After a very nasty discussion on Debito.org last month, regarding the validity of a story by Brian Hedge that a 74-year-old tourist was incarcerated for more than a week just for holding a pocket knife, the Japan Times has come through (The only media to bother — subscribe to the paper, everyone! Who else you gonna call?) and confirmed that it actually did happen. The Japan Times Community Page also ran a series of responses on Tuesday from readers, many outraged, by this treatment. The Law regarding Roppongi Urine Sampling and “Random Searches”:

Police cannot search your person, property or possessions without a warrant. Ask for one: “Reijou ga arimasu ka?”

If they threaten to take you to a police box for questioning, refuse and don’t move. Police cannot force you to go anywhere without a formal arrest (taiho).

But be careful. Do not raise your voice. And never ever touch the cop, or they could arrest you for “obstruction of duty.” This is why sometimes you see street standoffs between cops and questionees during which nobody moves or talks until somebody gets tired and goes home.

Know your rights by checking out www.debito.org/whattodoif.html, or read more in our “Handbook for Newcomers, Migrants, and Immigrants.” But don’t assume the police will give the public the same cooperation they demand from the public. Accountability gets in the way of their modus operandi. Laws protecting people against invasive procedures interfere with keeping the streets safe from foreigners.

Tangent: Japan Times on crackdowns on students at Hosei University

Japan Times: Illegal arrests, forced expulsions, “kidnappings” by security police and beatings by hired thugs. No, it’s not another dispatch from a violent banana republic. Those accusations come from the leafy back-streets of Ichigaya, Tokyo, home to a branch campus of the prestigious Hosei University.

Hosei authorities and a group of students are locked in a poisonous struggle that has turned the campus into something resembling a low-security prison.

Entrances are guarded by newly installed CCTV cameras and jittery guards equipped with Bluetooth headsets. Notices have been published at many sites naming and shaming “troublemakers” who have been expelled, and the police are on call in case things get out of hand.

A provisional injunction forbids students from “loitering, putting up banners and making speeches within 200 meters” of the campus.

Since the dispute began three years ago, 107 students have been arrested and 24 indicted, some of whom awaited trial in detention centers for up to six months. Last Friday, five more students were formally charged with offenses including trespassing and obstructing the police. Another is being kept in detention for at least two more weeks.

Supporters say some have been framed using a prewar law designed to crush labor protests…

UN News: US among 18 nations elected to UN Human Rights Council

From two UN News articles: In becoming a member of the United Nations Human Rights Council, a country not only takes on greater responsibility for tackling abuses worldwide, but also lays bear its own record for the scrutiny of others, the world body’s top rights official said today…

She noted that critics of the Council point to the fact that among its 47 members are countries with “less-than-pristine” human rights records.

“To those critics I say two things: Is there any country that has a blemish-free record? Human rights violations are not the bane of any particular country or region. And even if such a thing were possible, what impact would a club of the virtuous have on those outside?”

The General Assembly on May 12, 2009, elected 18 countries to serve on the Geneva-based United Nations Human Rights Council for three-year terms starting next month, including – for the first time – Belgium, Hungary, Kyrgyzstan, Norway and the United States.

The Assembly also re-elected Bangladesh, Cameroon, China, Cuba, Djibouti, Jordan, Mauritius, Mexico, Nigeria, Russia, Saudi Arabia, Senegal and Uruguay. All 18 members elected today will begin their terms on 19 June.

UN News on upcoming Durban human rights summit and Gitmo

Two posts from UN NEWS that are tangental but within the pale of Debito.org.

First up is news about the next big human rights summit in Durban, South Africa. The last one was at the beginning of this decade. Those interested in attending (I would, but again, no money) might want to start making plans.

Second, I was asked recently by a friend, “What do you want to see Obama do immediately after taking office?” I answered back with a question, “You mean personally, or big-picture?” Both. “Okay, personally, state publicly that the USA will not support any application by Japan to the UN Security Council until it honors its treaty promises, including passing an enforceable law against racial discrimination.” But that’s easily backburnerable. “But big-picture, I want to see Obama close Guantanamo, that running sore of human-rights abuses that is arguably doing more to encourage anti-American sentiment worldwide than anything else.”

Well, the big-picture was precisely what Obama took steps to do his first working day in office. Bravo. And the UN recognizes it as such.

South Korea’s 2007 “Basic Act on Treatment of Foreigners Residing in Korea”. Hello Japan?

In 2007, South Korea passed “The Basic Act on Treatment of Foreigners Residing in Korea”, a law regarding equitable treatment and human rights protections for foreigners and naturalized Koreans. This is on top of government apparatus established specifically to enforce those protections. While I’m sure the system is far from perfect (the UN’s comments below are eerily similar to what goes on in Japan), if South Korea can pass a law on this, so can Japan. Jenkins get his Permanent Residency in record time. Congratulations, but…

Just heard yesterday that Charles Jenkins, long-suffering veteran of North Korea (who got a very harsh life after defecting from the US military from South Korea, before I was even born!), just got his Permanent Residency (eiuuken) in record time (a coupla weeks). And with fewer years spent here (four) than the average applicant (generally five years if married to a Japanese, ten if not married). With personal consideration from Justice Minister Hatoyama.

Congratulations Mr Jenkins. Seriously. I’m very happy you can stay here with your family as long as you like, and may you have a peaceful and happy rest of your life out on Sadogashima.

But I wish the often strict procedures given other applicants could have applied to him as well. Again, as with the case of Fujimori (who was “naturalized” in about the same amount of procedural time) and certain sports figures, politics keeps infiltrating the application process for assimilation. Inevitable, some might say, but still a shame when there are people as eminently qualified as Mr Jenkins being refused…

Kimura Kayoko of Nikkan Berita reports:

Recently, as the eve of the G8 Summit approaches, we are seeing incident after incident of non-Japanese being stopped at airports.

NJ who are coming here for G8 Summit activities (including reportage and convocations), without connections to governments or major press outlets, are apparently being subjected to background searches. 24-hour detentions are not unusual.

Last night (June 27), three Hong Kong citizen journalists who have been registered with the Citizens’ Media Center (Sapporo) were detained by Immigration, and were on the verge of being deported.

This morning, Susan George (ATTAC France) was stopped and questioned at the airport. Ms George is 74 years old, and her detention demonstrates a lack of humanity on the part of authorities.

Similar measures on the part of Immigration are forecast to continue in this vein.

LA Times: US giving liver transplants to Yakuza with FBI assistance

LA Times: “UCLA Medical Center and its most accomplished liver surgeon provided a life-saving transplant to one of Japan’s most powerful gang bosses, law enforcement sources told The Times. In addition, the surgeon performed liver transplants at UCLA on three other men who are now barred from entering the United States because of their criminal records or suspected affiliation with Japanese organized crime groups…

The most prominent transplant recipient, Tadamasa Goto, had been barred from entering the U.S. because of his criminal history, several current and former law enforcement officials said. Goto leads a gang called the Goto-gumi, which experts describe as vindictive and at times brutal. The FBI helped Goto obtain a visa to enter the United States in 2001 in exchange for leads on potentially illegal activity in this country by Japanese criminal gangs, said Jim Stern, retired chief of the FBI’s Asian criminal enterprise unit in Washington…”

The FBI did not help Goto arrange his surgery with UCLA but did help him gain entry to this country, Stern said. The agency had long been frustrated by the reluctance of Japanese law enforcement to share information on yakuza members in the United States.

…”For American law enforcement, it’s been like pulling teeth to get criminal intelligence from Japanese authorities,” said David Kaplan, a journalist who co-wrote the book “Yakuza: Japan’s Criminal Underworld,” published in 2003 by the University of California Press…

Highlights of UN OHCHR Universal Periodic Review of Japan’s Human Rights Record, May 14, 2008

Here’s what investigating countries at the United Nations are saying about Japan’s human rights record. First, some highlights of what the GOJ itself says it’s doing about following treaties and human rights standards, then other countries respond with a surprising degree of awareness. The biggest issues seem to be the death penalty, human trafficking, and rights for women (with historical issues brought up by neighboring Asian countries), but as far as Debito.org is concerned, there is plenty of attention devoted to issues we’ve been raising all along. Even if Special Rapporteur Doudou Diene’s reports on racism in Japan are mostly being ignored by our government, they certainly are being read by members of the UN. Do try to read parts of the UPR Report with a straight face, as that’s what our government is making a number of risible claims with. I offer links to sections on Debito.org that are at odds with the GOJ’s claims.

UN OHCHR Minority Update: Japan reviewed by Human Rights Council

Here are two updates on Japan’s human rights behavior being considered for periodic review by the UN Human Rights Council. This is a new activity by the UN after the old Human Rights Commission was disbanded, accused for many years of having the world’s worst human-rights offenders as leaders, there covering up their own abuses. Now under this new organ with the same acronym, everyone is being subject to review once every four years. And according to the press releases below, Japan’s turn came last week. Forwarding primary-source documents to you. Pertinent sections underlined. As it says below, you can also submit documents to the OHCHR if you want about human-rights abuses in Japan. Japan Today: NJ suspect acquitted by J Court, yet still detained–for overstaying his visa due to denial of bail!

Here’s another way to make sure you perpetually incarcerate any NJ suspected of any crime. Even if they’ve even been acquitted in court, just keep them in detention (after all, NJ aren’t allowed bail in Japan) long enough, and then you can get them for overstaying their visa! “Hostage Justice’s” safety catch…

Japan Times ZEIT GIST: G8 Summit and the bad “security” habits brought out in Japan

Japan Times column on the Hokkaido G8 Summit: The point is, international events bring out bad habits in Japan. And now we have Tokyo bidding for the 2016 Olympics? Cue yet another orgiastic official fear-and-crackdown campaign foisted on the public, with the thick blue line of the nanny state the biggest profiteer. Conclusion: I don’t think Japan as a polity is mature enough yet to host these events. Japan must develop suitable administrative checks and balances, not to mention a vetting media, to stop people scaring Japanese society about the rest of the world just because it’s coming to visit. We need to rein in Japan’s mandarins and prevent them from converting Japan into a police state, cracking down on its already stunted civil society.

US State Dept Country Reports on Human Rights Practices, 2007, Japan

Although the US is certainly no paragon of human rights worldwide (what with torture, renditions, abuses under SOFA, denial of Habeas Corpus to non-citizens, Guantanamo, Abu Ghraib, and the largest arms sales worldwide, to name but a few caveats under this administration), here is their annual report on human rights in Japan in full. For what it’s worth. Note how the situation of “Japanese Only” signs nationwide is no longer mentioned, like it was in previous reports. I guess the US State Department considers the situation resolved. I beg to differ.

Rough Guide on what to do if and when arrested in Japan

Anonymous Guide: “In Japan, police can arrest anyone, any time. They do not come announced. There are no government leaflets that prepare you for the catastrophe. So, I wrote this one instead, compiled from my own painful experience and those of many other foreigners in Japan. The actual chances to be arrested in Japan are much higher than the chances to be hurt by an earthquake in Japan – especially if you are a foreigner. Don’t think that you will be able to deal with it just because “you know your rights” from back home or from Hollywood court movies. Japan is not about justice, it is about bustice. So prepare yourself for the real big bang – read this.”

“Hostage Justice”: Swiss woman acquitted of a crime, but detained for eight months anyway during prosecution’s appeal

Here’s another oddity of the Japanese judiciary–“hostage justice”. The prosecution is so strong in this country that, in the extremely rare case (less than one percent of all cases that go to trial) they lose a criminal case judgment (and the accused goes free), they can appeal. But, as you can see in the article below, the rights of the accused differ by nationality. If you are a Non-Japanese, and even if you are judged innocent by a lower court, you are still incarcerated for however many months it takes for the higher court to deliver a verdict (in this case, innocent again). Because, you see, foreigners aren’t allowed bail in Japan. Unlike Japanese. When Japanese appeal guilty verdicts, they are not detained (see Horie Takafumi and Suzuki Muneo; the latter, now convicted of corruption twice over, is still on the streets, even re-elected to the Diet!).

Two articles from The Economist on bent Japanese criminal justice system, death penalty

The Economist, two articles: “Article 34 of the Japanese Constitution guarantees the right to counsel and habeas corpus, but is systematically ignored. Police and prosecutors can detain suspects for 23 days. Interrogations are relentless and sometimes abusive. Prosecutors are reluctant to bring cases to trial without a confession. Indeed, it is considered a first step in a criminal’s rehabilitation. When asked about the country’s 99% conviction rate, Japan’s justice minister, Kunio Hatoyama, corrected your correspondent to state that it was actually 99.9%, because prosecutors only present cases that are watertight.”… “The notion of being innocent until proven guilty is not strong in Japan. Mr Hatoyama calls it “an idea which I want to constrain”. But confessions are important and the courts rely heavily upon them. Apart from helping secure convictions, they are widely interpreted as expressions of remorse. A defendant not only risks a longer sentence if he insists he is innocent, he is also much less likely to be granted bail before trial—often remaining isolated in police custody, without access to counsel, for long enough to confess. Toshiko Terada, a private lawyer, calls this hitojichi shiho—hostage justice. Perversely, where little supporting evidence exists, the system helps hardened criminals, who know that if they do not confess they are unlikely to be indicted. Innocents, on the other hand, may crack—as in the Kagoshima case, or in a notorious 2002 rape case when the accused confessed under pressure but was released last October after the real culprit came forward.”

“Foreign crime” in reverse: The Miura Kazuyoshi Case

Of tangental interest to Debito.org is the case of Miura Kazuyoshi. Here is a person convicted of killing his wife in a lower Japanese court unusually vindicated by a higher court. Then he gets arrested in US territory (which avoids double jeopardy) for the same crime nearly 25 years later. Wouldn’t it be yet another black eye for the Japanese judiciary if the US convicts him instead? We won’t know for a little while (but it will take definitely less time than the Japanese judiciary; hey, it took Miura four years for his High Court verdict, and Asahara has been on trial for more than a decade now…) Is this guy the Japanese O.J. Simpson or what? Instead of using the race card, he uses the “foreign crime” card…

FCCJ Photo Journalist Per Bodner’s account of his arrest on fictitious “assault charges”

Per Bodner, a professional photo journalist from Sweden (8 years resident in Japan, married with a house here), was arrested and charged with a alleged assault on a Tokyo taxicab driver right outside the Foreign Correspondents’ Club of Japan on his way home from work November 28. Himu Case: Tokyo District Court orders Sankei Shinbun to pay NJ damages for reporting erroneous al-Qaeda link

Some good news for a change: A Bangladeshi by the name of Islam Himu was accused during the al-Qaeda Scare of 2005 of being part of a terrorist cell. And the media, particularly the Sankei, reported him by name as such. Detained for more than a month by the cops, he emerged to find his reputation in tatters, his business rent asunder, and his life irrevocably changed. This is why you don’t report rumor as fact in the established media. And as we saw in the Sasebo Shootings a few days ago, the papers and the powers that be won’t take reponsibility even when they get it wrong and destroy somebody’s life. So Mr Himu sued the Sankei. And won. Congratulations. A good precedent. Now if only could get the Japanese police to take responsibility when they overdo things. Well, we can dream. Asahi: Hunger strike after rotten food in Immigration Gaijin Tank

You know things have gotta be pretty antipathetic when even inmates have bad food (and food in Japanese prison, from what I’ve read, is apparently sparse but not all that unhealthy). But then again, this is not a prison. It’s a Gaijin Tank–where NJ are held indefinitely and not subject to the same standards (such as exercise, baths, time outside their cells, and–most importantly–a definite time limit to their incarceration) that people who have been formally sentenced to a Japanese prison will have.

Back to the food. Remember where we are: This being Japan, a land of foodies, it’s famous for being a place where it’s hard to get a truly bad meal. People are really fussy, and it shows in the marketplace. No professional in their right mind in the Japanese meal services lets quality slip.

It might be the effect of a captive market, literally, meaning no competition and no incentive for quality control.

Or it might be antipathy. Either this Detention Center’s meal preparers are completely shameless people, or they just don’t like foreigners and feel no compulsion to serve them properly.

Anyway, pretty stunning. Stop faffing about and fire the cooks already, Immigration.

Excellent Economist editorial on anti-terrorism measures and civil liberties

Excellent article in The Economist this week regarding anti-terrorism measures and the erosion of civil liberties. How the pendulum has begun swinging back. As a twenty-year reader of The Economist, I’ve noticed a constant editorial slant favoring market-based solutions to just about everything, and the comcomitant (but wan and blinding) hope that the more politically-conservative elements of governments in the developed economies would follow their preferred course. Hence their often backwards-bending support of the current administration in the world’s most powerful economy, which has long demonstrated a pursuit of power for its own (and its cronies’ own) sake. Now, after struggling for years to come to terms with (and offering conditional, but certainly evident, support for) the American curtailment of civil liberties (enabling other countries, such as Japan, to take pages from their book and create policy rendering all foreigners suspicious as terrorists), this week’s Economist finally comes down against the erosion. Bravo. Now if only Japan’s opinion leaders were as intelligent and outspoken about the flaws in Japan’s new anti-terrorist and foreign-crime targeting regime…

Fujimori finally gets his–extradition to Peru

Former President Alberto Fujimori returned to Peru on Saturday to face charges of corruption and sanctioning death-squad killings, a grim homecoming for the strongman who fled the country seven years ago as his government collapsed in scandal. He was flying to Peru under police custody Saturday, a day after the Chilean Supreme Court ordered his extradition on human rights and corruption charges.

LAT: First recorded police confession OK as evidence

LA Times: For the first time, a DVD recording of a suspect confessing his crime to police was admitted as evidence in a Japanese court Friday, a move that could lead to stricter checks on the lengthy, secret police interrogations that defense lawyers say result in pressure on suspects to make false confessions. Prosecutors and police have long resisted demands from human rights activists and lawyers to record their questioning of suspects, who can be held without charge for 23 days in special police cells with limited access to defense lawyers. But a court case here may open the way for greater oversight of the confession-based investigation culture.

NYT on forced confessions by Japanese police

In all, 13 men and women, ranging in age from their early 50s to mid-70s, were arrested and indicted. Six buckled and confessed to an elaborate scheme of buying votes with liquor, cash and catered parties. One man died during the trial — from the stress, the others said — and another tried to kill himself. But all were acquitted this year in a local district court, which found that their confessions had been entirely fabricated. The presiding judge said the defendants had “made confessions in despair while going through marathon questioning.” The Japanese authorities have long relied on confessions to take suspects to court, instead of building cases based on solid evidence. Human rights groups have criticized the practice for leading to abuses of due process and convictions of innocent people.

Lucie Blackman’s alleged killer acquitted, given life for other crimes

The alleged killer of hostess Lucie Blackman, whose body was found a short walk from serial racist and killer Obara Jouji, was aquitted of murdering Blackman due to “circumstantial evidence”. This in a system where circumstantial evidence has gone a long way in other verdicts which turned out guilty, and why does it increasingly seem like the police do a half-assed job when crime is committed against non-Japanese…?

Asahi Column: Tokyo JH school refuses education to NJ child

“Currently, the most important law on education in Japan, as well as the very Constitution, does not guarantee the right to education for children with foreign nationalities. Our eldest daughter, who has only Brazilian nationality, was once denied entrance to a public junior high school in Setagaya Ward, Tokyo, when trying to transfer from a school in Brazil at the age 15 in the ninth grade. Officials said our daughter was a year older than the proper age for obligatory education. They explained that exceptions cannot be made because the obligatory education system does not apply to a child without Japanese nationality.”

Yomiuri Jan 24 07 on foreigners “filling” J prisons

Interesting stats: About 3,200 inmates, 360 more than the capacity, are held at Fuchu Prison. Among them, about 550 are foreigners. The number is 1.3 times more than were incarcerated 10 years ago. Fuchu prison houses inmates from 46 countries who speak 35 languages. The figure has increased from 22 countries in 1986, and 39 in 1996.The number of foreign inmates nationwide was 5,312–2.6 times more than a decade ago.
