Hi Blog. \u00a0Here’s something that makes me smile. \u00a0The 2018 United Nations CERD Report (CERD\/C\/JPN\/10-11) includes something that might not otherwise be there — had Debito.org not taken up the task of describing<\/a> and cataloging<\/a> discrimination for the past 25 years<\/a> (back when people were even denying that racial discrimination actually happened<\/em> in Japan!).<\/p>\n

Everything mentioned in the UN excerpt below is covered in my book Embedded Racism in Japan<\/em><\/span><\/a> (Lexington Books, 2015). \u00a0But especially close to my heart is the text enlarged below.<\/p>\n

Concluding observations on the combined tenth and eleventh periodic reports of Japan<\/strong><\/p>\n

1.The Committee considered the combined tenth and eleventh periodic reports of Japan (CERD\/C\/JPN\/10-11), submitted in one document, at its 2662nd and 2663rd meetings (CERD\/C\/SR.2662 and 2663), held on 16 August and 17 August 2018. At its 2676th meeting, held on 28 August 2018, it adopted the present concluding observations.<\/strong><\/em><\/p>\n

Situation of non-citizens<\/em><\/strong><\/p>\n

33.The Committee is concerned that:<\/em><\/strong><\/p>\n

(a)Non-citizens have reportedly been denied housing<\/a> and employment<\/a> because they are foreign nationals;<\/em><\/strong><\/p>\n

(b)Foreign nationals and individuals with a foreign appearance have reportedly been denied entry to and services of certain privately owned facilities<\/a> like hotels<\/a> and restaurants<\/a> that otherwise serve the public, including through the posting of signage reading \u201cJapanese only<\/a>\u201d;<\/h3>\n

(c)Non-citizens, in particular Koreans, continue to be excluded from the national pension scheme because of the age requirement;<\/em><\/strong><\/p>\n

(d)The State party has not yet amended its legislation to allow non-citizens to be eligible for basic disability pensions;<\/em><\/strong><\/p>\n

(e)Non-citizens and long-term foreign residents and their descendants remain excluded from public positions that engage in the exercise of public authority or public decision-making<\/a> because they do not have Japanese nationality;<\/em><\/strong><\/p>\n

(f)Some permanent residents must obtain a permit to re-enter the country prior to departing, even if they are only leaving for one day, while others do not need such a permit.<\/em><\/strong><\/p>\n

34. Bearing in mind the Committee’s general recommendation No. 30, the Committee recommends that the State party:<\/em><\/strong><\/p>\n

(a) Ensure access to housing and employment to non-citizens and foreign nationals without discrimination ;<\/em><\/strong><\/p>\n

(b) Create and enforce legislation against the posting of discriminatory signs and the practice of excluding public services by privately owned facilities, such as hotels and restaurants, to persons on the basis of being a foreigner or of foreign appearance;<\/h3>\n

(c) Ensure that non-citizens are included in the national pension scheme ;<\/em><\/strong><\/p>\n

(d) Amend legislation to allow non-citizens to be eligible for basic disability pensions ;<\/em><\/strong><\/p>\n

(e) Allow non-citizens, especially long-term foreign residents and their descendants, to have access to public positions that engage in the exercise of public authority or public decision-making ;<\/em><\/strong><\/p>\n

(f) Eliminate the permit requirement prior to departure for some permanent residents so that they may enter and exit the country in the same manner as other permanent residents ;<\/em><\/strong><\/p>\n

(g) Consider ratifying the Convention relating to the Status of Stateless Persons and the Convention on the Reduction of Statelessness.<\/em><\/strong><\/p>\n
