg. 347 in the English version:<\/p>\n<p>Further, the BOHR has denied information to claimants on the pretext of protecting claimants from their own privacy, so I wholeheartedly agree with the exchange student&#8217;s complaints about the lack of transparency.
